A regular meeting of the Adams County Board of Supervisors was held with Chairman Lee Hogan
presiding. Roll call members present, Michael Stromer- District 1,Glen Larsen—District 2, Lee Hogan-

Orthmann—District 7.
Motion by Orthmann, seconded by Curtis that this is an open public meeting of the Adams County Board

August 4, 2020 minutes were circulated to the board members.Chairman Hogan asked if there were any
corrections needed on the minutes. Minutes were approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the

Chairman Hogan opened the meeting to receive comments from the public.
No public comments were made.
Kyle Brown with the USDA Wildlife Services Office, provided the county with an annual report of the
wildlife control efforts in the county.
Adams County Treasurer, Melanie Curry, presented the board with an annual report of delinquent
properties that were unsold,with Resolution 2020-08-18.01,directing Curry to issue county tax sale
certificates.
Motion by Thomsen, seconded by Stromer to approve the signing of Resolution 2020-08-18.01. Roll Call;

RESOLUTION
2020-08-18.01
WHEREAS, The Adams County Board of Supervisors has received from Melanie
J. Curry, Treasurer in and for the County of Adams, State of Nebraska, a list of all
delinquent Real Estate Taxes in said County of Adams, as required by Section 77-1918
of the Revised Statutes of Nebraska 1943, as of August 11, 2020;
THEREFORE, be it resolved that Melanie J. Curry, the County Treasurer, hereby
is directed to issue Tax Sale Certificates on those parcels upon which there is one or
more years delinquent Real Estate Taxes.

Adams County Maintenance Supervisor Tom Reichert, informed the board of an issue with the sidewalk
at the Adams County Extension office. Reichert did not seek any action at this point but was further
investigating the issues and costs involved.
Motion by Neumann, seconded by Curtis to meet as a Board of Equalization to review and take action
on motor vehicle tax list exemption applications. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,

Adams County Budget Preparer, Dawn Miller, presented the board with the preliminary 2020/2021
Adams County Budget. Miller requested a time to be set for the public hearing on the 2020/2021 Adams
County Budget.
The date and time for the public hearing to hear comments for or against the 2020/2021 Adams County
Budget,was set for September 1, 2020 AT 10:00 a.m.
Adams County Convention and Visitor's Bureau Director,Annjanette Bonham, requested the board
approve appointing Lindsay Nigel to the Adams County CVB Board.
Motion by Thomsen, seconded by Stromer to approve Lindsay Nigel to the Adams County CVB Board.

Supervisor Neumann presented the board with an agreement between Adams County and Heartland
Pet Connection.
CONTRACT FOR ANIMAL SHELTER SERVICES
This is an Agreement is made on this 18th day of August,
2020, by and between the County of Adams, (hereinafter referred
to as "County") , and Hastings Animal Shelter Association, Inc. ,
d/b/a Heartland Pet Connection, (hereinafter referred to as
"Heartland") ; providing for Heartland to operate an animal
shelter for the County and to receive and care for animals
impounded pursuant to statutory authority by the County as may be
amended, for certain agreed upon consideration.
1 . STATEMENT OF PURPOSE
Heartland and the County respectfully enter into this
agreement for the purposes of (1) protecting the public from the
risk of at large animals, (2) providing humane care for animals
brought in by the County and (3) ensuring Heartland remains
financially capable of providing all necessary animal shelter
services for animals brought in by the County.
2 . DEFINITIONS
Animal shall mean a cat, a dog, or livestock. Livestock
includes buffalo, deer, antelope, fowl, and any other animal in
any zoo, wildlife park, refuge, wildlife area, or nature center
intended to be on exhibit .
3 . TITLE TO IMPROVEMENTS
Title to the animal shelter and to such other improvements
as may be added thereto shall at all times remain with Heartland.
4 . HEARTLAND' S DUTIES
In performance of this Agreement, Heartland shall have the
following duties :
a . Heartland shall furnish, maintain, and operate an
animal shelter with equipment, supplies and facilities to be
utilized in connection with Heartland's performance of this
Agreement. However, Heartland reserves the right to reject any
animal it is not qualified to provide animal shelter services to .

