A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann was
presiding. Roll call members present: Michael Stromer — District 1, Lee Hogan- District 3, Scott Thomsen —
District 4, Dale Curtis- District 5, Chuck Neumann — District 6, Eldon Orthmann — District 7

Motion by Neumann, seconded by Stromer that this is an open public meeting of the Adams County Board of
Supervisors. Roll CaII; Ayes: Stromer, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None, Absent:

Orthmann stated that minutes from the December 20, 2016 meeting have been circulated and will stand
approved unless there is a correction.
No corrections were suggested
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda
was available to the board members and was kept continuously current and posted in the County Clerk's office,
the main courthouse lobby and the Adams County website. The following is the agenda of items to be heard, no
modifications were made to the agenda after 9:30 a.m. the business day prior to this meeting.

Chairman Orthmann opened the meeting for public comment.
Adams County Roads Superintendent, Dawn Miller, spoke during public comment to advise the board of some
larger projects for the upcoming calendar year, including various asphalt projects and construction on Adams
Central Road.
Miller also provided an update to damage done during the December 25, 2016 windstorm. Miller advised
damage was minimal but there were some trees that fell on county roadways.

Chairman Orthmann requested that any old business be addressed prior to starting the 2017 Board
reorganization process.

Motion by Neumann, seconded by Stromer that the 2016 sessions of the Adams County Board of Supervisors be
adjourned sine die and appoint the County Clerk as temporary Board Chairperson. Roll CaII; Ayes: Stromer,
Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None, Absent: Weeks
Adams County Clerk, Ramona Thomas, requested nominations for the 2017 Adams County Supervisor Chairman.
Supervisor Scott Thomsen nominated Eldon Orthmann for the 2017 Adams County Board Chairman.
Clerk Thomas requested additional nominations
Motion by Neumann to cease nominations and cast a unanimous ballot for Supervisor Orthmann. Motion
seconded by Thomsen. Roll Call; Ayes: Stromer, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None,

Orthmann will retain the chairman position for the 2017 calendar year.
Chairman Orthmann requested nominations for the 2017 Adams County Board of Supervisors Vice Chairman.
Supervisor Thomsen nominated Dale Curtis for the 2017 vice chairman position.
Motion by Neumann, seconded by Thomsen to cease nominations and cast a unanimous ballot for Dale Curtis as
the 2017 Adams County Board of Supervisors Vice Chairman. Roll Call; Ayes: Stromer, Hogan, Thomsen, Curtis,
Neumann, Orthmann. Nays: None, Absent: Weeks
Supervisor Dale Curtis will retain the vice chairman position for the 2017 calendar year.
Chairman Orthmann stated all committee and liaison appointments will stand, with the exception of Lee Hogan
moving from the Hastings Library Liaison position to the Combined Services Liaison position, and Michael
Stromer will replace Hogan as the Hastings Public Library Board Liaison.
Chairman Orthmann requested a motion to name the following banks as Adams County depositories: Wells
Fargo, Heritage Bank, Pinnacle Bank, Adams County Bank, Nebraska Public Agency Investment Trust, Five Points
Bank, US Bank, Geneva State Bank, Bank of Doniphan.
Motion by Stromer, seconded by Curtis to approve the banks listed by Chairman Orthmann as Adams County
depositories. Roll Call; Ayes: Stromer, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None, Absent:

Orthmann requested a motion to authorize the County Treasurer to deposit funds in the following local banks;
Wells Fargo, Adams County Bank, Nebraska Public Agency Investment Trust, Five Points Bank
Bank of Doniphan, US Bank and Geneva State Bank.
Motion by Stromer, seconded by Neumann to approve the treasurer depositing funds in the banks presented by

Adams County Emergency Management Director, Chip Volcek, presented the Board with an Emergency
Response Plan for Adams County.

