HomeMy WebLinkAboutSP09-04-12COURTHOUSE HASTINGS NEBRASKA Tuesday, September 4, 2012 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Thomsen attended an ASAAP meeting and a Safety meeting on the 28th and the Buildings and Grounds meeting this morning. Saathoff attended a Chamber Board meeting on the 22nd, drove roads in West Blue Township with Dawn Miller on the 24th and a Roads Committee meeting this morning. Hynes attended the Roads Committee meeting this morning and a Region III meeting on the 23rd. Neumann attended a meeting in Kearney on emergency management control on animals with disease, went to the state fair a couple times and attended the Oregon Trail Rodeo. Curtis attended a Library Board meeting on the 22nd and drug court on the 29th. Orthmann worked at the County property on D & Rhode Island on the 28th and 29th cutting and spraying weeds, attended the state fair on the 29th and attended the Buildings and Grounds meeting this morning. Woodman attended the Roads Committee meeting this morning. Motion by Neumann, seconded by Hynes to approve the additional approved increase of one percent for the 2012-2013 Adams County budget. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller, Highway Superintendent, presented two bids received for large corrugated metal pipes for 4 County projects. Bids received were from Ace/Eaton Metals for $55,816.00 and Midwest Service and Sales for $67,164.04. Motion by Hynes, seconded by Saathoff to award the bid for large metal corrugated pipes to Ace/Eaton Metals in the amount of $55,816.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Miller also presented a timeline history to the Board regarding the 35 mile per hour speed limit on Lochland Road near Tri-View School. It was her suggestion based on the fact that school is no longer held at Tri-View that the speed return to the county gravel road speed limit of 50 mph. Motion by Thomsen, seconded by Saathoff to change the speed limit from 35 mph to 50 mph on that portion of Lochland Road at the City of Hastings limits east to just west of Showboat Blvd. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Curtis to approve release of a security from Five Points Bank in the amount of $1,000,000.00, Cusip # 3136FRQ71. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Judy Mignery, Planning Administrator, presented information to the Board regarding the proposed resolution to vacate the RS Ag Land Subdivision and approve the Mehling Subdivision. Motion by Thomsen, seconded by Hynes to approve and authorize the Chairman to sign Resolution 12-09-04.1 vacating the RS Ag land Subdivision and approving the Mehling Subdivision. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County clerk’s office. At 10:00 AM the Board held a public hearing for the proposed 2012-2013 County budget. The Chairman asked those wishing to speak to step forward. County Clerk Lewis offered information regarding the proposed budget and referenced the publication in the Hastings Tribune from August 30, 2012. Lewis read the following statement into the record. The Adams County tax rate will be .31911. If it were not for the use of inheritance dollars, the county rate would be increased to .32890 in order to maintain the current level of services that are both mandated under state law and that Adams County taxpayers deserve and expect. Adams County will be transferring $1,000,000.00 from the Inheritance Fund to the General Fund. No one else appeared to speak and the Chairman closed the hearing. Motion by Neumann, seconded by Saathoff to set the tax request for the County different from last year for the General Fund for 2012-2013 at $8,110,409.00 and the Library Fund at $151,136.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, none. Motion by Hynes, seconded by Orthmann to approve and adopt the Adams County 2012-2013 budget as presented. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann< Saathoff and Woodman. Nays, none. Donna Daiss, County Attorney, discussed whether or not to pursue a contract with Northeast Juvenile Services in Madison NE for housing juveniles that need to be kept in secured facilities for court hearings. Northeast requires an upfront annual payment of $39,205.00 to guarantee beds available and a reduced daily rate of $145.00 per day for secured detention and $125.00 per day for staff secured. Per Diem rates without a contract are $255.00 per day for secured detention and $175.00 per day for staff secured. The Board asked for her to also see about getting transportation costs. Chairman Larry Woodman administered an oath of office to Robert McGovern who will hold a position on the Veterans Service Committee replacing Jim Peterson. Motion by Curtis, seconded by Saathoff to accept inventories from the county departments for 2012. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Thomsen to re-appoint Doug Joynt to the Board of Adjustments for a three year term to expire in May, 2015. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Saathoff to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Hynes, seconded by Thomsen to accept an officers report from the Sheriff for the month of August. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Orthmann to move to Executive Session for a county burial request. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 10:45 AM. Motion by Orthmann, seconded by Thomsen to return to regular session.