b. Except as otherwise stated or agreed to, Heartland
shall receive animals, except chickens, brought in by the County
and to provide care and shelter for said animals, and to arrange
for the euthanasia of said animals if the same becomes necessary.
c. Heartland shall operate during such dates and
times as may be determined by Heartland and said hours of
operation shall be posted at the animal shelter. In addition
thereto, Heartland shall provide drop-off doors where animals can
be delivered, by the County, to the animal shelter 24-hours per
day, seven days per week. Heartland personnel shall be on-call
for emergency purposes after normal operating hours. The
telephone number of said on-call personnel shall be maintained
with the County personnel as designated by the County, and such
on-call information shall be posted at Heartland.
5 . COUNTY' S DUTIES
In performance of this Agreement, the County shall have the
following duties :
a. The County shall maintain its obligation to
perform animal control functions pursuant to the County laws and
guidelines and/or laws of the State of Nebraska.
b. The County shall not transport injured or sick
animals to Heartland after hours, but shall transport said
animals to the veterinary clinic designated by Heartland. The
County shall notify Heartland within twenty-four (24) hours after
animals have been transported to the veterinarian clinic
designated by Heartland and the shelter manager while
transporting the animal or immediately thereafter.
c . The County shall provide written notice to
Heartland within 10 days of any proposed change or addition to
any animal ordinance of the County so Heartland can participate
in this process to ensure that any change or new ordinance is
mutually beneficial to both parties and the public.

6 . COMPENSATION OF HEARTLAND
In consideration of the services to be performed by
Heartland as provided in this Agreement, the County shall
compensate Heartland as follows :
a. The County shall pay to Heartland the minimum sum
of seven thousand dollars per annum for the first one hundred
animals brought to Heartland by the County, excluding chickens .
The parties agree to negotiate in good faith the per annum cost
for the first one hundred animals 90 days prior to the automatic
renewal date.
For each additional animal brought to Heartland after
the first one hundred, excluding chickens, the County shall pay
to Heartland the sum of fifty dollars per animal .
b. Pursuant to Neb. Rev. Stat. §28-1012 . 01 (2) , for
animals seized by the County and transferred to Heartland, the
County shall timely file an application with the Court having
appropriate jurisdiction within seven (7) days after the animal
is seized to determine the disposition and the cost of care of
the animal . Pursuant to Neb. Rev. Stat. §28-1012 . 01 (2) , the
Court shall set the hearing within ten business days after the
date of application for hearing unless otherwise determined and
ordered by the Court .
If the County fails to file a timely application
pursuant to Neb. Rev. Stat. §28-1012 .01 (2) , then the County shall
reimburse Heartland for all reasonable expenses for the care of
the animal including veterinary care incurred by Heartland as
provided below.
c. For all monies owed to Heartland from the County,
including reimbursement for seized animals stated above,
Heartland shall provide a written billing statement by the first
of each month, and the County shall pay the full amount of said
billing statement within ten (10) days of receipt thereof.
d. Pursuant to Neb. Rev. Stat. §28-1012 . 01 (5) ,
nothing shall prevent Heartland from releasing seized animals to

