E1204076LD COURTHOUSE, ADAMS COUNTY Tuesday, December 3, 2013 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck Neumann presiding. Roll Call members present were: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff and Neumann. Motion by Orthmann, seconded by Weeks, that this is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Neumann, Nays: None. The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Board members attended the following committee meetings since the November 19, 2013 and gave a brief report: Orthmann Curtis Weeks Hynes Saathoff Thomsen - November 19, 2013 attended a CRA Committee Meeting -November 20, 2013 attended a Mid Nebraska Individual Services Meeting in Kearney -November 21, 2013 attended a Nebraska Safety meeting held at Bernardoes -November 21, 2013 attended the Celebration of Lights event in Downtown Hastings - December 3, 2013 attended an Adams County Building and Grounds Committee meeting -November 19, 2013 attended an Adams County Ag Board meeting -November 21, 2013 attended a South Central Economic Development District Board meeting -December 3, 2013 attended an Adams County Road and Bridges Committee Meeting - November 27, 2013 attended the retirement party for Adams County employee Julie Koch at the ACOB - December 3, 2013 attended an Adams County Road and Bridges Committee Meeting - December 3, 2013 attended an Adams County Road and Bridges Committee Meeting - November 19, 2013 attended an ASAAP Board Meeting -November 19, 2013 attended an Adams County Safety Committee Board meeting -November 29, 2013 attended the Drug and Alcohol Task Force - December 2, 2013 attended an Adams County Planning and Zoning Committee meeting - December 3, 2013 attended an Adams County Building and Grounds Committee meeting. Neumann - December 3, 2013 attended an Adams County Building and Grounds Committee meeting - November 19, 2013 attended an Adams County Safety Committee Board meeting During public comment, Leona Anderson with the Retired Teachers Association presented a facsimile check to the board that represents the number of volunteer hours worked by the association. The check represented 28, 863 hours of service. Adams County Deputy Attorney, David Bergin, requested Chairman Neumann's signature on a contract to renew the County's agreement with Northwest Nebraska Juvenile Services. This agreement guarantees placement at the Madison facility. Motion by Thomsen, seconded by Curtis to approve Chairman Neumann signing the Juvenile Services Agreement with Northwest Nebraska Juvenile Services. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Dawn Miller, Adams County Highway Superintendent, requested the Board approve Chairman Neumann's signature certifying Miller as the Adams County Highway Superintendent for January 1 -December 31St, 2013. This certification must be on file with the NDOR in order to receive federal funds. Motion by Weeks, seconded by Orthmann to approve the Chairman's signature verifying Dawn Miller as the Adams County Highway Superintendent for 2013 and having Clerk Thomas file it with the NDOR. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthamann. Nays: None Motion by Saathoff, seconded by Curtis to open an advertised public meeting regarding an Isolated Land Affidavit filed by Maxine Strasburg of 12175 S 1" St; Ayr, NE. The Isolated Land Public Meeting was opened at 10:01 a.m. Deputy Attorney Bergin gave the Board a brief explanation for the reason for the public hearing. Ms. Strasburg owns forty acres of land that she claims is currently inaccessible due to the purchase of adjacent land, owned by Gregg Lay of 611 North Shore Drive; Hastings, NE. Ms. Strasburg was represented by Attorneys Doug Pauley and Josh Johnson. Also present was Ryan Gerloff who rents the isolated land from Strasburg for the purpose of producing hay. Mr. Lay was represented by attorney Art Langvardt. Lay and Langvardt outline the reasoning behind the land being inaccessible and proposed alternative routes to access the land that Stasburg claims is isolated. Motion by Thomsen, seconded by Saathoff to close the public meeting on isolated land. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Motion by Saathoff, seconded by Hynes to table a decision on the isolated land until the February 18, 2014 meeting, to allow for further research of alternate routes and give the parties involved an opportunity to try and come to an agreement. Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Motion by Weeks, seconded by Orthmann to open the public meeting for a conditional use permit for expansion of an existing grain bin facility. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Adams County Planning and Zoning Director, Judy Mignery, advised the Board that the Planning and Zoning Committee did not approve the conditional use permit in question and would recommend tabling the matter until the January 6, 2014 meeting. Motion by Weeks, seconded by Thomsen to table the Public Hearing for a conditional use permit until January 6, 2013. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Motion by Saathoff, seconded by Weeks to resume regular session. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Phil Lorenzen with DA Davidson Associates presented resolution 2013-12-3.01 authorizing issuance of Bond Anticipation Notes, Series 2014A to pay a portion of costs of Rural Road Improvement District No. 2013-1 in the amount of $950,000.00 at .5% interest. The Board confirmed with Dawn Miller that $950,000.00 was an appropriate amount to authorize. Motion by Hynes, seconded by Weeks to approve resolution 2013-12-3.01 authorizing the issuance of Bond Anticipation Notes in the amount of $950,000.00 for a portion of Rural Road Improvement District 2013-1. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Chrys Setlik, Adams County Clerk of the District Court, approached the Board regarding the salaries for elected officials for calendar years 2015-2018. Setlik proposed a 3.6% increase each year to bring the officials up to the NACO recommended minimum salaries for elected officials. Brief discussion took place among the Board members regarding the elected official's salaries. A decision on salaries was differed to the next meeting, giving Board members a chance to contact the elected officials and to get their opinion on salaries. The Board must set the elected official's salaries no later than January 15, 2014 for the 2015-2018 elected term. Motion by Hynes, seconded by Orthmann to approve claims and authorize the clerk to pay out of their respective accounts. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None Motion by Curtis, seconded by Weeks to approve the officer's report submitted by the County Clerk and the Clerk of the District Court..
