HomeMy WebLinkAboutSP07-20-10COURTHOUSE HASTINGS NEBRASKA Tuesday, July 20, 2010 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Curtis, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Hynes, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and asked if there were any conflicts of interest with any agenda item. Minutes of the previous meeting were approved as circulated. Kehoe attended a Combined Services Committee meeting on the 14th and the 911 system and Code Red were discussed. Saathoff sat in on protest hearings on July 7th, attended a Roads Committee meeting on the 14th, a Chamber Ag Business meeting on the 15th and a Roads Committee meeting this morning. Hynes attended the Planning Commission work shop on July 8th, the Business After Hours in Kenesaw on the13th, a Combined Services and Roads Committee meeting on the 14th and another Roads Committee meeting this morning. Neumann attended a Midland Area on Aging Board of Governors meeting and the Planning Commission meeting on July 8th, a South heartland District Health Dept board meeting on the 14th, a Wellness Committee meeting on the 15th where there was discussion of a tobacco free campus starting January 1, 2011 and a Wall of Wellness profiling employees who have made changes in their overall health. Curtis sat in on protest hearings on July 7th, attended the Planning meeting on the 8th and a Library Board meeting on the 12th. Orthmann sat on in on protest hearings on July 7th, attended the MAAA meeting on the 8th, a Senior Services and heartland Pet Connection meetings on the 14th. Woodman attended the Combined Services Committee meeting on July 14th, the protest hearings on the 7th, the Planning meeting on the 8th, a Roads Committee meeting on 14th and another Roads meeting this morning. During the public comment portion of the meeting, Dawn Miller, highway Superintendent announced that Adams Central Rd from 12th St to DLD Rd for bridge repair. At 9:45 the Board held a public hearing for a Conditional Use Permit for Glenwood Telecommunications Corp. for a communications tower. Judy Mignery, Planning Administrator, provided information to the Board from the Planning Commission. The Chairman opened the hearing and asked those wishing to speak to come forward. Charles Hastings, attorney, of 800 W 3rd St, Ste 202, spoke in behalf of Glenwood supporting their application. No one else appeared and the hearing was closed. Motion by Neumann, seconded by Saathoff to approve the Conditional Use Permit for Glenwood Telecommunications Corp., case 10-07.1 with the same conditions as requested by the Planning Commission. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Mignery also gave information regarding the Kids and Cattle Subdivision, case 10-07.2. Motion by Neumann, seconded by Hynes to approve the Kids and Cattle Subdivision, case 10-07.2, applicants Troy and Kari Legg. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Curtis to approve and authorize the Chairman to sign the Interlocal Agreement with the villages for planning services. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:00 AM the Board held a public hearing for proposed changes to the County Land Use Plan. Mignery, Planning Director, read the recommendation from the Planning Commission. Jim Kostal of 650 W Pony Express Road, Chairman of the Planning Commission spoke to the Board recommending passage of the proposed changes. Craig Murman of 800 E Monroe, Glenvil spoke stating that he could not make any comments regarding the entire Plan as he had not read the whole think but commended the County and the Planning Commission for their work. David Potter, consultant with JEO, spoke regarding changes to the boundaries of the Transitional Ag Area and retracting the highway overlay to be the same boundary as the TA District. Mignery read a communication from Justin and Allison Osborne assuring their property would be grandfathered outside the new Land Use Plan regarding the number of livestock units allowed on his property. No one else appeared to speak and the hearing was closed. Motion by Neumann, seconded by Hynes to accept the recommendations from the Planning Commission for Changes to the County Land Use Plan with changes as noted accepting draft 3A, Land Use Plan, , Zoning regulations, draft 6A, and Subdivision regulations, draft 2A. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dan Schwartzkopf of the Krull Agency presented a proposal to the Board to merge the County’s Flexible Spending Plan with the County’s Health Reimbursement Plan to one administrator that being Mid American Benefits at no increased cost to the County. The cost would remain at $14.00 per employee. Motion by Neumann, seconded by Saathoff to approve the change for the administration of the County’s Flexible Spending Plan to Mid American benefits. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Kehoe to move to Board of Equalization for motor vehicle exemption applications. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 11:00 AM. Motion by Saathoff, seconded by Kehoe to approve claims and authorize the County Clerk to pay the same from their respective accounts. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Neumann to accept officers reports for the month of June from the Register of Deeds. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Curtis, seconded by Saathoff to accept Miscellaneous Receipts for the month of June in the amount of $1,491,148.30. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board heard budget requests from the County Assessor, Veterans Service Officer, Extension Office and County Court, recessing at 12 Noon and reconvening at 1:15 PM to continue hearing budget requests from the Register of Deeds, Microfilm Dept, Communications budget, Treasurer’s office, County Attorney, Sheriff, Jail, 911and Roads Dept. Motion by Curtis, seconded by Neumann to approve and authorize the Chairman to sign the Letter of Agreement with Region III. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign the agreement with the Nebraska Dept of Energy for the Community Block Grant in the amount of $142,918.40. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Orthmann, to move to Executive Session for a county burial request. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Enter Executive Session at 3:25 PM. Motion by Neumann, seconded by Orthmann to return to regular session. Returned to regular session at 3:45 PM Motion by Saathoff, seconded by Curtis to approve the request for county burial assistance but to send a bill to Webster County and State of Nebraska since the deceased was a state ward residing in Webster County. presiding. Roll call members present were: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorney Lee and Shannon Bird representing the Treasurer. Motion by Saathoff, seconded by Curtis to approve motor vehicle exemption application for South Central Behavioral Services for a 2003 Dodge Intrepid. Roll call, ayes: kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Orthmann to return to regular session. Roll call, ayes: Kehoe, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:05 AM. This Board is now adjourned.