a licensed veterinarian for the humane destruction as determined
necessary by the licensed veterinarian or as authorized by Court
order .
7 . CONTRACTS WITH OTHER ENTITIES
Heartland may render similar services to other governmental
subdivisions, and the inhabitants thereof, upon such terms and
conditions as may be agreed upon to the parties thereto, however,
such agreements with other parties shall not inhibit Heartland' s
operation as the animal shelter for the County of Adams .
8 . TERMS OF AGREEMENT; RENEWAL; TERMINATION
This Agreement shall take effect on August 1, 2020
following its approval by the County Board of Supervisors, and
shall continue in full force and effect for a period of one year.
Thereafter, this Agreement shall automatically renew for
successive one year periods .
Notwithstanding the above, either party may provide written
notice to the other, without giving reason, at least sixty days
prior to any renewal date of August 1, 2021, that it is the
intent of the notifying party to terminate this Agreement . If
such written notification is given, this Agreement shall
terminate upon the end of the one year term.
This Agreement may be .terminated for cause at any time for
any of the following reasons :
a. Heartland may terminate for cause if the County
shall fail to perform any of the provisions of this Agreement as
stated herein.
b. The County may terminate for cause if Heartland
shall fail to perform any of the provisions of this Agreement as
stated herein, but also if Heartland (1) ceases to maintain its
corporate existence in the State of Nebraska, (2) abandons its
animal shelter operations, or (3) fails to maintain or operate
the animal shelter in accordance with the terms and conditions of
this Agreement .
c . Termination for cause may only be effected by

giving written notice of such termination, outlining the reasons
for the termination, to the other party not less than thirty days
before the effective date of termination.
d. In a circumstance where notification for cause has
been given, the notifying party shall, in its sole discretion,
have the capability to rescind the termination if the party that
was notified remedies the cause (s) for the termination, at any
time before the termination is to take effect .
9 . PARTIES TO BE BOUND
This Agreement shall bind and inure to the benefit of the
respective successors of the parties, but may not be assigned by
either party without the written consent of the other party.
10 . CHOICE OF LAWS
This Agreement shall be construed in accordance with the
statutory authority of the County of Adams and the laws of the
State of Nebraska .
11 . HOLD HARMLESS AND INDEMNIFICATION
Heartland agrees to indemnify, defend, and hold the County
harmless from any and all liability resulting from omissions,
negligence, intentional, unintentional, or reckless acts or the
acts of the employees or agents of Heartland in connection with
all actions, rights, responsibilities, obligations and duties
contemplated by this contract . Likewise, the County agrees to
indemnify, defend, and hold Heartland harmless from any and all
liability resulting from any omission, negligence, intentional,
unintentional, or reckless acts or the acts of the employees,
agents, franchisees, licensees, directors or officers of the
County in connection with all actions, rights, responsibilities,
obligations and duties contemplated by this Agreement . In the
event of a lawsuit, investigation, or claim, the indemnifying
party will, at its sole discretion, cost and expense, protect,
defend, indemnify, release and hold harmless the other party from
losses arising out of or resulting from any and all claims,
actions, suits, proceedings, demands, assessments, judgments,
costs and expense, including, without limitation, any legal fees
and expenses, incident to any of the foregoing, except in case of

the indemnified party' s gross negligence, bad faith or willful
misconduct with respect thereto .
12 . INSURANCE
Heartland agrees :
a . To procure and maintain continuously during the
entire term of this Agreement, at its sole cost and expense, fire
insurance, including the risk generally known as "extended
coverage, " in an amount not less than 80% of the replacement cost
of the structure to be constructed by Heartland;
b. To procure and maintain continuously during the
entire term of this Agreement, at its sole cost and expense, a
policy or policies of comprehensive general liability insurance
with not less than One Million Dollars ($1, 000, 000 . 00) of
coverage per claimant per occurrence for bodily injury and
property damage, with an aggregate amount of not less than Two
Million Dollars ($2, 000, 000 . 00) ;
c. The County shall be named as an additional insured
on all liability insurance policies . Heartland shall provide the
County annual certificates from its insurers confirming the
existence of the insurance coverage required by this lease .
13 . ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the
County and Heartland notwithstanding any other oral agreements or
understandings to the contrary and may be amended only in
writing, approved and executed as required by law.
14 . SEVERABILITY
If any portion of this Agreement shall be deemed
unenforceable or invalid, the remaining portion (s) shall be
deemed valid and enforceable to the extent allowed by law, unless
to do so would clearly violate the present legal and valid intent
of the parties to this Agreement .

