HomeMy WebLinkAboutSP08-16-11COURTHOUSE HASTINGS NEBRASKA Tuesday, August 16, 2011 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Orthmann, seconded by Neumann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Thomsen reported on a meeting he had with the new representative for Verizon Wireless. He also reported that he was able to find a certified appraiser to appraise the building the County is purchasing and also met with Daryl Parde and Prairie Title regarding closing date. Saathoff attended a Senior Action meeting on the 15th and the Roads Committee meeting this morning. Hynes attended a Budget meeting on the 15th, the exit interview with the state auditors and the Roads Committee meeting this morning. Neumann attended a Midland Area Agency on Aging meeting on the 4th, the exit interview with the auditors on the 10th and a CASA meeting on the 11th. Curtis attended a Drug Court meeting on the 4th and an Extension Board meeting that same evening, met with the Personnel Committee to review changes to the personnel manual on the 10th, but didn’t meet since the Board Room was not available, an Institute of Excellence webinar on the 11th and helped the Library Board at Kool-Aid Days on the 13th. Orthmann attended the MAAA meeting on the 4th, pulled the Emergency management Trailer to Tractor Supply for a fund raiser on the 6th, attended a Senior Services meeting on the 10th, met with the appraiser on the Parde building, was available for the Personnel Committee meeting that afternoon and a Heartland pet Connection meeting that evening. He also had an Adams County Convention and visitors Bureau meeting on the 11th and participated in the parade, car show and Sunday events for Kool-Aid Days. Woodman attended the budget meetings and also the exit interview with the auditors. During Public Comments Dawn Miller, Highway Superintendent, advised to Board of an invitation for a one day training in Grand Island by NDOR regarding federal funds. Lee Hogan and Sandy Himmelberg of the Adams County Fair Board addressed the Board regarding their upcoming budget. They said there are no numbers available yet as the auditors currently have their books. Kaleena Fong, Executive Director of the Adams County Convention and Visitors Bureau provided information regarding their request to raise the lodging tax by one percent to create a Visitors Improvement Fund. The Board held a public hearing at 10:00 for comment in support or opposition to the creation of the Visitors Improvement Fund. The Chairman opened the public hearing. Harry Dworak of the Comfort Inn spoke in favor of creating the fund. He stated it is a good thing and a lot of study had been given to this matter. The intent is to do good for Adams County. Stephanie Hagemeier of the Holiday Inn Express also spoke in support of the fund. Dee Haussler, HEDC director, wanted to go on record from a personal rather than professional position in support of this fund. He remarked that tourism is part of economic development. No one else appeared to speak and the hearing was closed. Motion by Saathoff, seconded by Thomsen to approve and authorize the Chairman to sign Resolution 11-08-16.1 creating the Visitors Improvement Fund. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office. The Board took up the matter of the resolution for financing the purchase of the Daryl Parde building with Adams County Bank. Clerk Lewis told the Board she had filled in all the required information on the bank’s prepared copy. Hynes questioned why the County is referred to as a corporation rather than a government. Woodman stated that this was only required by the bank because of federal bank auditors. Attorney Lee said she could have it rewritten naming Adams County as a government rather than a corporation but she was comfortable with the term corporation. Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman and Co-Chairman to sign the Resolution 11-08-16.2 for financing of the purchase of the Daryl Parde building as prepared. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office. Attorney Lee read a letter that she had prepared notifying Rural Metro of cancellation of the County’s contract with them. The Board had questions regarding the City’s ability to have an ambulance service up and operational by March 1, 2012. Joe Patterson, City Administrator and Kent Gilbert, Fire Chief addressed those questions. Motion by Hynes, seconded by Saathoff to approve and authorize the Chairman to sign the letter to Rural Metro terminating the contract with Adams County effective March 1, 2012. