E1204076LD COURTHOUSE, ADAMS COUNTY Tuesday, October 15, 2013 175 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck Neumann presiding. Roll Call members present were: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff and Neumann. Motion by Orthmann, seconded by Weeks, that this is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann, Nays: None. The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Chairman Neumann also gave a brief summary of the NACO salary recommendations for elected officials Mark Evans, with the City of Hastings Planning Department was present for Rich Cartier to request approval for the Nunley Third Subdivision located at Baltimore Avenue and Prairie Lake Road, there is a right of way indication that requires Adams County Board approval. Motion by Saathoff, seconded by Weeks to approve the request made by Mark Evans with the City of Hastings Planning Department for the Nunley Third Subdivision. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Dawn Miller, Adams County Highway Supervisor, presented the Board with a resolution (#2013-10-15-.02) for placement of a stop sign at 42nd and Columbine and a yield sign at Silver Lake and Adams Central Road. Motion by Weeks, seconded by Curtis to approve resolution 2013-10-15.02 for the placement of a stop sign at 42nd and Columbine and a yield sign at the intersection of Silver Lake and Adams Central Road. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Resolution 2013-10-15.02 is on file at the Adams County Clerks Office. 176 SUPERVISORS RECORD No. 27 ADAMS COUNTY, NEBRASKA REDFIELD & CO. E1204076LD David Bergin, Deputy Adams County Attorney, requested Chairman Neumann's signature on a special conditions form for the (Victims of Crime Act) VOCA grant. Motion by Orthmann, seconded by Curtis to approve Chairman Neumann's signature on the special conditions form for the VOCA grant. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Motion by Curtis, seconded by Saathoff to move to Board of Equalization to hear penalty protests, tax list corrections,motor vehicle exemptions and to set 2013 tax year levies. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. The Board entered as a Board of Equalization at 10:00 a.m. Motion by Orthmann, seconded by Saathoff to resume regular session. Roll Call. Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Board resumed regular session at 10:39 a.m. Chrys Setlik, Adams County Clerk of the District Court, addressed the Board regarding upgrades to the Adams County Courtrooms. Proposed upgrades would include a new sound system, and T.V. monitors. The proposed upgrades were not included in the 2013-2014 budget. At this time Setlik will get formal bids for the upgrades. Chip Volcek, Adams County Emergency Management Director, requested the approval of resolution 2013-10-15.01 for a Local Emergency Operations Plan (LEOP). Motion by Weeks, seconded by Orthmann to approve the signing of the 2013 LEOP. Roll Call: Ayes; Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Clerk Thomas presented the Board with correspondence from Deputy Treasurer Melanie Curry, requesting the striking of personal property taxes from properties where back taxes have been unable to be collected for two years. SS 77-1738. Motion by Curtis, seconded by Saathoff to approve the striking of personal property taxes for Oasis Sprinklers & Landscape and Premium Protein Products in accordance with SS 77-1738. Roll Call: Ayes; Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Bergin, presented the Board with the revised agreement between Verizon and Adams County, for leasing of tower space on the ACOB tower to Verizon. Thomsen stated that after extensive negotiations, he is satisfied with the agreement and is comfortable requesting Board approval. Brief discussion took place regarding the agreement. Motion by Curtis, seconded by Hynes to approve the signing of the Lease agreement between Adams County and Verizon for the renting of Adams County tower space on the Adams County Office Building. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff. Nays: Neumann. Harold Johnson, Head of the Adams County Maintenance Department, presented the Board with bids for a new chiller for the main courthouse building. Two bids were received; Johnson Controls from Omaha at a price of $92,800.00 and Rutt's Heating and Air-conditioning from Hastings at a price of $120,000.00. After discussion with the Building and Grounds Committee, Johnson recommended the higher bid from Rutt's Heating and Air due to there being no additional charge for service calls, mileage and fuel surcharges as there is with Johnson Controls. Motion by Saathoff, seconded by Orthmann to award the chiller bid to Rutt's Heating and Air in the amount of $120,000.00. Roll Call: Ayes; Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Motion by Orthmann, seconded by Saathoff to move to closed session for both the protection of