RESOLUTION
AMENDING THE ADAMS COUNTY EMPLOYEE HANDBOOK
TO PERMIT CHANGES TO VACATION POLICY AS A RESULT OF
THE CORONAVIRUS PANDEMIC

BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ADAMS COUNTY,
NEBRASKA that:
1. Due to the Coronavirus Pandemic of the year 2020, the Adams County Employee
Handbook is amended as follows:
Page 33,paragraph 4,after the fourth sentence which ends in the word "chart.", the
following sentence shall be inserted: "However, the elected official or department head of any
county office may determine that due to emergency circumstances all employees of the of/ice or
department may earn and use vacation time for an extended time of six months. Such
determination shall be made by a written notification to the County personnel committee signed
by the county official or department head."

The board addressed the agenda item of possibly approving a motion to vacate a previous isolated land
ruling on July 21,2020.
Attorney Elizabeth Lay had filed an appeal with the District Court of the Board of Supervisor's July 21,
2020 decision
Adams County Attorney, Donna Fegler-Daiss, made the recommendation to take no further action until
court proceedings are finished.

At 2:00 p.m.the August 18,2020 Board of Supervisor's meeting resumed at the Adams County
Extension Office Building.
Chairman Hogan advised where the open meeting laws were posted and called for roll.
Clerk Thomas took roll, roll call members present were; Michael Stromer- District 1,Glen Larsen—
District 2, Lee Hogan- District 3, Scott Thomsen—District 4, Dale Curtis- District 5,
Absent were Chuck Neumann—District 6 and Eldon Orthmann—District 7
Supervisor Thomsen started discussion on the proposed justice center.Thomsen outlined plans for the
justice center and the offices that would be relocated there. It is the desire of the justice center
committee to place a bond issue before the voters of Adams County to fund the justice center.
Neumann entered the meeting at 2:04 p.m.
Orthmann entered the meeting at 2:15 p.m.
Thomsen introduced Resolution 2020-08-18.03,to draft ballot language to place the 2020 General
Election Ballot.
Motion by Thomsen, seconded by Curtis to approve Resolution 2020-08-18.03 to direct DA Davidson to
draft ballot language for the election ballot.
Chairman Hogan requested the clerk take a roll call vote:

RESOLUTION
REGARDING THE SUBMISSION TO THE VOTERS OF THE QUESTION OF THE
CONSTRUCTION OF AN ADAMS COUNTY JUSTICE CENTER
AND THE DIRECTION THAT BALLOT LANGUAGE BE CREATED TO BE USED
AT THE 2020 GENERAL ELECTION FOR SUCH PURPOSE,AND WHICH WILL BE
ADOPTED AT THE REGULAR BOARD MEETING ON SEPTEMBER 1,2020.

BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ADAMS COUNTY,
NEBRASKA THAT:
WHEREAS,the Adams County Board of Supervisors hereby intend to submit the question of
whether to construct a new Adams County Justice Center to the voters at the 2020 General
Election;and
WHEREAS,there is specific ballot language by which the question shall be submitted to the
voters;
THEREFORE,the Adams County Board of Supervisors hereby directs the following:
That the appropriate ballot language for the submission of the question to the voters shall be

A regular meeting of the Adams County Board of Equalization was held with Chairman Lee Hogan
presiding. Roll call members present, Michael Stromer- District 1,Glen Larsen—District 2, Lee Hogan-
District 3,Scott Thomsen—District 4, Dale Curtis- District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Neumann, seconded by Curtis to meet as a Board of Equalization to review and take action
on motor vehicle tax list exemption applications. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,

Adams County Treasurer, Melanie Curry, presented the board with motor vehicle exemption requests
from Hastings College and Mid Nebraska Individual Services.Curry has reviewed the applications and
confirmed the entities meet the criteria for exemption.
Motion by Thomsen,seconded by Orthmann to approve the motor vehicle tax exemptions as presented
