Roll call members present, Michael Stromer - District 1, Glen Larsen — District 2, Lee Hogan- District 3 , Scott Thomsen — District 4, Dale Curtis- District 5, Chuck Neumann — District 6, Eldon Orthmann — District 7. Motion by Curtis, seconded by Stromer that this is an open public meeting of the Adams County Board of Supervisors. Roll CaII; Ayes: Stromer, Larsen, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None. Orthmann stated that minutes from the October 17, 2017 meeting have been circulated and will stand approved unless there is a correction. No corrections were suggested Public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the board members and was kept continuously current and posted in the County Clerk's office, the main courthouse lobby and the Adams County website. There were no comments from the public made. 743 ' Page Adams County Deputy Attorney, David Bergin and City of Hastings Attorney, Dave Ptak presented the Board with an interlocal agreement for the establishment of enhanced (E-911) emergency telephone services. Hastings police captain Brian Hessler was also available and spoke in favor of approving the agreement. Motion by Neumann, seconded by, Hogan to approve the interlocal agreement between Adams County and the City of Hastings for enhanced emergency telephone serives. Nays: None INTERLOCAL AGREEMENT FOR ESTABLISHMENT OF ENHANCED (E-911) EMERGENCY TELEPHONE SERVICE WHEREAS, local governmental subdivisions in the State of Nebraska are authorized under the provisions of the Interlocal Cooperation Act to enter into agreements with one another for joint or cooperative action which are in the best interests of their residents and of the general public; WHEREAS, such local governmental subdivisions are authorized by the provisions of the 911 Service System Act, Neb. Rev. Stat. §86-1001 et seq., and the Enhanced Wireless 911 Services Act, Neb. Rev. Stat. §86-442 et seq., to establish an emergency 911 telephone service comprised of basic 911 service, enhanced 911 service, enhanced wireless 911 service, next - generation 911 service, and any emerging technologies, networks, and systems that allow access to 911 service, hereinafter referred to collectively as "emergency 911 telephone service", and to pay the costs thereof by imposition of a uniform service surcharges on both landline and wireless telephone services; and WHEREAS, it is in the public interest of the residents of Adams County and for their safety to establish an emergency 911 telephone service for the residents of Adams County. WHEREFORE, the undersigned hereby stipulate and agree as follows: 1. The duration of this agreement shall be indefinite, subject however, to the rights to withdraw or terminate as hereinafter set forth. 2. The administrator of this cooperative undertaking shall be the person who, from time to time, holds the position of City Administrator of the City of Hastings, Nebraska. No other legal or administrative entity shall be created hereby. 3. The purpose of this Agreement shall be to establish an emergency 911 telephone service for the residents of Adams County and for those political subdivisions of general jurisdiction within Adams County participating in this Agreement as authorized by their respective governing bodies and their execution of this Agreement. 4. The emergency 911 telephone service established hereby shall be financed in accordance with the provisions of Neb. Rev. Stat. §86-435 et seq. by imposition of a uniform service surcharge in an amount not to exceed the amount permitted by Nebraska statutes on each local exchange access line and wireless service (cell phones) which provides a service user with the ability to reach a public safety answering point by dialing the digits 911 for the purpose of reporting emergencies in the service area of the jurisdictions participating herein within Adams County, Nebraska. In the event, however, that the costs of non-recurring or recurring charges for the installation, maintenance, and operation of the emergency 911 telephone service Page744 'g e will exceed the funds generated by the service surcharge, the parties hereto will meet and agree upon additional sums to be appropriated by, the respective parties on a proportional basis, subject however, to the rights of the parties to withdraw or terminate as set forth herein. 5. The City of Hastings agrees to accept the emergency 911 telephone service equipment from Adams County as previously provided to Adams County by Windstream Nebraska, Inc., f/k/a Lincoln Telephone and Telegraph Company, the service supplier. 6. The City of Hastings further agrees to operate the emergency 911 telephone equipment. Specifically, the City of Hastings Emergency Communications Center located in the City of Hastings' Police Department shall be the public safety answering point for all 911 service calls placed from participating jurisdictions within Adams County, Nebraska. 7. Except as otherwise provided by Nebraska statutes, the uniform service surcharge created hereunder shall be imposed upon each local exchange access line and on all active telephone numbers or functional equivalents every month from users of wireless service within participating jurisdictions subsequent to the execution of this Agreement and any agreement for 911 service with Windstream Nebraska, Inc., f/k/a Lincoln Telephone and Telegraph Company, the service supplier. 8. Each general political subdivision of Adams County may indicate its decision to participate in this Agreement by the authorized action of its governing body, and subsequent execution of the original or a copy of this Agreement. 9. Any party may withdraw from this Agreement upon one (1) year's notice to all other parties. This Agreement may be terminated at any time by mutual agreement of all parties. Upon termination, all property acquired for administration of the emergency 911 telephone service shall be distributed equitably among the participating jurisdictions by the City of Hastings, Nebraska. 10. The parties hereby designate the City of Hastings, Nebraska, as the governing body to which funds collected from the imposition of the service surcharges shall be paid. That governing body shall credit those funds to a separate fund apart from the general revenue of that governing body, and said funds shall be used solely for payment of the costs of installation, maintenance and operation of the emergency 911 telephone service, including operation of the public safety answering point. 11. This Agreement shall be binding upon the successors and assignees of each party hereto. No party may assign its interests in this Agreement without the written consent of all other parties. Curry has reviewed the request and is recommending approval. Motion by Curtis, seconded by Larsen to approve the release of securities presented by Curry. Thomas had presented this request during the October 17, 2017 meeting, however Mary Lanning was unable meet required publication deadlines, therefor Thomas is requesting the Board take action on the appointment again. Motion by Stromer seconded by, Thomsen to approve the appointment of Colleen Adam to the Adams County Hospital Board Authority No. 1. Roll Call; Ayes: Stromer, Larsen, Hogan, Thomsen, Curtis, Neumann, Orthmann. Nays: None Thomas also presented a new option for 125 plans. The IRS has increased the maximum allowance for an HAS from $2600.00 to $2650.00. The participation in the 125 plan was approved during the October 17, 2017 meeting. Thomas is requesting the board to determine if they will allow the full option of $2650.00 to be deposited into an employee HRA accounts.