the public interest and contract negotiations.Roll Call: Ayes; Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. The Board entered executive session at 10:57 a.m. Board member Orthmann left the room at 11:52 a.m. Motion by Weeks, seconded by Curtis to resume regular session. Roll Call: Ayes; Weeks, Hynes, Thomsen, Curtis, Saathoff, Neumann. Nays: None. Absent/Not Voting: Orthmann. The Board resumed regular session at 11:52 am. Chairman Neumann stated that no action was taken in closed session. Orthmann returned to the Board room at 11:54 a.m. Dawn Miller, Adams County Highway Superintendent, distributed information to the Board regarding finance options for the proposed 281 to Hwy 6 truck route project. Information distributed contained both five and six year finance options. At this time, Miller requested a decision on the terms of the financing for the project if the project moves forward. Motion by Curtis, second by Orthmann to approve a five year financing option in the event the proposed truck route project moves forward. 177 SUPERVISORS RECORD No. 27 ADAMS COUNTY, NEBRASKA REDFIELD & CO. E1204076LD Chairman Neuman requested a verbal roll call vote. Roll Call: Ayes: Weeks, Curtis, Orthmann, Neumann. Nays: Hynes, Thomsen. Abstaining: Saathoff. Motion by Curtis, seconded by Orthmann to remove from the table the bid award for the proposed Hwy 281 to Hwy 6 truck route project. Roll Call: Ayes: Weeks, Curtis, Orthmann, Hynes, Neumann. Nays: Thomsen. Abstaining: Saathoff. Mike Zinella of Werner Construction was available to answer questions regarding the construction of the proposed truck route. The projected completion date of the project would be August, 2014. Motion by Curtis, second by Orthmann to approve the truck route project connecting Hwy 281 to Hwy 6, awarding the project to Werner •Construction. Chairman Neumann requested a verbal roll call. Roll Call; Ayes: Weeks, Curtis, Orthmann, Neumann. Nays: Hynes, Thomsen. Abstaining: Saathoff. Motion by Orthmann, seconded by Curtis to approve the claims and direct the County Clerk to pay out of the respected funds. Nays: None Motion by Curtis, seconded by weeks to accept officers reports from the Register of Deeds and Planning and Zoning offices. E1204076LD COUTHOUSE HASTINGS, NEBRASKA Tuesday, October 15, 2013 The Adams County Board of Supervisors met as a Board of Equalization for the purpose of hearing motor vehicle tax exemption requests, requests to remove penalties assessed for late filing of personal property returns, tax list corrections and appoving 2013 tax year levies with Chairman Neumann presiding. Roll call, ayes: Thomsen, Curtis, Neumann, Hynes, Orthamnn, Saathoff and Weeks. Also present were County Clerk, Ramona Thomas; Assessor, Diane Hynes; Treasurer,Bev Davis; and Deputy Attorney, David Bergin. Motion by Curtis, seconded by Saathoff to move to Board of Equalization to hear penalty protests, tax list corrections, motor vehicle exemptions and set 2013 tax year levies. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neuymann. Nays: None An open meeting of the Adams County Board of Equalization opened at 10:00 a.m. Patricia Burr, with TPB Farms approached the Board requesting that a 15% penalty for failure to file a timely personal property return, be reduced. Adams County Assessor, Diane Hynes was available to answer questions by Ms. Burr as well as the Board. Hynes indicated to the Board that Nebraska State Statute restricts the Board from making any adjustments to a penalty that was assessed correctly. Motion by Saathoff, seconded by Weeks to deny the appeal by TPB Farms for a 15% failure to file penalty for personal property. Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None Assessor Hynes presented the Board with an appeal request from Green Technologies requesting penalty fees for failure to file a timely personal property tax return be removed. No one was present to speak on behalf of Green Technologies. Motion by Saathoff, seconded by Orthmann to deny the appeal from Green Technologies to remove penalties for failure to file timely personal property returns. Roll Call: Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff, Neumann. Nays: None. Adams County Treasurer, Beverly Davis presented the Board with Motor Vehicle Tax Exemption requests for The Good Samaritan Society and Hastings College. Davis has reviewed the request and recommends the Board approve them. Motion by Curtis, seconded by Weeks, to approve the Motor Vehicle Tax Exemption requests from The Good Samaritan Society and Hastings College. Roll Call: Ayes; Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff , Neumann. Nays: None Adams County Clerk, Ramona Thomas, presented the Board with the 2013 tax year levies for Adams County and sub -districts within Adams County. Thomas has sent all the levy amounts to the sub -divisions and has informed them the deadline to make corrections is Tuesday, November 5, 2013.
