HomeMy WebLinkAboutSP12-07-10COURTHOUSE HASTINGS NEBRASKA Tuesday, December 7, 2010 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Hynes, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. . The Chairman announced the locations of the open meetings law and agendas in the room. He also asked for any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Thomsen attended a Buildings and Grounds Committee meeting this morning. Saathoff attended a Chamber Board meeting on the17th, the South Central Economic Development Board annual meeting on the 18th, the Safety meeting and recognition of a Roads Dept employee on the 22nd and the Roads Committee meeting this morning. Hynes attended the Roads Committee meeting this morning and a meeting on the 6th with Senator Utter and other county officials regarding mental health reform. Neumann attended a Wellness Committee meeting on the 18th, the Safety meeting at the Roads Dept on the 22nd, a meeting at Hastings Utilities about future water rate increases on the 29th, a Midland Area Agency on Aging on the 2nd, the meeting with Senator Utter on the 6th as well as the Planning meeting that evening and the Buildings and Grounds Committee meeting this morning. Dale attended the SCEDD annual meeting on the 18th, the Safety Meeting at the Roads Dept on the 22nd, a Library Board meeting and an Extension Board meeting on the 2nd. Orthmann attended the Safety meeting at the Roads Dept on the 22nd, the meeting at Hastings Utilities on the 29th, the MAAA meeting on the 2nd and the Buildings and Grounds Committee meeting this morning. Woodman attended the Mid Nebraska Individual Services meeting on the 17th, the meeting with Senator Utter on the 2nd and the Roads Dept meeting this morning. During the public comments portion of the agenda Dawn Miller updated the Board on the progress with FEMA regarding storm damages in the County. Clerk Chris Lewis reminded the Board of the date for swearing in of recently elected officials on January 6, 2011 at 8:30 AM in the District Court room. Miller presented a resolution to the Board for approval for purchase of signage for the Roads Dept with federal funds. Motion by Saathoff, seconded by Curtis to approve and authorize the Chairman to sign Resolution 10-12-07.1 for purchase of signage for the Roads Dept with federal funds. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. At 9:45 AM the Board held a public hearing for the re-appointment of Robert Foote Sr to the Hospital Authority Board No 1. Clerk Lewis told the Board that she had received a petition from Mary Lanning Memorial Hospital with the required number of signatures to re-appoint Mr. Foote. She also reported that she had advertised the notice twice as required by law and that she had not received any written objections to his re-appointment. The Chairman opened the public hearing and no one appeared to speak for or against the re-appointment. The hearing was closed. Motion b y Neumann, seconded by Thomsen to re-appoint Robert Foote Sr to the Hospital Authority Board No. 1 for a term of 6 years to expire September 2015. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Attorney Audrey Lee presented an agreement to the Board for the services of attorney Vic Covalt for assistance with bankruptcy at a rate of $220.00 per hour. The need for his assistance will be left at the discretion of the treasurer. Motion by Hynes, seconded by Thomsen to approve and authorize the Chairman to sign the agreement with attorney Vic Covalt to serve as a bankruptcy attorney for Adams County at the rate of $220.00 per hour. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:00 AM Harold Johnson, Maintenance Supervisor, told the Board that the bids received for the lights were all higher than the grant from the Dept of Energy was written for. He suggests refusing all bids and asking Energy Pioneer Solutions to rewrite the grant. Motion by Curtis, seconded by Orthmann to refuse all bids received for replacement of lights in the Courthouse and ask Energy Pioneer Solutions to rewrite the grant. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to bring back to the table the bids received at the November 16th meeting for the thermostats and storm windows. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Thomsen to reject all bids received for thermostats and storm windows at the November 16, 2010 meeting. Motion by Saathoff, seconded by Curtis to approve claims and authorize the County Clerk to pay the same from their respective funds. Motion by Neumann, seconded by Saathoff to accept officers reports for the month of November from the County Clerk, Clerk of District Court, Register of Deeds and Treasurer. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Residents of Countryside Drive met with the Board regarding improvements to their road. Jim Ruzicka of 1208 Countryside Dr was the spokesperson for the residents since attorney Shon Lieske is no longer representing them. They asked the Board to please reconsider their request for a Street Improvement District in their subdivision as it is currently in poor condition. The Board said they cannot legally do that for them. Attorney Audrey Lee explained that she had written Mr. Lieske stating that statutorily the County is prohibited to create a Street Improvement District as the property lies within the jurisdiction of the City of Hastings. They said the City has refused their request as well. It was suggested that they might look into creating a Rural Road Improvement District, however it was mentioned that too is prohibited because the property lies within the City’s jurisdiction. Other residents from the area also spoke and asked questions. It seems that it is questionable whether or not a Home Owners Association was ever created in the subdivision. The Board remarked that they were sympathetic to their needs however they had no legal avenues to help them. It was suggested that they consult another attorney and petition the City again perhaps going through the Planning Commission. Judy Mignery, Planning Administrator, presented information to the Board regarding vacation of Uhrmacher Acres Subdivision and request for creation of Uhrmacher Acres Subdivision No 2. Motion by Saathoff, seconded by Neumann to approve and authorize the Chairman to sign Resolution 10-12-07.2 vacating Uhrmacher Acres Subdivision, case 10-12-1. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office. Motion by Hynes, seconded by Curtis to approve Uhrmacher Acres Subdivision No. 2, case 10-12.2, applicants Kevin and Carissa Uhrmacher. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Orthmann to move to Executive Session for personnel matters. The Chairman announced that the only discussion was about personnel and no action was taken.
