HomeMy WebLinkAbout0107 Minutes from January 7, 2014COURTHOUSE, ADAMS COUNTY Tuesday, January 7, 2014 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck Neumann presiding. Roll Call members present were: Weeks, Hynes, Thomsen, Curtis, Orthmann, Saathoff and Neumann. Motion by Hynes, seconded by Weeks, that this is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Weeks, Hynes, Thomsen, Curtis, Orthmann, Neumann, Nays: None. The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any conflicts of interest with any agenda items. Minutes of the previous meeting were approved as circulated. Board members attended the following committee meetings since the December 17, 2013 Board meeting and gave a brief report: Orthmann - December 19, 2013 attended the Christmas lunch at the Register of Deeds Office Curtis - December 19, 2013 attended the Christmas lunch at the Register of Deeds Office Weeks - December 19, 2013 attended the Christmas lunch at the Register of Deeds Office Hynes - The regularly scheduled Road and Bridges Committee meeting was cancelled this morning due to Dawn Miller being ill, however Hynes reported that the redrawing of flood plain boundaries will be taking place in some areas and some residence are upset. Hynes also reported that the Department of Natural Resources will be attending an upcoming meeting. Saathoff - December 19, 2013 —attended a Hastings Chamber Christmas party Thomsen — December 30, 2013 attended an ASAAP Board meeting January 6, 2014 attended an Adams County Planning and Zoning meeting January 7, 2014 attended an Adams County Building and Grounds Committee meeting Neumann - December 19, 2013 attended the Christmas lunch at the Register of Deeds Office January 7, 2014 attended an Adams County Building and Grounds Committee meeting Chairman Neumann asked if there were any comments from the public. No public comments were received. Chairman Neumann announced that the Adams County Board will be reorganizing pending the completion of any old business. Chairman Neumann asked if there was any old business that needs to be addressed. Motion by Orthmann, seconded by Thomsen that the motion passed on December 17, 2013 in regards to the salaries set for elected officials for years 2015-2018 be reconsidered. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Neumann announced that salaries for the elected officials must be set by January 15, 2014. Chairman Neumann requested a motion that this Board be adjourned sine die and to appoint the County Clerk as Board fhairnarcnn Motion by Saathoff, seconded by Weeks to cease nominations and cast a unanimous ballot for Chuck Neumann as the Adams County Board Chairperson. Roll Call: Ayes; Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Abstaining; Neumann Chairman Neumann requested nominations for the Adams County Board Vice chairperson. Weeks nominated Lee Saathoff as Adams County Board Vice Chairperson. Chairman Neumann asked for additional nominations Motion by Weeks, seconded by Hynes that nominations cease and cast a unanimous ballot for Lee Saathoff as the Adams County Board Vice Chairperson. Roll Call: Ayes; Neumann, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Abstaining: Saathoff. Chairman Neumann requested a motion to name the following banks as Adams County depositories: Wells Fargo, Heritage Bank, Hastings State Bank, Adams County Bank, Nebraska Public Agency Investment Trust, Five Points Bank, US Bank, Geneva State Bank and Bank of Doniphan. Motion by Curtis, seconded by Orthmann to approve Wells Fargo, Heritage Bank, Hastings State Bank, Adams County Bank, Nebraska Public Agency Investment Trust, Five Points Bank, US Bank, Geneva State Bank and Bank of Doniphan, as Adams County depositories. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Chairman Neumann requested a motion to authorize the Adams County Treasurer to deposit funds in the following local banks: Wells Fargo, Heritage Bank, Adams County Bank, Nebraska public Agency Investment Trust, Five Points Bank, Bank of Doniphan, US Bank, Geneva State Bank and give consent to the County Treasurer to deposit 100% of capital stock and surplus in any of the depository banks named, and said deposits to be protected by bonds and securities as required by law. Chairman Neumann requested a motion to designated the Hastings Tribune as the legal newspaper for Adams County and the Adams County website www.adamscountv.org, as approved methods for the publication of notices of meetings, public bids, County Board agendas and County Board minutes. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Weeks addressed the Chairman with a concern that the request for a motion to authorize the Adams County Treasurer to deposit funds in the following local banks: Wells Fargo, Heritage Bank, Adams County Bank, Nebraska public Agency Investment Trust, Five Points Bank, Bank of Doniphan, US Bank, Geneva State Bank was not fulfilled. Motion by Weeks, seconded by Saathoff to authorize the County Treasurer to deposit funds in the following local banks: Wells Fargo, Heritage Bank, Adams County Bank, Nebraska public Agency Investment Trust, Five Points Bank, Bank of Doniphan, US Bank, Geneva State Bank. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Chairman Neumann announced the reorganization was complete and the Board will proceed with new business. Dan Rutt with Horizon Recovery addressed the Board with a funding request for the Horizon Recovery Program. Rutt had brought two juveniles who are currently in the program. Macy Cooper and Larry Orlen spoke of the struggle with additions and how Horizon has helped them. Board members asked the youths several questions ranging from, how they became addicted, what they were addicted to and suggestions they have on how to keep kids from substance abuse. Dave Rippe with the Hastings Economic Development Corporation (HEDC) requested the approval of incremental annexation releases for PMP LLC (2nd increment), Central Logistic Services Inc. (5th —final increment), and Centennial Plastics (3rd — increment). Rippe answered questions by the Board regarding the process where properties are annexed in increments. Motion by Weeks, seconded by Saathoff to approve incremental