Roll call members present, Michael Stromer- District 1, Glen Larsen—District 2, Lee Hogan- District 3,Scott Thomsen—District 4, Dale Curtis-District 5,Chuck Neumann—District 6, Supervisor Eldon Orthmann—District 7 was present at the meeting but was absent at time of roll call vote. Motion by Curtis, seconded by Stromer that this is an open public meeting of the Adams County Board of Supervisors. Stated the building and grounds committee will be reaching out to an area high school to replace another county cemetery sign September 15,2020—attended and Adams County Safety Committee meeting Stromer- September 2,2020—Attended an Adams County Planning and Zoning Meeting September 8,2020—Attended a Hasting Public Library Board meeting Neumann- September 15, 2020—Attended an Adams County Safety Committee meeting and stated that September is emergency preparedness and awareness month September 9,2020—Attended an Adams County Wellness Committee meeting and stated that flu shots will be available to county employees on October 7, 2020 September 3,2020-Attended a Midland Area Agency on Aging meeting September 2,2020—Attended a South Heartland District Health Department meeting Curtis- September 9,2020—Attended an Ag Society meeting September 10, 2020—Attended a government affairs meeting via Zoom September 10, 1010—Attended the retirement party for road's employee Linda Parr (date not provided)Attended a justice center meeting at the Adams County Extension Building Larsen- September 2,2020—toured rural Adams County Roads with Supervisors Neumann and Hogan September 14,2020—toured rural roads near Kenesaw with Supervisor Hogan Hogan- September 3,2020-Attended a Midland Area Agency on Aging meeting (date not provided)Attended a justice center meeting at the Adams County Extension Building September 10, 1010—Attended the retirement party for road's employee Linda Parr September 2,2020—toured rural Adams County Roads with Supervisors Neumann and Larsen September 14, 2020—toured rural roads near Kenesaw with Supervisor Larsen Chairman Hogan opened the meeting to hear comments from the public; Dave Lynn of 6870 S.Showboat Road spoke during public comment to address his frustrations with the Adams County Roads department regarding water run off near his property. Lynn outlined several conversations that have taken place over the years, most notably an offer by Lynn in 2019 to grant an easement in exchange for partial payment of the$5000.00 culvert and salvage from the bridge. Lynn stated that Dawn Miller rejected the offer. Supervisor Orthmann entered the room at 9:49 a.m. Lynn continued outlining various conversations with the county roads department and stated he would grant an easement if appropriately compensated. Lynn's comments turned to the proposed Adams County Justice Center that will be on the General Election Ballot. Lynn expressed concern of the cost being absorbed by property owners. Chairman Hogan stated a meeting with the roads department and Lynn is necessary and closed public comment. 547 J Page Dawn Miller presented a slight budget correction to the board prior to sending the final budget into the state auditor's office. Miller stated that no action was needed as the corrections did not change the county's levy request. l:, , .) Regular session resumed at 10:37 a.m. Adams County Planning and Zoning Director,Judy Mignery, presented the Board with plans for the Little Blue River View Subdivision. Mignery read the following into the record: RE: Case#20-09.1 Little Blue River View Subdivision Applicant: John Spady Location: 10015 S Baltimore Ave,Ayr,NE Zoned Use: Ag Zoning Administrator's Comments: The applicant would like to subdivide 3.80 acres in the NW r/<Section 25-T6N-R1OW. The proposed subdivision contains a house,shed,storage building,well and septic system. There is an existing easement along the south side of property for access to property to south. There will be a proposed easement at north end of property for ingress and egress for farming. These are both existing driveways off of Highway 281. A portion of the proposed plat does fall within the flood plain but the buildings do not.All requirements of the existing County and Village Subdivision Regulations and the Zoning Regulations have been met. Mignery stated the plans have been approved by the Adams County Planning and Zoning Board and is presenting for County Board approval. Motion by Thomsen, seconded by Stromer to approve plans for the Little Blue River View Subdivision as presented by Mignery. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis, Neumann,Orthmann. Nays: None. Adams County Deputy Attorney, David Bergin, presented a revised interlocal agreement between Adams County and the City of Hastings for library services. Motion by Neumann, seconded by Stromer to approve the library interlocal as presented by Bergin. INTERLOCAL AGREEMENT THIS INTERLOCAL AGREEMENT made and entered into by and between ADAMS COUNTY,NEBRASKA,a Political Subdivision of the State of Nebraska, hereinafter referred to as"County"and the CITY OF HASTINGS,NEBRASKA,a Nebraska Municipal Corporation,hereinafter referred to as"City",WITNESSETH: WHEREAS,County and City currently jointly finance the operations of the Hastings Public Library(Library);and WHEREAS,as a result of this joint financing of the Library's operations,all Adams County residents residing outside the corporate limits of City are granted access to the Library and the Library's services; NOW,therefore,in consideration of the foregoing recitals and the terms and conditions hereinafter set forth,the parties hereby jointly and mutually agree as follows: 1. All property taxes collected by the County from the Adams County Library Levy commencing for Fiscal Year 2020-21 shall be transferred by County to City.As a result of said transfer by County,City shall be responsible for the funding of Library operations and the operation,maintenance,and replacement of the Bookmobile. 