A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann was presiding.
Roll call members present, Michael Stromer - District 1, Glen Larsen — District 2, Lee Hogan- District 3 , Scott Thomsen —
District 4, Dale Curtis- District 5, Chuck Neumann — District 6, Eldon Orthmann — District 7.
Motion by Curtis, seconded by Stromer that this is an open public meeting of the Adams County Board of Supervisors.
Roll Call; Ayes: Stromer, Larsen, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None.
Orthmann stated that minutes from the Oc, 2017 meeting have been circulated and will stand approved unless there is a
correction.
No corrections were suggested
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was
available to the board members and was kept continuously current and posted in the County Clerk's office, the main
courthouse lobby and the Adams County website. The following is the agenda of items to be heard, no modifications
were made to the agenda after 9:30 a.m. the business day prior to this meeting.

Chairman Orthmann opened the meeting for comments from the public.
Adams County Highway Superintendent, Dawn Miller, spoke during public comment regarding the technical
program at CCC that Chairman Orthmann mentioned in his committee report. Miller stated that she had just
hired a graduate with the program and was very complementary of the program.
Adam County Maintenance Department Supervisor, Thomas Richert, addressed the Board regarding the broken
elevator used for the Adams County Jail. Richert stated the repairs will be in excess of $20,000.00 therefore
requiring bids unless the Board determines this is an emergency repair in which the bidding process would be
waived.
Discussion occurred among the Board members to determine if the lack of an elevator for the jail would be
considered an emergency. With the lack of the elevator it would be necessary to transport prisoners through
public areas causing public safety concerns.
Motion by Thomsen, seconded by Neumann to waive the bidding process for repairs to the jail elevator as it is
an emergency purchase. Roll Call; Ayes: Stromer, Larsen, Hogan, Thomsen, Curtis, Neumann, Orthmann.

Deputy County Attorney, David Bergin, addressed the room and requested anyone wishing to speak in favor of
selling the property to come forward and speak.
Cathy Watts of Hastings spoke in favor of selling the property as she may be interested in placing a bid for
purchase.

No other comments were made in favor of selling the property.
Deputy Attorney Bergin addressed the room and requested anyone wishing to speak against the selling of the
property come forward.
Hastings resident, Norm Sheets, who lives next door to the property spoke. Sheets stated that he was not
necessarily for or against the selling of the property but wanted to clarify that the property is zoned 03
Commercial, and hoped that would be communicated to potential buyers.
Motion by Stromer, seconded by Curtis to close the Public Hearing regarding the county owned property
located at 100 N. Shore Drive. Roll Call; Ayes: Stromer, Larsen, Hogan, Thomsen, Curtis, Neumann,

Hastings Tribune.

Adams County Emergency Management Director, Chip Volcek, presented for approval an interlocal agreement
between Adams County and the Nebraska Office of the Chief Information Officer for information technology
services. Volcek and Deputy Attorney Bergin have reviewed the agreement and is recommending approval.

