A special meeting of the Adams County Board of Supervisors was held as per written request under Neb. Rev.Stat. Section 23-273. A special
meeting was necessary for the following purpose of declaring the Adams County Public Defender position vacant due to the death of current office
holder, Arthur Toogood, to direct the Adams County Clerk to solicit applications for a replacement public defender, and to appoint an Acting Public
Defender until a permanent replacement is appointed. Public notice was given in the Hastings Tribune on June 1, 2013.
Chairman Neumann was presiding. Roll Call: Thomsen, Curtis, Neumann, Orthmann, Saathoff, Hynes and Weeks. Also present was Adams County
Clerk, Ramona Thomas; Adams County Attorney, Donna Fegler-Diass; Adams County Deputy Attorney, David Bergin; Adams County Deputy Public
Defenders, Sam Zeleski and Bob Wolf; also from the Adams County Public Defender's office were office staff Patty Feldman and Sandra Kothe.
Motion by Orthmann, seconded by Weeks to declare this an open special meeting of the Adams County Board of Supervisors. Roll Call: Ayes;
Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, Weeks. Nays; None.
Chairman Neumann opened the meeting by acknowledging the sudden loss of long time Adams County employee Arthur Toogood. Neumann
requested a motion to declare the position of the Adams County Public Defender as vacant.
Motion by Curtis, seconded by Saathoff to declare the Adams County Public Defender position as vacant. Roll Call: Ayes; Thomsen, Curtis,
Neumann, Hynes, Orthmann, Saathoff, Weeks. Nays; None.
Chairman Neuman requested a motion to allow Clerk Thomas to begin advertising and collecting applications for the Public Defender position.
Motion by Orthmann, seconded by Saathoff to authorize Clerk Thomas to advertise the position as open and collect applications for the selection
process. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, Weeks. Nays; None.
Current Deputy Public Defenders Wolf and Zeleski both spoke of their interest in being appointed the Acting Public Defender.
Motion by Saathoff, seconded by Orthmann to approve the appointment of Sam Zeleski as the Acting Public Defender for Adams County, until the
position can be permanently filled. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, Weeks. Nays; None.