2. The term of this agreement shall be open-ended;however,either the City or the County may make a request for reconsideration of the terms hereof by giving a six(6) month written notice to the other party. In addition,the patties shall review this Interlocal Agreement each year through the City/County Combined Services Committee prior to the adoption of the County's annual budget. If any changes to the Interfocal Agreement are necessary,they shall take effect on October 1 in order for City to continue to adequately provide for the continued operation of the Library. As part of the annual review,the Library Director shall provide the Committee with the latest utilization numbers as part of an annual report of the Library's activity. 3. As provided in Paragraph 1.The County shall budget an amount equal to fifteen percent(15%)of the City's Fiscal Year 2019-20 annual budget in addition to an amount for any levy not collected and any collection fee charged by the County to for the operation of the Library which the County shall collect as the Adams County Library Levy and pay over to the City as the County collects the same. In subsequent fiscal years,the County shall use the City's prior fiscal year budget for the Library to determine the fifteen percent(15%)amount to be budgeted in the County's annual budget as the Adams County Library Levy. 4. The funds shall be utilized by the City for Library support and funding for County residents residing outside the city limits of the City.In consideration of the annual funds as provided in Paragraph 1.above,the City shall provide all regular library services to all residents of Adams County,including the Bookmobile,at no additional charge.The Library may charge for some special events or services,but the charge shall be applicable 552 I Page to all patrons and not differentiate between residents of the City and residents of the County. 5. In addition,County shall transfer any monies held in its current Bookmobile Sinking Fund balance as of start of its 2020-21 Fiscal Year to the City. The City shall set aside said funds into a sinking fund to pay for the maintenance and replacement of the Bookmobile. All of our office correspondence has"return service requested"on it to allow for us to know if someone is temporarily away,or possibly at a different location. Mr.&Mrs.Klatt's postcard was returned to our office with a Campbell address listed on it for a forwarding address by the attached USPS label. Our office then resent the postcard to the Campbell address instead. Mr.Klatt then physically came to our office to file their Homestead on April 16th, When he was asked by our Clerk about the Campbell address he made mention that all their mail is sent to them on the farm. After Mr.Klan left,my clerk then approached my Deputy Assessor about the mail situation and they both determined that it seemed a little odd. Therefore,they investigated like we typically do when we are not sure if the Homestead Exemption requirements are being met to be approved for the exemption and in this case it was a matter of,are they occupying the residence? We contacted Hastings Utilities who said that they arc sending their bill to Campbell as well and we also sent Deputy Morrow to the residence to do an occupancy check for us. In short,Deputy Morrow determined that the daughter of the Klatt's is most likely the past occupant of the home,hut is no longer living there and that it is not believed that Mr.or Mrs.Klatt have every occupied the residence as their primary home.Enclosed is Deputy Morrows report as well. Therefore,I contacted Franklin County due to the Campbell address and the Franklin County Assessor expressed that she was certain they were living in Campbell and that their daughter was living in Hastings in the past. I also then assumed that the house in Campbell was located in Franklin County, however,since the Homestead denial was sent out,I have learned that the home's location is actually close to the border but rests in Webster County. I have contacted the Webster County Assessor who has also stated that she believes the Klan's daughter was living in I lastings but has since built a new home in Franklin County and that Mr.&Mrs.Klatt are living at their Farmstead in Webster County. I contacted the Dept of Rev PAD to determine how they would like me to handle the situation since the owner has not occupied the home as their primary residence as is required by the exemption from January is'to August 15th yearly. I would venture to guess that their driver's licenses and/or FE)cards will have the Campbell address listed as%veil. The Adams County Clerk,since the denial,has also determined that they have been registered voters in Webster County and not Adams County which would also indicate Webster County as their primary residence.If necessary,information could be subpoenaed from their tax returns as to where they reported their primary residence to determine if they have federally reported Campbell as their home as well. 562 I Page The Klatt's have claimed to be occupying the Hastings home since 2012 when they fiirst started receiving a homestead exemption in Adams County. Property Assessment Division has chosen to deny the exemption only from 2017. moving forward which is in accordance with their current audit capabilities. They have chosen not to pursue reimbursement for the exemption that was awarded in years 2012-2016. Our recommendation is to deny the protest of the Homestead Exemption denial based on the findings of Deputy Morrow,the Adams County Clerk with regards to voter registration,the information from the Franklin and Webster County assessors offices,and at the direction of the Property Assessment Division,unless the Klatt's can provide substantial evidence suggesting otherwise.