INTERLOCAL COOPERATION AGREEMENT
FOR
INFORMATION TECHNOLOGY SERVICES
This interlocal cooperation agreement is between the NEBRASKA OFFICE OF THE CHIEF
INFORMATION OFFICER, an agency of the State of Nebraska ("OOO") and ADAMS COUNTY, a political
subdivision of the State of Nebraska ("Political Subdivision").
Recitals:
WHEREAS, the OCIO is the state agency responsible for providing information technology
services and support to state government agencies; and
WHEREAS, the OCIO is authorized to provide information management services and technical
assistance to any subdivision of government (Neb. Rev. Stat. § 81-1117(h)) and to enter into agreements
for the mutual support and use of communications services with political subdivisions (Neb. Rev. Stat. §
81-1120.17(7)); and
WHEREAS, Adams County provides contracting and fiscal services for the South Central Region, a
public safety communications coordinating entity; and
WHEREAS, the parties, pursuant to the Nebraska Interlocal Cooperation Act (Neb. Rev. Stat. §§
13-801 through 13-827), have determined that it is in the best Interest of the public to enter into this
agreement for the purpose of having the OCIO provide certain information technology services to
Political Subdivision.
NOW, THEREFORE, the parties agree as follows:
1. Services and Rates. (a) The OCIO agrees to provide the Information technology services
listed in attachment A in a satisfactory and professional manner.
(b) Political Subdivision agrees to pay the OCIO for the information technology
services listed in attachment A at the specified rates.
(c)
Attachment A may be revised from time to time as the parties deem
appropriate.
2. Term. (a) This agreement will be in effect for an initial term of five years. Upon
expiration of the initial term, this agreement will automatically renew on a year-to-year basis until
terminated.
(b) Unless terminated earlier as provided for herein, the services listed in
attachment A will be coterminous with this agreement.
3. Termination. Either party may terminate this agreement, or any service listed In
attachment A, for any reason upon 60 days' advance written notice.
4. Billing and Payment. (a) The OCIO will provide Political Subdivision with a monthly
billing statement Including a list of the services provided.
(b) Political Subdivision will make payment in full within 45 days of receipt of the
monthly billing statement.
5. Agreement Administrator. The state Chief information Officer is the agreement
administrator for purposes of Neb. Rev. Stat. § 13-804(4)(a).
6. Amendment. Any amendment to this agreement must be made in writing and signed by
a duly authorized representative of each party. The following individuals are jointly authorized to amend
attachment A:
(1)
For the OCIO, the Chief Information Officer, and
(2) For Political Subdivision, the Director, Adams County EMA.
7. Relationship of the Parties. The parties are not creating a separate legal or
administrative entity. The parties are not creating a Joint entity. The parties are not Joint employers for
any purpose under this agreement, and each party will be solely responsible for at wages, benefits,
workers' compensation coverage (or self -Insurance), other insurance coverage, or other costs of or
compensation to its respective employees, agents or subcontractors. Each party Is responsible for the
acts or omissions of its own officers, employees, subcontractors or any agent in connection with the
performance of this agreement.
8. Real and Personal Property. Each party will maintain ownership and control over all real
and personal property currently owned or controlled by such party. In no event will any sharing or
access granted by this agreement constitute a conveyance or participation In ownership or control of
such property. The parties will not jointly purchase any real or personal property as part of this
agreement. At the time of termination of this agreement, each party may dispose of Its real and
personal property in accordance with the party's own disposal procedures.
9. Assignment. Neither party may assign this agreement or any of its rights or obligations
hereunder to any third party, without the prior written consent of the other party.
10. Force Majeure. Neither party will be in default under this agreement if and to the
extent that any failure or delay in such party's performance of one or more of its obligations hereunder
is due to a natural disaster; fire; flood; fiber, cable, conduit or other material failures; shortages or
unavailability or other delay in delivery not resulting from the responsible party's failure to timely place
orders therefore; lack of or delay In transportation; changes to any government codes, ordinances, laws,
rules, regulations or restrictions (unless such codes, ordinances, laws, rules, regulations or restrictions

are under the control of and changed by the party claiming force majeure}, as to which a party's
compliance is necessary to carry out the terms and conditions of this agreement; war or civil disorder; c
any other cause beyond the reasonable control of such party. In the event of such force majeure event,
such party's performance of such obligation(s), will be excused and extended for and during the period
of any such delay.
11. Confidentiality. All data, documents, designs, drawings, specifkations, and other
information furnished under this agreement and conspicuously marked as confidential by the disclosing
party will be received by the other party in confidence. Each party shall use its best efforts to preserve
the value of such confidential information and maintain its confidentiality. This obligation of
confidentiality does not apply to any verbal communications unless they are promptly thereafter
reduced to a written memorandum acknowledged by both parties. This obligation of confidentiality
does not apply to any information which is required to be disclosed or otherwise made public by order
of a court of competent jurisdiction, or is required to be disclosed pursuant to the provisions of
Nebraska law governing the release of public records.
12. Non-discrimination. In accordance with the Nebraska Fair Employment Practice Act
(Neb. Rev. Stat. §§ 48-1101 through 48-1125), the parties agree that they, and their subcontractors, wil
not discriminate against any employee or applicant for employment, to be employed in the performanc
of this agreement, with respect to hire, tenure, terms, conditions, or privileges of employment, becausr
of race, color, religion, sex, disability, or national origin.
13. Governing Law. This agreement will be govemed, construed, and enforced in
accordance with the laws of the State of Nebraska.
14. Counterparts. This agreement may be signed in counterparts, each of which may be
deemed an original but all of which constitute one and the same instrument.
15. Effectiveness; Date. This agreement will become effective when all parties have signed
it. The date of this agreement will be the date this agreement is signed by the last party to sign It.

