HomeMy WebLinkAbout0304 Minutes from March 4, 2014239 COURTHOUSE, ADAMS COUNTY Tuesday, March 4, 2014 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Chuck Neumann presiding. Roll Call members present were: Weeks, Thomsen, Hynes, Orthmann, Saathoff and Neumann. Motion by Weeks, seconded by Orthmann, that this is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's office. Roll call; Ayes: Weeks, Curtis, Hynes, Orthmann, Neumann, Nays: None. Absent/Not Voting: Thomsen The Chairman announced the locations of the open meetings law and agenda in the room and also asked if there were any conflicts of interest with any agenda items. Board member Thomsen joined the meeting Minutes of the previous meeting were approved as circulated. Jason Ackles from the Adams County Sheriff's Department was the speaker. March 3, 2014 attended a planning and zoning meeting March 4, 2014 attended an Adams County Building and Grounds Committee meeting and advised that the construction of the Verizon maintenance shed is running behind schedule due to the weather February 18, 2014 attended the United Way luncheon. February 19, 2014 attended an Adams County Wellness Committee meeting February 23, 2014 attended a fundraiser at the Prairie Loft Center February 25, 2014, attended an informational insurance meeting at the Adams County Roads Department March 3, 2014 attended the Adams County tax sale March 4, 2014 attended an Adams County Building and Grounds Committee meeting During public comment, Gary Shurigar of11665 W Oregon Trail Rd in Roseland, addressed the Board with an issue regarding the ownership of 1 % acres of land near his property. Shurigar states that Adams County had purchased land from his father in 1968, the land was then sold back to Shurigar's family but the wrong property description was placed on the Deed. Shurigar was spoken with the Adams County Assessor, Register of Deeds and County Surveyor and cannot seem to resolve this issue. Deputy Attorney took down Mr. Shurigar's information and will research the matter. Chairman Neumann recognized Greg Anderson and Dennis Zarek with the Adams County Roads Department. Anderson has worked for the Adams County Roads Department for 36 years, and Zarek 35. Both employees were honored with a certificate of recognition and an Eileen's Cookie. Susan Ferrone form the South Heartland District Health Department addressed the Board regarding National Colorectal Cancer Awareness Month and made colorectal cancer testing kits available to all Adams County employees. Chairman Neumann requested a motion to open the Public Hearing for a conditional use permit in the mixed use district. Motion by Weeks, seconded by Curtis to open the Public Hearing for a conditional use permit in the mixed use district. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays; None. Public Hearing on a conditional use permit in the mixed use district was opened at 10:02 a.m. Judy Mignery, Adams County Planning and Zoning Director, advised that the Adams County Planning and Zoning Committee tabled a decision on the conditional use permit, therefore advised that the Adams County Board of Supervisors continue this Public Hearing until March 18`h Motion by Saathoff, seconded by Orthmann to table the matter of a conditional use permit in the mixed use district. Mignery requested that her next item on the agenda, approval of the Beeson Subdivision, be differed until the March 18th meeting as Mr. Beeson did not attend the Adams County Planning and Zoning meeting. Mignery presented case number 14-03.3, Prairie Lake Subdivision on behalf of applicants Ron and Kathy Skrdla or 10955 W Prairie Lake Rd. in Juniata. The applicant would like to subdivide 3.11 acres in the NE'/, Section 34, T7N, R11W. The proposed 241 Miller also requested the Board's approval of an agreement and resolution 2014-03-04.01 between Adams County and the Nebraska Department of Roads for the 2014 Fracture Critical Bridge Inspections. Motion by Weeks, seconded by Curtis to approve the signing of the agreement and resolution between Adams County and the NDOR for the 2014 Fracture Critical Bridge Inspection. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays; None. Diane Jones, owner of Bonnavilla Mobile Home Park in Hastings, addressed the Board with concerns she has on abandoned trailers within her complex that have an excessive amount of unpaid taxes on them. Often times more is owed in taxes than what the trailer is worth. As a result, there are no bidders on the properties on a tax sale and Jones is left being unable to dispose of the property because the taxes remain unpaid. Ms. Jones has spoken to both the Adams County Treasurer and the Sheriff's Department regarding this problem. Deputy Attorney, Bergin outlined the distress warrant procedure on such properties. After several minutes of discussion, Bergin advised that he will look into the issue further and see if he can find a possible solution to the issue. Bob Parker with Central Nebraska Collections provided the Board with an update on the Board's inquiry of utilizing Central Nebraska Collections for the collection on unpaid taxes. Parker has met with Treasurer Davis and Deputy Attorney Bergin, currently they are researching if the County can legally turn over the collection of unpaid taxes to a collection agency and will update the Board at a later date. Mr. Parker also addressed the Board on the issue of courthouse security. Mr. Parker used area counties as an example of what he would like to see implemented in Adams County. Deputy attorney Bergin requested the Board approve resolution 2014-02-18.01 that allows for the striking of uncollected distress warrants. This resolution was presented to the Board during the February 18, 2014 regular meeting, the Board differed a decision on signing the resolution until more research could be done on some of the large amounts of unpaid taxes. Bergin confirmed that the unpaid taxes in question were due to a bankruptcy and therefore will not be able to be collected. Motion by Saathoff, seconded by Orthmann to approve the signing of resolution 2014-02-18.01 for the striking of distress warrants in the total amount of $68,325.74 for years 1990-2010. Roll Call: Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays; None. Bergin also presented to the Board and addendum to the Central Nebraska Drug Court Interlocal Agreement. Currently the agreement includes the counties of Adams, Buffalo, Hall and Phelps. The addendum will allow for the inclusion of Kearney County. Motion by Saathoff, seconded by Weeks to approve the addendum to the Interlocal Drug Court Agreement to include Kearney County as a participant. Roll Call: : Ayes: Neumann, Saathoff, Weeks, Hynes, Thomsen, Curtis, Orthmann. Nays; None. Motion by Weeks, seconded by Hynes to meet as an Adams County Cemetery Board. Witte Deputy Clerk COURTHOUSE, ADAMS COUNTY Tuesday, March 4, 2014 245 The Adams County Board of Supervisors met as an Adams County Cemetery Board on March 4, 2014 with Chairman Neumann presiding. Present, were Board members Neumann, Orthmann, Curtis, Weeks, Hynes, Saathoff and Thomsen, Deputy County Attorney Bergin and County Clerk Thomas. Chairman Neumann opened for discussion the maintenance of the County owned cemeteries. Board members had little discussion as maintenance concerns were minimal. Motion by Thomsen, seconded by Orthmann to continue hiring Patty's Lawn service as the mowing provider for the County owned cemeteries.