annexation releases for PMP LLC (2nd increment), Central Logistic Services Inc. The chairman announced the continuation of the Public Hearing that was opened on December 3, 2013 regarding case #13- 12.3; a conditional use permit for the expansion of an existing grain bin facility. Applicants are Duane and Russell Ochsner, 7860 S. Liberty Ave, in Roseland. Adams County Planning and Zoning Director, Judy Mignery, reviewed the case with the Board. Russell Ochsner was present to answer the Board's questions. Ochsner would like to take down one grain bin that was erected in the early 1950's and replace it with a new larger grain bin. Mignery advised that all concerns the Planning and Zoning Committee had have been satisfied and is now requesting the County Board's approval. Motion by Weeks, seconded by Saathoff to approve the conditional use permit filed by Russell and Duane Ochsner for the expansion of an existing grain bin facility, Case #13-12.3. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. At 10:35 a.m. Chairman Neumann requested a motion to open the Public Hearing for a conditional use permit for a contractor storage yard in a multi -use district, case # 14-01.1. Motion by Orthmann, seconded by Curtis to open the Public hearing on case # 14-01.1. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Mignery presented the Board with Case #14-01.1, a Conditional Use Permit , by applicants Jeff Wissing and Tom Quinn. The applicants would like to build a building for his construction business in Lot 1 of West Fork North 2nd Subdivision. Mignery confirmed the Adams County Zoning Regulations adopted in 2010 will allow this use with a Conditional Use Permit. Motion by Thomsen, seconded by Saathoff to approve the Conditional Use Permit, Case # 14-01.1 by applicants Jeff Wissing and Tom Quinn.. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Clerk Thomas informed the Board of a request made by Julie Koch to rent the assembly room at the ACOB on January 31, 2014 for a scrapbooking event. The applicant is aware of the $25.00 fee for the rental. Motion by Orthmann, seconded by Curtis to approve the rental request made by Julie Koch. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Motion by Weeks, seconded by Curtis to close the public hearing for case # 14.01.1. Chairman Neumann advised the Board members that Judy Reimer's term on the South Heartland District Health Department Board is up, Reimer would like to serve another term. Motion by Hynes, seconded by Weeks to appoint Judy Reimer to the South Heartland District Health Department Board. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Fegler-Diass had checked with counties comparable to Adams County in regards to property valuations and population. Most counties Fegler-Diass checked with currently have the position of County Attorney paying $85,000.00. Fegler-Diass noted that Adams County has a larger criminal case load than the counties she had researched. Motion by Saathoff, seconded by Weeks to set the salaries for the offices of; County Clerk, County Assessor, County Treasurer, Clerk of the District Court and the Adams County Register of Deeds at $57,000.00 for 2015, $59,280 for 2016, $60,500.00 for 2017 and $62,950.00 for 2018. Salary for the office of the Adams County Attorney would be $80,000.00 for 2015, $82,700.00 for 2016, $84,767.00 for 2017 and $62,950.00 for 2018. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Brief discussion took place regarding the salary for the Adams County Sheriff. It was clarified that the current Adams County Sheriff, Gregg Magee resides in the Courthouse resulting in the living expenses of the sheriff are included. Chairman Neumann clarified with County Attorney Fegler-Diass that residing in the Courthouse is not a requirement of the County Sheriff position, and that should a new sheriff be elected, residing in the Courthouse would not be mandatory nor would the County have to compensate the individual if they do not reside in the Courthouse. Motion by Saathoff, seconded by Weeks to set the salary of the Adams County Sheriff at $68,000.00 for 2015, $69,500.00 for 2016, $71,000.00 for 2017 and $72,500.00 for 2018 and the salary for the County Surveyor at $4,500.00 for 2015, $4,600.00 for 2016, $4,800.00 for 2017 and $4,950.00 for 2018. Discussion occurred regarding the salary for the County Surveyor. Neumann reminded the Board that the County Surveyor is an elected position therefore they receive full benefits even though their services are on an on call basis only. The County Surveyor is also allowed to be employed by a private surveying firm. Saathoff amended his previous motion and made a motion to set the salary of the Adams County Sheriff at $68,000.00 for 2015, $69,500.00 for 2016, $71,000.00 for 2017 and $72,500.00 for 2018 and the salary for the County Surveyor at $4,500.00 per year for 2015-2018. Weeks seconded the amended motion.. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays: None. Discussion took place regarding the salaries of the Adams County Supervisors. Thomsen stated he would like to see the salary of the Supervisors increase as the duties extend far beyond two meetings a month. An increased salary could also increase interest for others to run for the Supervisor positions. Neumann suggested the salaries of $17,500.00; $18,250.00; $19,000.00; and $20,000.00 for years 2015-2018 respectively. Members of the Board inquired the possibility of adjusting the salary in two years when new Board members would be taking office. Clerk Thomas stated that salaries could be adjusted when new members of the Board started their term, and salaries could be adjusted as they were in 2012. Motion by Thomsen, seconded by Orthmann to set the salaries of the Adams County Board of Supervisors at $17,900.00 for 2015; and $20,000.00 per year for the remaining years of 2016, 2017 and 2018. Clerk Thomas stated that on previous salary resolutions the Board set a salary for an elected official that was appointed to prepare the County Budget. Thomas said currently the budget is prepared by Chris Lewis who is no longer an elected official, however should an elected official every take over those duties a salary should be set.