Adams County Clerk of the District Court, Chrystine Setlik, presented the Board with 2016 findings calculated
by Sequoia Consulting Group for reimbursable indirect child support enforcement expenses. Setlik has
reviewed the finding and is requesting approval.

Adams County provides support to a number of federally funded programs including Child
Support program administration. Your meaty is currently being reimbursed for the direct costs,
salaries, benefits, office supplies, equipment maintenance, postage, etc. The county is also eligible
W be reimburscei for the indirect costs of supporting these programs if the county prepares a
Contral Services Cost Allocation Plan to appropriately identify these costs. This plan when.
prepared in accordance with 2 CFR Pan 200 Subpart E and Appendix V, Section E (formerly
OMB A-87) the Cost Principles for State, Local and Indian Tribal Governments and ASMH C -I0
used as guidance for determination of cost allocation and basis selection will enable the county to
recover indirect costs initially funded by the County's General Fund in support of these federal

other costs that vary from county to county. Per agreement with the State of Nebraska, the
Federal share of these properly identified costs will be reimbursed on a quarterly basis.

The process used to allocate costs must he compliant with 2 CFR Part 200 Subpart ti and

government clients in Nebraska. Ile also possesses substantial experience in the auditing a
negotiation of cost allocation plans and indirect cost rates, obtained during his employment with 1
State of Nebraska's Child Support Enforcement Unit, Department of Health and Human Services.
Robert Vernon, Senior Consultant - Mr. Vernon brings over thirty years experience to Sequoia
Consulting Group in the specific arca of cost allocation services. Having worked for the U.S.
Department of Health and Human Services' (DHHS) Division of Cost Allocation Mr. Vernon's
credentials provide a unique expertise in meeting the cost allocation services of our client base.
During his tenure with DiIIIS he was responsible for the review and negotiation of cost allocatio

Director in the Revenue Services Division. Mr. Malinowski managed a wide variety of
organizational, operational, and financial consulting engagements. Iie designed the system used
calculate thc Medicaid Administrative Claiming.
Michael Lenox, Senior Consultant — Mr. Lenox joined the firm in 2007 and has worked on cosh
allocation projects for the states of Indiana and Louisiana. Mr. Lenox has been instrumental in the
development and use of SequoiaCAP with thc largest health and human services agency in Indian
FSSA. He uses SequoiaCAP to implement the quarterly allocation of the FSSA Public Assistance
Cost Allocation Plan (PACAP) that products, by Division and Units, the quarterly Departmental
indirect costs and Division indirect costs for each federal program. The allocation model that
distributes costs from Indiana's Family & Social Services Administration (FSSA) administrative
mist pools contains 32 Central Service departments and 21 Administrative departments. Over 40
different allocation methods are used in the model to allocate costs to more than 60 benefitting
programs. Mr. Lenox has also completed Indirect Plans for the Indiana State Courts, as well as
Cost Plans and Cost Rates for Indiana's Department of Correction and Louisiana's Office of

Our plan to complete the engagement of preparing and submitting the central services cost
allocation plan and indirect cost allocation rates for Adams County consists of six (6) steps:
Step 1—Data Collection and Analysis: As soon as possible, we will initiate data collection
by setting up interviews with staff to determine the optimal organization and structure of
each cost plan. We will discuss with appropriate personnel to determine if any changes
have been made to County structure (additions, deletions or service combinations) and
whether statistics to allocate that arca arc still appropriate and obtainable by the County
without undue burden. We will review the County's Organizational Chart and financial
statements to determine that each support the capture of allowable costs to central service
activities included in the plan.

Specific data requested will include:
• The last prepared Central Services Indirect Cost Allocation Plan.
• The last prepared indirect Cost Allocation Rates.
• A report showing financial information for all grants; open and closed.
• A current organization chart of the County.
• Expenditures for the County showing full account -structure coding.
• Necessary statistics used for allocation of Central Service Departments and
Functions.
• Additional requests will be made after interviews.
Once interviews have been completed and the data request has been finalized, Sequoia
Consulting Group will meet with County Staff to discuss changes, the data requests, and
any other pertinent information that is necessary for the completion of the Central Services
indirect Cost Allocation Plan.
Sten 11— Plan Preparation: We will use our proprietary cost allocation system and the
work product from Step Ito develop a Central Services Indirect Com Allocation Plan.
Soquoia will evaluate and analyze the Plan and compare the results to prior submissions.
We wilt review any material changes with County Staff so everyone has an understanding
of the impact made by any change. If alternative allocation methods are proposed that fall
within federal and state guidelines, we will run the allocation with these new method(s),

