HomeMy WebLinkAboutSP09-18-12COURTHOUSE HASTINGS NEBRASKA Tuesday, September 18, 2012 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Orthmann, seconded by Neumann that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Orthmann attended a Midland Area Agency on Aging meeting on the 6th, a BID Board meeting on the 11th, a Senior Services meeting on the 12th, an ACCVB meeting on the 13th and the Buildings and Grounds meeting this morning. Curtis attended an Extension Board meeting on the 6th, a Library Board meeting on the 10th and an Ag Society Board meeting on the 11th. Neumann attended the MAAA meeting on the 6th, met with Gary Jewell of Colonial Life on the 10th, attended a South Central Heartland District Health planning meeting on the 11th and a Board meeting on the 12th and the Buildings and Grounds meeting this morning. Hynes attended a Road Committee meeting yesterday to meet with a salesman and also a regular committee meeting this morning. Saathoff attended the same Roads Committee meetings as Hynes. He also reported that he had spot checked some of the county department inventories and that everything checked out fine. Thomsen attended a Planning Commission meeting on the 4th and the Buildings and Grounds meeting this morning. He said the windows at the ACOB are finished and the deadline was met. The paperwork has been sent in. The windows in the Annex will be the next project. He stated that both projects will be a great improvement. Woodman attended both Roads Committee meetings. During public comments, Amy Palser, Managing Editor of the Hastings Tribune, introduced their new government reporter, Jocelyn McMurtry. Dawn Miller, Highway Superintendent, provided information on the annual report to the Nebraska Board of Classifications and Standards and asked the Board for approval to submit the report. Motion by Saathoff, seconded by Curtis to approve and authorize the Chairman to sign the Road and Bridge Contracts Report for 2012. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Saathoff to approve and authorize the Chairman to sign the Certification to The Board of Public Works Classifications and Standards. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Kaleena Fong, Director of Adams County Convention and Visitors Bureau, presented information to the Board regarding grant awards that had been approved by the ACCVB Board in the amount of $26,027.00 and asked the Board for their approval to award them. Motion by Orthmann, seconded by Curtis to approve Visitors Improvement grants to the following: Hastings Museum, $4000.00; Adams County Historical Society, $1000.00; Crystal Lake, $10,000.00 and Prairie Loft, $11,027.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Fong also asked for permission to transfer City Occupation tax funds from Hastings State Bank to Five Points Bank because of their proximity to her location and also because of the support that Five Points Bank shows to local events. Motoi by Orthmann, seconded by Neumann to approve transferring City occupation tax funds from Hastings State bank to Five Points Bank. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:00 AM the Board held a public hearing for a Conditional Use Permit for Commercial Grain Storage by CHS. Judy Mignery provided preliminary information and reported on the recommendation from the Planning Commission. Mitch Woeste of CHS spoke in favor of the permit and answered questions from the Board. Dawn Miller stated that the portion of the road where this facility is to be located is maintained by Webster County and referred CHS to Webster County regarding a driveway. No one else appeared to speak and the Chairman closed the hearing. Motion by Hynes, seconded by Thomsen to approve the request for a Conditional Use Permit, case 12-09.3, applicants James and Danece Meyer, with the same conditions as recommended by the Planning Commission. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Joe Heckenlively, Trustee of the Kenesaw Village, addressed the Board regarding drainage issues in Kenesaw Village and flooding of the west part of town during a 5 inch rain. He stated the Village plans to put in a 24” culvert under the railroad tracks but asked the Board to assist in some additional work in ditches on the south side of the tracks to divert more water away from town. Jeff Edmondson and Hank Edmondson also responded to questions from the Board. It was decided that the Board couldn’t make any decisions at this meeting but offered to discuss possible solutions with the Roads Committee at a future meeting. Dawn Miller presented a proposed purchase of a John Deere motorgrader from state bid with the trade of a 2002 140H Caterpillar. Motion by Saathoff, seconded by Hynes to approve the purchase of a John Deere 770G motorgrader from state bid with the required options in the amount of $211,420.00 with the trade of the 2002 140H Caterpillar in the amount of $95,200.00 for a final purchase price of $116,220.00. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 10:37 AM and reconvened at 10:45 AM. County Clerk Lewis presented information regarding a proposed change to the lease with Dept of health and Human Services for space at the ACOB. The amendment proposes changing the automatic extension from 10 years to 5 years with the date going to November 30, 2016. Motion by Neumann, seconded by Saathoff to approve the lease amendment with DHHS for space at the ACOB extending it to November 30, 2012 with the provision that the County do a study of expenses related to the lease in relation to the rent amount by July 2013. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Thomsen to move to Board of Equalization for Tax List Corrections. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 11:07 AM. Motion by Curtis, seconded by Orthmann to approve claims and authorize the Clerk to pay the same from their respective funds. Motion by Saathoff, seconded by Neumann to accept miscellaneous receipts for the month of August in the amount of $574,842.88. Motion by Orthmann, seconded by Curtis to accept officers reports for the month of August from the County Clerk, Register of Deeds and Clerk of the District Court. Roll call members present were: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis and Attorney Naples. Motion by Curtis, seconded by Orthmann to approve and authorize the Chairman to sign Tax List Corrections 14013 through 14027. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Orthmann to return to regular session.