Volcek outlined the content of the plan and stated it outlines procedures for all buildings to follow in the event
of an emergency or evacuation.
Motion by Thomsen, seconded by Stromer to approve the Emergency Response Plan for Adams County, as
presented by Volcek. Roll Call; Ayes: Stromer, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None,
Absent: Weeks
Volcek will distribute the plan to all offices and will provide training if necessary.
Adams County Planning and Zoning Director, Judy Mignery, present the Board with the Livestock Friendly Report
that she had submitted to the Nebraska Department of Agriculture. The full report is available at the Planning
and Zoning office and the Adams County Clerk.
Adams County Deputy Attorney, David Bergin, presented the Board with Resolution 2017-01-03.01, to amend
the Adams County Employee Handbook relating to catastrophic sick leave.
Bergin stated that the newest version of the Adams County Employee Handbook omitted guidelines pertaining
to the catastrophic sick leave policy. Resolution 2017-01-03.01 states that any employees who had accrued
catastrophic sick leave prior December 20, 2011 would be allowed to retain that benefit and utilize it in the
event of a catastrophic illness.
Motion by Thomsen, seconded by Neumann to approve Resolution 2017-01-03.01; updating the catastrophic

RESOLUTION
TO AMEND THE ADAMS COUNTY EMPLOYEE I-IANDBOOK.
RELATING TO CATASTROPHIC ILLNESS LEAVE
Adams County Resolution No.
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ADAMS COUNTY.
NEBRASKA that:
On page 25 (lithe Adams County Employees Handbook which was most recently fully revised
on December 2(), 2011, between the section entitled 'SICK LEAVE BANK PROGRAM" and
the section entitled `BLOOD DONATION TI3ME OFF", insert the following new section:
CATASTROPHIC ILLNESS LEAVE
The policy of granting catastrophic illness leave was repealed by the Adams County Board of
Supervisors on December 20, 2011. No employee shall have been credited for catastrophic
illness leave which shall have accrued subsequent to that date. No employee whose employment
commenced subsequent to that date shall accnie any catastrophic illness leave. However, any
employee who shall have accrued any catastrophic illness leave prior to December 20, 2011 shall
retain such accrued leave and may use such leave in accordance with the following rules.
The hollowing rules regarding catastrophic illness leave shall apply only to catastrophic illness
leave accrued prior to December 20, 2011, and to no other kind of sick leave described in the
Adams County Employee Ilandbook.
Employees may request paid catastrophic illness leave accrued prior to December 20, 2011
when: 1) the employee is suffering from a catastrophic illness as defined in this section; and 2)
the employee has exhausted all sick leave, vacation leave, and other paid leave available.
No payment shall be made to the employee for unused accrued catastrophic illness leave at the
termination of employment.
Adams County may refuse to grant catastrophic illness leave if the employee does not provide
medical records and other information related to the illness which are requested by Adams
County or its officials. It is the employee's responsibility to sign whatever waivers or consents
are required by the physician, hospital, or other health care provider to permit the information
requested by Adams County to be turned over to Adams County.
For the purposes of this section, "CATASTROPHIC ILLNESS" shall mean any of the following:
cancer, heart attack, stroke, kidney disease, acquired immunodeficiency syndrome (AIDS) or its

disabling complications, Alzheimer's disease, multiple sclerosis, muscular dystrophy, or any kind
of traumatic injury which results in the loss of use of an arm or leg for the period of thirty (30) or
more consecutive days, or actual physical loss of an arm or leg, or loss of sight in either or both
eyes for a period of thirty (30) or more consecutive days.

At 10:15 a.m., Adams County Highway Superintendent, Dawn Miller, opened a bid for farm rental ground owned
by Adams County. Notice was published in the Hastings Tribune on December 13, 20 and 27, 2017 that sealed
bids would be accepted for the advertised land.
NOTICE TO BIDDERS
The Board of Supervisors of Adams County, Nebraska, will receive sealed bids at the
Office of the Adams County Clerk in the Adams County Courthouse, P.O. Box 2067,
West 4th St., Hastings, Nebraska 68901, until 9:30 a.m. on Tuesday, January 3, 2017, and
at 10:15 a.m. the bids will be publicly opened, read and compared. A contract will be
awarded to the highest bidder(s) for the renting of three parcels of farm ground owned by
Adams County in the Southeast Quarter of Section 8, T7N-R1OW, Adams County,
Nebraska (at the location of the Adams County Public Works Department),
All bids submitted will be for a cash rent amount per acre per parcel, payable as specified
in the bid proposal documents.
Successful bidder will be required to enter into a rental agreement with Adams County
upon award of the bid. Said rental agreement will be for a period of five (5) consecutive
years.
Bid Proposal documents and copies of the Rental Agreement are available at the Office
of the Adams County Highway Superintendent, 415 North Adams Central Avenue,
Juniata, Nebraska 68955.
The Board of Supervisors reserves the right to reject any or all bids, and to waive any
informalities or technicalities in bids.