Sten 111— Cost Rate Preparation: Develop an Indirect Cost Allocation Rate calculation fc
the County Attorney, Clerk or the District Court and any Other County Departments as
required for submission.
Sten W— Plan and Rates Submission: Once the Central Services Cost Allocation Plan ar
Indirect Cost Rates have been received and accepted by the County, we will submit the
Plan and Rates for review to the Nebraska Department of Health and Human Services
Child Support Enforcement Division.
Sten V— Plan and Rates NeRotlation: Pursuant to federal regulations, the cognizant
agency has up to six months from the time of submission to respond. When they do
respond, we will conduct negotiations on the County's behalf to obtain a final approved
plan and the appropriate rate agreements.
Sten VI — Continuing Support: The Central Services Indirect Cost Allocation Plan is
compiled using a two year cycle. After the Plans and Rates have been approved, we will b
available to provide continuing advice and assistance in its application. We will monitor
the progress of claims through the State to ensure the County receives recoveries due it. 14
will store the work papers in accordance with the County's record retention policy. In the
event of an audit, we will provide whatever assistance is required to support our work
Sequoia Consulting Group has included references in Appendix A to substantiate the quality of
work that Adams County can expect to receive.
Enclosed are two (2) signed proposed agreements for your review. The contract term would cove
three years, FY 2017, FY 2018 and FY 2019 which will result in cost reimbursement in FY 2019„
FY 2020 and FY 2021. Our fee schedule for Nebraska counties will be capped bused on
population. The fee Adams County will pay is capped at Five Thousand One Hundred and Forty
(85,140) per year for services rendered under this agreement,
The agreement provides for a lower contingency fee in that the county will keep 60 percent of
every federal dollar recovered. For every $10,000 recovered, 86,000 remains with the county. If'
only 85,000 were recovered our full fee would be 82,000.
To improve the cash flow we will bill 40% of our fee upon delivery of the indirect cost allocation
plan to the Adams County. Our contract provides that the remainder of our fee is not due until
you have recovered the funds from the State of Nebraska.

INTERLOCAL COOPERATION AGREEMENT
FOR PROFESSIONAL ENGINEERING SERVICES
BY AND BETWEEN
THE COUNTY OF HALL, NEBRASKA
AND
THE COUNTY OF ADAMS, NEBRASKA
THIS AGREEMENT is made and entered into by and between the County of Hall,
Nebnjska, a body politic and corporate and a political subdivision of the State of Nebraska,
hereinafter referred to as "Hall County," and the County of Adams, Nebraska, a body politic
and corporate and a political subdivision of the State of Nebraska, hereinafter referred to as
"Adams County", WITNESSTH:
WHEREAS, tho Interlocal Cooperation Act, NEB, Env. STAT. § 13-801, et seq.,
provides that units of local government of the State of Nebraska and Nebraska state agencies
may enter into agreement for the joint and cooperative exercise of powers, privileges, or
authority capable of being exercised by either agency; and
WHEREAS, NMB. Rity, STAT. § 13-801, et seq., provides that any one or more public
agencies may contract with any one or more public agencies to perform any governmental
=vice, activity, or other undertaking which each public agency entering into the contract is
authorized by law to perform; and
WHEREAS, Adams County docs not have a Professional Engineer on staff to perform
engineering work, and
WHEREAS, Hall County has a Professional Engineer on staff who is appointed as the
Hall County Engineer in accordance with NEn. Rnv. STAT. § 23-1901.02, et seq.; and
WHEREAS, the Hall County Engineer is registered as a Professional Engineer in the
State of Nebraska and has met all requirancnts of the Nebraska Board of Engineers and
Architects to provide Professional Engineering services in the State of Nebraska; and
WHEREAS, Hall County is willing to perform Professional Bngineering services in
accordance with the teens hereinafter provided.
NOW, THEREFORE, Hall County and Adams County mutually covenant and agree
as follows:
1) Scope of Agreement. This agreement is for Professional Engineering services provided
by Hall County's Engineer for Adams County.
2) Hall County's Obligations.
a) Prepare a brief scopq of work for each project along with a cost estimate for approval
by the Adams County Highway Superintendent. The costs and expenses would
include, but not necessarily be limited to mileage, an agreed hourly consultation rate,
an agreed hourly rate for travel time, postage, and costs for office processing of paper
work.
b) Submit hourly rates for each project to the Adams County Highway Superintendent
prior to starting work on each project.
c) Track costs involved in providing the Professional Engineering services and submit
invoices with necessary supporting documents to Adams County for reimbursement
l3illed costs shall be actual costs for equipment, materials, salary & benefits.
3) Adams County's Obligations.
a) Review brief project scopes and authorize Hall County to proceed with individual
projects.
b) Review and approve invoices for payment
c) Make payments hereunder to the Hall County Road Fund within 30 days.
4) Type of work. Professional Engineering work may include but is not limited to the
following:
a) Traffic Engineering. spot speed studies, intersection control such as stop or yield
signs, accident reviews, etc.
b) Culvert Hydrology & Hydraulics: estimating peak nmoff and sizing culverts, ete.
c) Preparing Culvert Load Rating Summary Sheets (LRSS).
5) Professional Registration. The seal of a registered Professional Engineer licensed to
practice in the State of Nebraska shall be placed on plans, documents, reports or
specifications as required by the Nebraska Engineers and Architects Regulations Act,
NMB. REV. STAT. § 81-340, et seq.
6) Governance. This agreement shall be co-govemed by ther%Hall County Surveyor and the
Adams County Highway Superintendent
7) Indemnification. Each party hereto agrees to indemnify and hold harmless the outer party
from and against all losses, liability, expenses, damages and claims, including attorney's
fees, arising out of or resulting from the indemnifying party's acts or omissions in
performing under this agreement, except to the extent caused by negligent or willful act or
omission of the other party. Each party agrees to provide liability insurance to indemnify
itself in the event that it becomes liable for the payment of a judgment based upon its acts
or omissions, or the acts or omissions of its agents or etnployees in performing this
agreement.
8) :Modification. This agreement may be modified by written agreement of the Parties.
9) No Separate Entity. There shall be no separate legal entity created through this interlocal
cooperative agreement.

