E1204076LD Tuesday, August 6, 2013 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck Neumann presiding. Roll Call members present were: Thomsen, Curtis, Neumann, Orthamann, Saathoff, Hynes and Weeks. Motion by Curtis, seconded by Orthmann, that this is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff, Weeks and Hynes. Nays: None. The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Committee Reports: Thomsen attended a dinner and tour of the Maryland Center on the 19th. On the 5th, Thomsen attended a Planning and Zoning meeting and a Building and Grounds meeting this morning. Thomsen, as well as all the Board members, attended the Board of Equalization property valuation protest hearings on the 23rd. Saathoff attended two Road and Bridges Committee meetings, one on the 30th of July and one this morning. Hynes attended the Road and Bridges Committee meeting this morning. Weeks attended an LEPC Appreciation event for all organization that participated in the bids for the future Veteran's Home and a Road and Bridges Committee meeting this morning. Curtis attended a SCEDD meeting in Nelson on the 25th and an Extension Board meeting on the l:t. Orthmann attended an MNIS meeting on the 17th in Kearney, had a personnel meeting with Becky Sullivan from Mary Lanning on the 18th, attended a tour of the Maryland Center on the 19th, a Community Action Partnership meeting in Kearney on the 25th, a Midland Area Agency on Aging meeting on the 1" and the Building and Grounds meeting this morning. 145 Neumann attended a Joint Land Use Study meeting with SCEDD on the 24th, a Budget Committee meeting on the 24th and the Building and Grounds Committee meeting this morning. Chip Volcek, Adams County Emergency Management Director, introduced Dawna Whitcomb to the Board. Whitcomb has been hired as the Adams County Emergency Management Assistant. Volcek requested Chairman Neumann's signature recognizing Whitcomb's appointment and allowing Whitcomb to decisions for the Emergency Management office in the event of Volcek's absence. Motion by Weeks, seconded by Orthmann to approve the appointment of Dawna Whitcomb as the Adams County Emergency Management Assistant. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, and Weeks. Nays: None. Phil Lorenzen with D.A. Davidson & Company presented the board with bond options for the proposed truck route project. The Board had previously requested costs on a five year payment option in the amounts of two, two and a half and three million dollars. Extensive discussion took place regarding the project and the impact to tax payers. It was proposed by Dawn Miller, Adams County Highway Superintendent, that the County collect bids in order to determine an actual cost for the project as the bid process does not commit the County to move forward if the cost is determined too high. A decision collecting bids was tabled until the budget work session later this afternoon. Judy Mignery, Adams County Planning and Zoning Director, presented the Board with a subdivision application from land owner Dave Niemoth. Niemoth is requesting the property at 770 W 94th Street be subdivided for residential purposes. The size of the subdivision would by 11.8 acres and referred to as the Highland Heights 5th Subdivision that would include three lots. Motion by Saathoff, seconded by Weeks to approve the application by Dave Niemoth for the Highland Heights 5th Subdivision, located ay 770 West 94th Street. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays; None. David Bergin, Deputy County Attorney, approached the Board in regards to accepting bids for a Secondary Public Defender in cases where a conflict of interest occurs. Bergin stated that our current contract has expired and advised the County accept bids until August 19th at 5:00 p.m, with the bid opening occurring during the August 20th regular board meeting. An advertisement for bids will be placed in the Hastings Tribune by Clerk Thomas upon the Board's approval. Motion by Thomsen, seconded by Saathoff to allow Clerk Thomas to advertise for bids for Secondary Public Defender services. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Dawn Miller, Adams County Highway Superintendent, presented the Board with a resolution for execution of the construction engineering agreement with MaineIli Wagner & Associates for the Hastings Northeast Federal Aid Project BR -20385(1). The cost of the project is $109,632.58 which is all Federal Aid and State Funds. 146 SUPERVISORS RECORD No. 27 ADAMS COUNTY, NEBRASKA REDFIELD & CO. E1204076LD 3-o`.6 ^otn,o1 Motion by Weeks, seconded by Curtis to approve Chairman Neumann signing resolution41-3-08-06-for the execution of the construction engineering agreement with Mainelli Wagner & Associates for the Hastings Northeast Federal Aid Project BR -2038 (1). Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None. Amy Greenland, Director of the Hastings Public Library, presented a budget request to the Board in the amount of $149,490.00. This is a 3% increase from the 2012-2013 budgeted amount. Limited discussion pertaining to this request occurred as it will be further discussed during upcoming budget workshops. David Bergin, Deputy Adams County Attorney, presented the Board with a contract from Verizon for the rental of tower space that sits on the roof of the Adams County Office Building (ACOB). Scott Thomsen, spoke on behalf of the Building and Grounds Committee. Thomsen indicated that after extensive conversations with Verizon regarding responsibility of tower repairs, number and size of dishes that would be installed, and a three year verses one year extension term, it appears Verizon is unwilling to compromise and accepted the terms that Adams County requested in the contract. Thomsen advised that the potential risk of property damage outweighs the reward of $15,000.00 per year rent revenue. It is the recommendation of the Adams County Building and Grounds Committee that Adams County discontinues negotiations with Verizon regarding the rental of tower space on the ACOB. Motion by Curtis, seconded by Orthmann to discontinue negotiations with Verizon Cellular for the rental space on the Adams County Office Building. Roll Call: Ayes; Thomsen, Saathoff, Hynes, Neumann, Weeks, Curtis and Orthmann. Nays; None. Ramona Thomas, Adams County Clerk, requested the Board make a motion to exceed the budget limit by 1% from 2.5% to 3.5%. Motion by Thomsen, seconded by Saathoff to increase the budget limit by 1%. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None. Clerk Thomas presented the Board with a resolution setting the petty cash amounts for those offices that have petty cash available. Motion by Curtis, seconded by Weeks to approve the resolution setting the amount of petty cash available in certain County Offices. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None Resolution 13-08-06.2 will be on file in the County Clerks Office. Motion by Saathoff, seconded by Weeks to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff, and Weeks. Nays; None. Motion by Curtis, seconded by Hynes to approve the officer's report from the Register of Deeds office. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None. The Board concluded the morning session with a quarterly jail inspection. Recessed for lunch at 12:00. The Board resumed regular session at 1:00 p.m. with a budget workshop. Gregg Magee presented the Board with modifications made to the budget he had previously presented in July. These modifications would allow for items pertaining to courthouse security. For the protection of public interest it was determined by Chairman Neumann that items pertaining to courthouse security be heard in closed session. Motion by Weeks, seconded by Thomsen to enter closed session for the protection of the public interest. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None. The Board entered closed session at 1:09 p.m. Motion by Orthmann, seconded by Hynes to enter regular session. Roll call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays; None. The Board resumed regular session at 1:43 p.m. No action was taken in closed session. Dawn Miller, Adams County Highway Superintendent, once again approached the Board regarding the proposed truck route and requesting the County collect bids. Extensive discussion took place regarding the truck route project. Through discussion it was determined in order to make an informed decision on proceeding with the project, the County needed to collect accurate bids. It was stated that the bidding process did not commit the County to move forward with the project if bids were higher than anticipated. The only cost involved in taking bids would be the advertising cost. Motion by Curtis, seconded by Saathoff to allow the Adams County Highway Superintendent, Dawn Miller to advertise for bids on the proposed truck route project. Roll Call: Ayes; Thomsen, Curtis, Neumann, Hynes, Orthmann, Saathoff and Weeks. Nays: None. The Board concluded the meeting with a budget workshop.
