HomeMy WebLinkAboutSP05-22-12COURTHOUSE HASTINGS NEBRASKA Tuesday, May 22, 2012 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Curtis, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Orthmann attended a Midland Area Agency on Aging meeting and a NE Safety Council meeting at Flowserve on the 3rd, a Personnel Committee meeting and Drug Court Graduation on the 4th, a BID Board meeting on the 8th, a Senior Services meeting on the 9th, an Adams County Convention and Visitors Board meeting on the 10th and the Buildings and Grounds meeting this morning. Curtis attended an Extension Board meeting on the 3rd, the Personnel Committee meeting and the Drug Court Graduation on the 4th and a Library Board meeting on the 14th. Neumann attended the MAAA meeting and the Safety meeting at Flowserve on the 3rd, a South Heartland District Health dept meeting on the 9th, the Blue Cross Blue Shield meeting on the 17th and the Buildings and Grounds meeting this morning. He also reminded Board members about the Walk Out on Work tomorrow. Hynes attended the Roads Committee meeting this morning and State Dept of Roads Classifications and Standards meeting last Friday. Saathoff attended the Personnel Committee meeting on the 4th, a Chamber Ag Business meeting on the 17th, a Senior Action meeting on the21st and the Roads Committee meeting this morning. Thomsen attended an ASAAP meeting on the 15th and the Buildings and Grounds meeting this morning. Woodman attended a Mid NE Individual Services meeting and the Roads Committee meeting this morning. During public Comments, John Oberheide of 2815 S Baltimore Ave addressed the Board regarding the current Zoning Regulations that prevent him from getting a building permit on property he bought in 2000 with intentions to build a house there. He erected a building in 2001 with the plans showing a future house to be built there later. The Zoning Regulations were changed since then to only allow 2 house to be built in a quarter section in areas zoned Transitional Ag. He stated that next to his property are five houses on 75 acres with the most recent one built in 2006. He asked the Board for their advice on how he should proceed as current regulations prevent him from building. On the advice of the County Attorney the Board suggested that he appeal to the Board of Adjustments for their approval. Dawn Miller also addressed the Board to report that the Federal Highway Administration concurs with the NE Dept of Roads and has reinstated the soft match funds for Adams County in the amount of $1,039,821.33 after auditing county files. Dianne Fowler, director of Midland Area Agency on Aging introduced Gerald Gerdes who is replacing Ms Fowler effective July 1, 2012. She also presented the MAAA funding request from Adams County for 2012-2013. The total request is $14,801.00. Joyce Mangers with the City of Hastings Development Dept presented two subdivisions approved by the City for acceptance of streets and easements by the County. Motion by Curtis, seconded by Neumann to accept dedication of streets and easements in the Matt Gottsch Subdivision. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to accept dedication of streets and easements in the Alex Quinn Subdivision. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Orthmann to move to Board of Equalization for motor vehicle exemption applications. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10: 32 AM. Judy Mignery, Planning Director, presented information on the Glenwood Second Subdivision which also includes vacation of the original Glenwood Subdivision. Chuck Hastings, attorney, was available to answer questions. Motion by Hynes, seconded by Saathoff to approve the Glenwood Second Subdivision, case 12-05.4 which also vacates the original Glenwood Subdivision by way of Resolution 12-05-22.1. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Motion by Saathoff, seconded by Orthmann to re=appoint Jim Kostal to the Planning Commission to another three year term. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller presented a Resolution for approval that would allow her and the Clay County Highway Superintendent to conduct a study regarding the close of Riverview Avenue. Motion by Thomsen, seconded by Saathoff to approve and authorize the Chairman to sign Resolution 12-05-22.2 calling for a joint study with Clay County regarding the vacation of Riverview Ave. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County clerk’s office. County Clerk Lewis told the Board she is in receipt of a new contract with Region III for mental health services. A copy of the new contract was given to the County Attorney for review and she noted no changes from the previous contract. Motion by Curtis, seconded by Thomsen to approve and authorize the Chairman to sign the new contract with Region III for mental health services. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Lewis also told the Board that she has received a request to appoint two new members to the Adams County Convention and Visitors Bureau Board. Motion by Orthmann, seconded by Curtis to appoint Brian Almond to the ACCVB Board to a term to expire in June 2013 and Jody Jacobi to a term to expire June of 2016. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Thomsen to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Thomsen to approve Miscellaneous Receipts for the month of April in the amount of $693,735.31. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Curtis, seconded by Neumann to accept officer reports for the month of April from the County Clerk, District Court Clerk, Register of Deeds and Sheriff. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Thomsen, seconded by Orthmann, to move to Executive Session for discussion of personnel and litigation. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 11:30 AM. Hynes was excused. Also present was County Attorney Donna Fegler Daiss and Dawn Miller. Hynes returned at 12 Noon. Motion by Thomsen, Seconded by Orthmann to return to regular session. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Returned to regular session at 12:07 PM. The Chairman announced that the only discussion was regarding personnel and litigation and no actions were taken in closed session. This meeting is adjourned. Also present were County Clerk Lewis, County Attorney Naples and Shannon Bird representing the Treasurer’s office. Motion by Orthmann, seconded by Curtis top approve a motor vehicle exemption application for Mosaic for a 2012 Toyota.