10) Term and Duration. This agreement shall become effective on the date that the se
party executes the agreement and shall continue in force and remain binding unlll •
party terminates the agreement upon a 90 day written notice to the other party.
11) Provision of Assistance. Pursuant to the Interlocal Cooperation Act, NEB. Rtv. Sr
13-806, et seq., any party to this agreement, in the party's sole discretion, may approl
funds and may sell, lease, give, or otherwise provide assistance, including persanne
services, as may be within the party's legal power to furnish.

Upon receiving a number of local inquires regarding the removal of the "easy comers/curves" from the
intersection, along with the current YIELD signs located at the intersection of South Holstein Avenue and
West Powerline Road, 1 relayed my conversations to the Road/Bridge Committee. The Committee and myself
also met with area residents at the intersection on September 29, 2017 to hear their concerns and review the
signage. This intersection is further described as the common intersection corner to the SW corner of
Section 14, SE corner of Section 15, NE corner of Section 22 and NW corner of Section 23, Township 5 North,
Range 12 West (Logan).
The intersection in question has existing YIELD signs at the east, south and west legs. The south bound traffic
on South Holstein Ave does not have a traffic control sign for this lane of traffic. All intersecting roads are
classified as Other Arterial Routes as they approach this intersection. All lanes of traffic have gravel surfacing
at the intersection, then Holstein Ave changes to asphalt surfacing approximately 200 ft north of this
intersection. The south bound traffic on Holstein Ave is the only lane of traffic that approaches the
intersection on a near level surface, where the south and west legs approach the intersection with an incline
and the east leg has a slight decline approach. Due to terrain the south and east legs of the intersection have
a blind line of sight to each other as they approach this intersection. There are no reported accidents in the
past 10 years at this intersection.
The traffic counts show the traffic on Holstein Ave north of the intersection and the west leg of Powerline Rd
to be the higher counts for daily use. It should also be noted that the agriculture haul route through this
intersection runs from the west then turns north onto Holstein Ave and in the reverse direction. Please refer
to the attached aerial view of this intersection and note the recorded traffic counts per intersecting leg.
The 2009 Manual of Uniform Traffic Control Devices (MUTCD) was reviewed and changing the existing YIELD
signs to STOP signs falls within the parameters of reasons per said Manual for regulatory signing.
Based on the above information, it is recommended that the existing YIELD signs be changed to STOP signs at
this described intersection and the supporting Resolution be adopted by the Board of Supervisors.