not required to accept the bid if they feel it is too low.

techniques, sequences, and procedures of construction to be employed by Bidder; and (3) Bidder's

F. Bidder agrees, based on the information and observations referred to in the preceding paragraph,
that no further examinations, investigations, explorations, tests, studies, or data are necessary for
the determination of this Bid for performance of the Work at the price bid and within the times
required, and In accordance with the other terms and conditions of the Bidding Documents,
G. Bidder is aware of the general nature of work to be performed by Owner and others at the Site that
relates to the Work as indlcated in the Bidding Documents.

2. "fraudulent practice" means an intentional misrepresentation of facts made (a) to
influence the bidding process to the detriment of Owner, (b) to establish bid prices at
artificial non-competitive levels, or (c) to deprive Owner of the benefits of free and
open competition;
3. "collusive practice" means a scheme or arrangement between two or more Bidders,
with or without the knowledge of Owner, a purpose of which is to establish bid prices
at artificial, non-competitive levels; and
4. "coercive practice" means harming or threatening to harm, directly or indirectly,
persons or their property to influence their participation in the bidding process or
affect the execution of the Contract.

ARTICLE 6 —TIME OF COMPLETION
6.01 Bidder agrees that the Work will be substantially complete on or before May 1, 2017, and will be
completed and ready for final payment in accordance with Paragraph 15.06 of the General
Conditions on or before May 15, 2017.
6.02 Bidder accepts the provisions of the Agreement as to liquidated damages.

SERIICES
BY AND AMONG
THE COUNTIES OF ADAMS, BUFFALO, DAWSON, PHELPS, MERRICK AND
HALL, THE CITIES OF GRAND ISLAND, HASTINGS, KEARNEY, IIOLDREGE,
LEXINGTON, AURORA, AND COZAD
THIS AGREEMENT is made and entered into this 14th day of August, 2016, by
and between the Counties of Adams, Buffalo, Dawson, Phelps, Ivlerrick, and Hall and the
Cities of Grand Island, Hastings. Kearney, I-Ioldrege, Lexington, Aurora, and Cozad, all
being bodies politic and corporate and political subdivisions of the state of Nebraska,
hereinafter referred to collectively as the "Parties" and individually as a "Party."
WITNESSETH:
WHEREAS, the Parties desire to form an alliance among law enforcement
agencies of the Parties known as SCALES (South Central Area Law Enforcement
Services) to: promote cooperation among such agencies to combat crime in the most
effective manner possible; provide for joint acquisition of equipment and materials; and
allow for cooperative sharing and utilization of investigative resources; and
WHEREAS, the Interlocal Cooperation Act, NEB. REv. STAT. §13-801, et seq.
provides that units of local government of the State of Nebraska and Nebraska state
agencies may enter into agreement for the joint and cooperative exercise of powers,
privileges, or authority capable of being exercised by either agency; and '
WHEREAS, NEB. REV. STAT. §13-801 provides that any one or more public
agencies may contract with any one or more public agencies to perform any
governmental service, activity, or other undertaking which each public agency entering
into the contract is authorized by law to perform; and
WHEREAS, Counties and Cities are public agencies as defined by Nan. REV.
STAT. §13-801; and
WHEREAS, NEB. REV. STAT. §29-215 authorizes municipalities and counties to
enter into contracts with any other municipality or county for law enforcement services or
joint law enforcement services."
NOW, THEREFORE, the parties mutually covenant and agree as follows:
Term, This agreement shall have a term of five (5) years commencing August 14th,
2016. Said agreement shall automatically renew for no more than five successive
terms of one year each unless written notice of the non -renewal is provided by the
non -renewing party to the other parties not less than 60 days prior to the expiration of
the then current term.

