HomeMy WebLinkAboutSP08-07-12COURTHOUSE HASTINGS NEBRASKA Tuesday, August 7, 2012 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Orthmann, seconded by Neumann that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Thomsen attended the Board of Equalization meetings on the 18th, 19th and 20th, an ASAAP meeting on the 24th, the Planning Commission meeting on the 6th and the Buildings and Grounds Committee meeting this morning. Work on replacing windows at the ACOB is progressing. Saathoff attended the BOE meetings, a Chamber meeting on the 25th, visited with Melvin Haba about vacating Riverview Ave and also the auditor’s report on the 1st and the Roads Committee meeting on the 6th. Hynes attended the BOE meetings on the 18th and 19th, a State Board of Classifications and Standards meeting on the 20th, visited with Melvin Haba on the 1st and the Roads Committee meeting on the 6th. Neumann attended the BOE meetings on the 18th, 19th and 20th, the opening of the fair on the 18th, a CASA meeting, a Midland Area Agency on Aging meeting on the 2nd, the auditor’s report on the 1st and the Buildings and Grounds meeting this morning. Curtis attended the BOE meetings, judged a 4-H can rolling ice cream contest and drove the fair tram on the 20th and an Extension Board meeting on the 2nd. Orthmann attended the BOE meetings, the fair opening, a Community Action Partnership Board meeting on the 26th, the MAAA meeting on the 2nd, a Safety meeting and the Buildings and Grounds meeting this morning. Woodman attended the BOE meetings and the fair opening. Saathoff wanted to recognize Jack Schreiner for the work he has done with HEDC to promote and bring businesses to the community. During public comments, Melvin Haba spoke for his family on the vacating of Riverview Ave... They are opposed to permanently vacating the road as it makes it difficult for his calving operation and the pasture and farming operation which are northwest of his home. Silver Lake Rd has 5 low tonnage bridges that he cannot traverse with a loaded stock trailer or single axle grain truck. If any one of those bridges failed it might be possible to use Riverview as an alternate route. Mr. Hubl has concerns with only replacing the south structure would promote the growth of weeds. He doesn’t want to see either road closed but there would be more cost involved in keeping Silve Lake open than leaving Riverview open. Dawn Miller updated the Board on the Marian Rd box culvert project. The contractors, Van Kirks of Sutton, are asking for an extension of time and the Road Committee is considering this. Miller stated that no bids had been received for the safety project at 26th St and Showboat Blvd. The work for this project will be pieced out with the County doing placement of signs and posts, Hastings Utilities placing the lighting and the rumble bars and delineators being done by a contractor. Motion by Saathoff, seconded by Hynes to release securities from Five Points Bank, Cusip numbers 313374YZ7 in the amount of $1,000,000.00 and 313376XS9 also in the amount of $1,000,000.00 and from heritage Bank Cusip number 096584BB2 in the amount of $170,000.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Curtis, seconded by Neumann to move to Board of Equalization for real estate corrections and exemptions and motor vehicle exemption applications. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10:00 AM. Harold Johnson, Maintenance Supervisor asked the Board to declare a list of county property as surplus and to be placed for public sale. He reported that he had circulated the list to all departments and some items have been transferred and removed from his original listing. Motion by Thomsen, seconded by Curtis to declare the list of County property as presented by Harold Johnson as surplus and to be placed for public sale. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:20 the Board took up the discussion of a resolution for vacating Riverview Ave. Saathoff stated he did not feel the road should be permanently vacated with the property going to adjacent property owners. Neumann asked what is the difference between closing and vacating a road. He said once that is done you can never go back and establish it as a road again. Motion by Saathoff, seconded by Hynes to deny the vacation of Riverview Rd. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:30 the Board held a public hearing for a Conditional Use Permit. Judy Mignery, Planning Administrator, presented information on a Conditional use Permit application by Robert Cates. Mignery stated that the Planning Commission had approved the permit with conditions. The Chairman opened the hearing however no one stepped forward to speak and the hearing was closed. Motion by Neumann, seconded by Thomsen to approve the application from Robert Cates, case 12-08.1 for a Conditional Use Permit with the same conditions as recommended by the Planning Commission. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Mignery reported that the Mehling Subdivision and vacation of the RS Ag Land Subdivision had been approved by the Planning Commission, however she has not seen the plat and does not feel comfortable approving the subdivision and vacation without seeing the plat or having Mr. Mehling present. Motion by Saathoff, seconded by Neumann to postpone the application for Mehling Subdivision, case 12-07.2 until Mr. Mehling is available. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis reported she has received a letter from Kaleena Fong, ACCVB director, requesting the appointment of Terry Anstine to replace Pat Boyd. Motion by Orthmann, seconded by Saathoff to appoint Terry Anstine to the Adams County Convention and Visitors Bureau Board for a term to expire June 2016. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis presented a resolution to the Board for approval naming departments and amounts for petty cash funds. Motion by Neumann, seconded by Thomsen to approve and authorize the Chairman to sign Resolution 12-08-07 naming departments and amounts for petty cash funds. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 10:45 and reconvened at 10:50. Motion by Orthmann, seconded by Neumann to enter Executive Session personnel issues. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, none. Entered Executive Session at 10:50 AM. Motion by Orthmann, seconded by Saathoff to return to regular session. Roll call ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:25 AM. Motion by Orthmann, seconded by Thomsen to approve claims and authorize the Clerk to pay the same from their respective funds. Motion by Curtis, seconded by Orthmann to accept officers reports for the month of July from the County, District Court Clerk, Register of Deeds, Sheriff and the Distress Warrant report from the Treasurer. The Board conducted their quarterly inspection of the jail and reconvened in the Board Room for a budget workshop. The Board adjourned at 1:00 PM. Witte Deputy COURTHOUSE HASTINGS NEBRASKA Tuesday, August 7, 2012 The Adams County Board met as a Board of Equalization for the purpose of hearing motor vehicle, real estate and personal property exemption applications and real estate corrections of value with Chairman Larry Woodman presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorney Naples, Assessor Hynes and Shannon Bird representing the Treasurer. Motion by Neumann, seconded by Orthmann to approve the correction of value for Howard & Bev Junker, property ID # 034270.10 by changing the number of certified acres of irrigated ground for a total value of $623,260.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Curtis to approve the correction of value for property owned by Darrel Lockwood, ID # 50-00450 for 2009 to $265,385.00, 2010 to $289,595.00 and 2011 to $331,755.00.