WHEREAS, in accordance with the standards set forth in the Manual on Uniform Traffic
Control Devices (MUTCD), as from time to time amended, and
WHEREAS, it is in the best interest of Adams County, Nebraska, to establish and maintain
proper and consistent signing in conformity with said manual, and
WHEREAS, the County Road / Bridge Committee requested the County Highway
Superintendent to review the traffic control devices presently in use at the named intersections,
and
WHEREAS, the County Highway Superintendent did review the accident information,
performed traffic counts and viewed each named intersection for visibility, clarity and
obstructions, and
WHEREAS, the County Highway Superintendent recommends that the YIELD signs be
replaced with STOP signs at the intersection described below:

RE: NIRMA Dividend and Membership Recommitment

Dear Eldon:
We were very pleased to announce at last week's NIRMA Membership Conference in Kearney that the NIRMA
Board of Directors had declared the largest membership dividend in its history, this time in the amount of $2 million.
This marks the 22nd consecutive year that one or more dividends will be returned to our members. Such dividends
continue to be made possible by the strong balance sheets of NIRMA and NIRMA II. We all know that financial
strength and stability is critical in these challenging economic times.
Of this $2 million dividend, $1,250,000 was already distributed at last week's conference as a regular dividend to
those member counties who have participated in our program for at least five (5) policy years in accord with the
dividend policy NTRMA has adopted. However, there remains $750,000 yet to be distributed and that sum is
designated as a recommitment dividend and will be distributed to those eligible member counties that extend their
membership in NIRMA.
It is important for you to know that the recommitment portion of the dividend offered is based on a premise
that the eligible member county, on or before December 29, 2017, recommit for another three-year
membership in. NIRMA/II in order to receive this dividend. This is consistent with the procedure extended
by the NIR.1vIA Board in 1996, 1999, 2002, 2005, 2008, 2011 and again in 2014 when .ell eligible members
recommitted. Therefore, we ask that your county and the other member counties eligible to receive the
recommitment portion of this dividend timely review and act upon this request.
It is important to point out that this is a mutual commitment. In exchange for the county's recommitment, NIRMA
is also committing itself to continuing to provide its coverages and services to Adams County for this same time
period. NIRIVIA's focus is county government and we are in this business for the long term as demonstrated by the
30th anniversary which we will celebrate in 2018 and the extended partnership with and ownership by our member
counties since 1988.
By your action to extend the county's membership with NIRMA, Adams County will receive a recomtnitrnent
dividend of $18,995 which will supplement the regular dividend of $31,641 previously distributed for a combined
total of $50,636. The recommitment dividend check will be issued and sent out by mail once the recommitment
resolution is received in our office. As you might imagine, not all counties will receive an equal amount because the
dividend is computed on a pro -rata basis using the individual equity balance of each county in comparison to the total
equity held by all of the members of the pool. Counties have each participated in :FIRMA for varying lengths of time
and have different loss histories so those equity and dividend amounts will understandably vary from county to
county.

This dividend, when added to the previous dividends issued by NIRMA, will bring to $591,446 the cumulative
dividends received by Adams County since the NIRMA program began, and will increase to $20 million the total
dividends issued by NIRMA since 1994. We are able to do this because of NIRMA'e aucceas, the outstanding loyalty
and hard work of our member counties, and the exceptional financial condition of both pools. Aa of June 30, 2017,
NIRMA and NIRMA II had combined total assets of almost $56 million, liabilities of about $22.5 million, leaving
more than $33.5 million being designated as the Member Fund Balance and representing the equity ownership of
our members.
Any decision to recommit and accept that portion of this dividend is a determination to be made solely by each
respective member county !ward. We fully respect that process. Any such dividend actutlly accepted and paid will
he deducted from that county's individual member equity balance. Please note, the member equity account of any
county choosing not to recommit will be unaffected by this dividend and any amounts in that account will remain
unchanged and available for that county if eligible when future dividends or distributions are trade.
In summary, NIRMA continues to provide the broadest coverages and services available designed to meet the ever-
changing needs of our members, all at a stable coat to our members, which is especially important with the ever-
present financial challenges being faced by counties and other local governments. 1 believe there are a number of
compelling reasons for Adams County to extend its membership in NIRMA and hope your County Board feels the
name way.
If so, at your earliest convenience, and certainly before the end of December, please place on your board agenda the
item of NIRMA recommitment. A recommitment resolution is enclosed for those purposes. If the resolution is
adopted by your County Board, please have a copy sent immediately to the NIRMA office. Once again, this must
be completed no later than December 29, 2017, in order to receive the recommitment portion of this
dividend.