2) Termination. This agrcement may he terminated at an). time, with or Without cause
upon the mutual consent of a majority ol'the member Parties.
3) Withdrawal. Any Party may withdraw from this agreement at any time, with or
without cause, upon providing to the non -withdrawing Parties a written notice of suet
withdrawal given not less than sixty (60) days prior to the effective date of the
withdrawal.
4) Governance. The activities of the cooperative undertaking shall be governed by a
board comprised of the Sheriff or Chief of Police from each of the Parties, hereinafter
referred to as the "Board." The Board shall meet not less than two times each
calendar year. The Board shall select as officers a chairperson and a secretary who
shall serve terms of one year. A quorum of not less than a majority of the Board shah
be required to take action. All questions before the Board shall be determined by
majority vote of the members present. The Board may adopt such by-laws and rules
of procedure as deemed appropriate by the Board.
5) Cooperative Powers and Authority. Bach Party's Chief of Police or Sheriff may
supply manpower and other resources, when available, upon the request of a Party to
assist with any law enforcement activities including, but not limited to:
a) the investigation or prevention of any crime;
b) the service and execution of any search warrant, and
c) the making of any arrest.
6) Law Enforcement Powers. Any sheriff, deputy sheriff, marshal, deputy marshal,
police officer or peace officer employed by any Party shall have the power and
authority to enforce the laws of the State of Nebraska and to perform the functions of
his or her office anywhere within the geographic territory of any Party when acting or
participating in a cooperative investigation or cooperative law enforcement activity at
the request of any Party's Sheriff or Chief of Police or an authorized designee of any
such Sheriff or Chief of Police.
7) Ciairns and Indemnity. At all times while acting or participating in a cooperative
investigation or cooperative law enforcement activity, any such participating sheriff,
deputy sheriff, marshal, deputy marshal, police officer or peace officer shall remain
the employee of the Party supplying such officer. Bach Party shall provide liability
insurance and indemnification for its own personnel as provided in NEB. REV. STAT,
§13.1802,
8) Modification. This Agreement may be modified by written agreement of the Parties.
9) No Separate. Entity. There shall be no separate legal entity created through this
interlocal cooperation agreement. Said agreement shall be jointly administered by thi
Board as provided in section 4, above.
10) Property. Any property acquired or made available by any party to this agreement
for the purposes of this agreement shall remain the property of the party acquiring or
making such property available and shall he disposed of such party as provided by
law, regulation. or ordinance governing the same.
a) Any property acquired ,jointly shall, upon termination, be equitably distributed
among the Parties based upon the Parties' financial contributions toward the
purchase and maintenance of any such property. In the event any Party withdraws
from this agreement, an equitable distribution of the jointly held property, or the
fair market value thereof, shall be made to the withdrawing party based upon the
withdrawing Party's financial contributions toward the purchase and maintenance
of any such jointly held property.
b) Any property to be purchased and jointly held by the Parties shall be purchased
pursuant to the purchasing rules or statutes applicable to the Party making the
purchase on behalf of the Parties.
c) Any surplus or unusable jointly held property shall be disposed pursuant to the
rules or statutes applicable to the Party making such disposition on behalf of the
Parties. The proceeds of any sale or disposition of jointly held property shall be
equitably distributed among the Parties based upon the Parties' financial
contributions toward the purchase and maintenance of any such property.
d) An inventory of all property jointly held and a report on the disposition of any
joint property sold, transferred or disposed of during the prior twelve months shall
be provided to the City or County Clerk of each Party on or prior to April 1 of
each year.
11) Finances. This agreement shall he financed by funds available to the parties hereto.
12) Provision of Assistance. Pursuant to the Interlocal Cooperation Act, any party to
this agreement, in the party's sole discretion, may appropriate funds and may sell,
lease, give, or otherwise provide assistance, including personnel and services, as may
be within the party's legal power to furnish.
13) Additional Agreements.
a) The provisions of this agreement shall not be construed to impose an obligation
on any Party to this agreement to respond to a request for assistance. At any time
assistance is requested, the Party so requested may, for any reason, deem it
advisable not to respond and may so inform the requesting party.
b) This agreement shall become effective for each party when that party by
ordinance, motion or resolution adopts and approves this agreement and
authorizes the proper official to execute this agreement.
c) Additional cities or counties may become parties to this agreement upon
acceptance and execution of this agreement, and upon approval by the governing
bodies of the Parties already a party to this agreement.