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dee Haussler, HEDC Director, and Steve Scherr, attorney for Hastings Utilities were available for questions regarding the Resolution for County funding up to $500,000 to encourage businesses to locate in Adams County. The Board had several concerns about requiring future county boards to fund this on an ongoing basis and were also concerned about the County’s ability to fund it in this year’s budget. Scherr offered to re-write the resolution if the Board wished that would help ease the requirement for a set amount for a set period of time. The Board was still concerned about the ability to fund anything in this year’s budget. Saathoff stated he would rather fund $100,000.00 for economic development rather than give $300,000 to the Ag Society for fair entertainment. Motion by Saathoff, seconded by Thomsen to approve and authorize the Chairman to sign Resolution 11-08-16.3 for funding of economic development in the County. More discussion ensued by Board members. Several said they were not against economic development but did not want to burden the taxpayers in Adams County to fund it this year. Dee Haussler stated that rather than have the Board deny approval of the Resolution he would rather withdraw from consideration at this time. He also stated that Adams County has always been friendly to economic development and he could understand their budget concerns. He said the Board has worked well with HEDC in previous matters for economic development and he knew he could count on their support in the future in other ways. Saathoff stated he wished to withdraw his motion and Thomsen withdrew his second. The Board did not take any other action on this matter. The Board recessed at 11:00 AM and reconvened at 11:05 AM. Miller brought forward discussion regarding the Federal Aid Buy Out resolution from the Nebraska Dept of Roads. If approved the State would return $121,000 for asphalt projects and$80,000 in bridge projects effective March 1, 2014 and automatically renewed up to 5 years. Motion by Saathoff, seconded by Hynes to approve and authorize the Chairman to sign Resolution 11-08-16.3 authorizing the Chairman to sign contracts with Nebraska dept of Roads for the Federal Aid Buy Out funds. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office.\ Thomsen informed the Board regarding the contract with Verizon Wireless for the purchase of cell phones and service for them with Verizon. He stated the plan he negotiated with the new Verizon representative was actually around $100.00 a month less that the plan he had negotiated with Chris Andress who is no longer with Verizon. He also stated that he and Jan Johnson, Register of Deeds are the only ones authorized by Verizon to make changes to the plan or add equipment. Motion by Neumann, seconded by Curtis to approve and authorize the Chairman to sign the Western States Contracting Alliance Government Entity Authorized User Agreement with Verizon Wireless. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Clerk Lewis told the Board that the state auditors require the Board to annually re-authorize any petty cash funds in county departments and to show these funds in the budget submitted to the auditors office. Motion by Orthmann, seconded by Curtis to approve and authorize the Chairman to sign Resolution 11-08-16.4 authorizing petty cash funds and amounts for various county departments. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office. Attorney Lee asked the Board to authorize the Chairman to sign the Victim Witness grant application. Motion by Curtis, seconded by Saathoff to approve and authorize the Chairman to sign the Victim Witness grant application. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, none. Clerk Lewis requested the Board to approve a 1% increase on the budget limitation. She explained that this did not increase budgets that have already made their requests for this year but does allow the Board to exceed the state statutory limitation of 2.5% and creates additional unused budget authority for the next year. Motion by Hynes, seconded by Orthmann to approve the 1% increase on the budget limitation for 2011-2012 budget year. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann<Saathoff and Woodman. Nays, none. Assessor Hynes and IT Director Ron Kucera discussed the proposed contract with Tyler Technologies for new CAMA software. Hynes had budgeted $63,000.00 for this software but the pricing actually comes in at $53,734.00. The State is picking up the licensing fee of $96,000.00. Kucera stated that the current system is old and no guarantees on how long he can maintain it as operational. Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman to sign the contract with Tyler Technologies for new CAMA software in the amount of $53,747.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Orthmann to move to Board of Equalization for approval of Tax List Corrections. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 11:50 AM. Motion by Neumann, seconded by Hynes to approve claims and authorize the County Clerk to pay the same from their respective funds. Motion by Orthmann, seconded by Thomsen to approve Miscellaneous Receipts for the month of July in the amount of $954,185.90.