WHEREAS, Arta sn County has previously entered into
Intergovemmental/Intedocal Agreements with various other Nebraska Counties and other public agencies to
form and participate in the Nebraska Intergovernmental Risk Management Association (NTRMA) and the
Nebraska Intergovernmental Risk Management Association II (NIRMA II) as authorized by the
Intergovernmental Risk Management Act (Neb.Rev.Stat §44-4301 et seq.) and the Nebraska Interlocal
Cooperation Act (Neb.Rev.Stat.§13.801 et seq.); and
WHEREAS, Counties and other Public Agencies as de fined in Neb.Rev.Stat. §44-4303 are allowed to
participate in said cooperative undertakings; and
WHEREAS, the Legislature has found that proper risk management requires the spreading of tisk so
as to minimize fluctuation in insurance needs and that benefits can be derived through the pooling of insurance
purchasing by local government, and
WHEREAS, NIRMA and NIRMA U have provided coverages to the County in a cost effective way
wbkh meet and exceed that provided by standard insurance carriers; and
WHEREAS, NIRMA and NIRMA II provide tisk management services such as loss ptevention, safety
audits, claims and litigation management, and coverages tailored to address loss exposures counties and other
related public entities face not economically available from other sources; and
WHEREAS, these coverages and risk management services arc essential for the continued effective and
efficient use of county taxpayer dollars; and
WHEREAS, the current Intergovernmental/Interlrwal Agreements will expire on June 30, 2018, and
NOW, THEREFORE, BE IT RESOLVED that the .4 d torr j County Board hereby:
1. Extends its commitment to participate in NIRMA and NIRMA II for the period July 1, 2018 through
June 30, 2021; and
2. Declares that this Resolution shall serve as an amendment and addendum to the previous
Intergovernmental/Interlocal Agreements entered into by the County Board, said
Intergovernmental/Interlocal Agreements readopted by and incorporated herein by this reference as
amended.

The Adams County Board of Equalization met on October 17, 2017 at 10:00 a.m. in the Adams County Board Room to
review and take action on tax list corrections and motor vehicle tax exemption applications. Chairman Eldon Orthmann
presided over the meeting.

Board of Equalization opened at 10:19 a.m.
Adams County Assessor, Jackie Russell, presented the Board with a personal property tax list correction for Nebraska
Prime for years 2014, 2015 and 2016. Russell has reviewed the corrections and is recommending approval.

Thank you for your attention to the previously Issued subpoena for Nebraska Prime Group, ID 480058, in Adams
County, Nebraska for the 2017 tax year.
In regards to the filing of the depreciation schedule to satisfy the terms of the subpoena, it was discovered that
Nebraska Prime Group's past filed personal property schedules for years 2014, 2015, and 2016, were also using
the estimated "Assessor's Value" (which was first placed on the property in 2011) for the submitted amount of
personal property held by the company and was not a true indication of personal property depreciable assets
residing at 1009 W M St. in Hastings, NE.
Therefore, l have an obligation to report this information to my County Board of Equalization according to Neb.
§77-1233.04 (please see attached). The difference In value reported for tax years 2014, 2015, and 2016, are also
subject to a late penalty of 25% of the tax amount. (§77-1233.04(04)).
1 will be presenting this Information to my County Board of Equalization on October 17, 2017 with an open
meeting policy. Therefore, you are welcomed to have a representative of Nebraska Prime Group attend and have
opportunity for public comment.
This information will also be sent by email to Adina Reis, at areistaBroadwavHeathcare.com and at
areiseawrreserve.com, whom the 2017 depreciation schedule for personal property on the behalf of Nebraska
Prime Group was submitted.
Attached, you will find a coat/ of the tax list correction form which I will be presenting on the 17th. The form
indicates the billed amount of tax for each year in question, along with the corrected tax amount, tax credit (if
any), and imposed penalty on the remaining value that was not originally filed that 1 wilt be proposing to the Board
of Equalization. No decisions have been made at this time whether the indicated Additions to Tax Roll are due.
