Roll Call members present: Thomsen, Curtis, Neumann, Orthmann, Saathoff, and Weeks. Absent: Hynes Motion by Orthmann and seconded by Weeks that this is a meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An Agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's Office. Roll call, Ayes: Thomsen, Curtis, Neumann, Orthmann, Saathoff, and Weeks, Nays: None, Absent: Hynes The Chairman announced the locations of the open meetings law and agenda in the room and asked if there were any conflicts of interest with any agenda items Minutes of the previous meeting were approved as circulated. Board members attended the following events and committee meetings and gave a brief report: Orthmann- July 7, 2014 attended an emergency services meeting with Chip Volcek July 8, 2014 attended a Veterans Services meeting July 9, 2014 attended an Adams County Personnel Committee meeting July 15, 2014 attended a Business Improvement District meeting Curtis- Weeks - July 3, 2014 attended an Adams County Extension Board meeting July 8, 2014 attended an Ag Board meeting July 9, 2014 attended an Adams County Personnel Committee meeting July 9, 2014 a meeting with Roads Department regarding a truck route project update July 10, 2014 attended a Roads Department budget meeting July 15, 2014 attended an Adams County Road and Bridges Committee meeting Saathoff- July 9, 2014 attended an Adams County Personnel Committee meeting July 10, 2014 attended a Roads Department budget meeting July 15, 2014 attended an Adams County Road and Bridges Committee meeting Thomsen- July 7, 2014 attended and Adams County Planning and Zoning meeting July 8, 2014 attended an ASAAP Board meeting July 15, 2014 met with the Adams County Sheriff and Ideal Electric regarding upgrades to the jail July 15, 2014, attended an Adams County Safety Committee meeting Neumann- July 7, 2014 attended an emergency services meeting with Chip Volcek July 9, 2014, attended an Adams County Wellness Committee meeting July 15, 2014, attended an Adams County Safety Committee meeting Chairman Neumann opened the meeting for public comment. Lee Hogan with the Adams County Fair Committee, approached the Board regarding the upcoming Adams County Fair as well as plans for the future of the Adams County Fairgrounds. Hogan stated that Adams County Fairgrounds Manager, Sandy Himmelberg will be presenting Adams County with their budget once the fair has concluded. Judy Mignery approached the board on behalf of the Wellness Committee to provide an update to the recent Adams County Health Fair, Mignery reported that participation was just a few employees short of 100%. There were no additional public comments Brad Stark, residence 460 W Prairie Lake Road, approached the Board regarding an ongoing issue with water drainage on his property. In 1999 a culvert was placed on his property the culvert makes a right angle towards the driveway causing water to accumulate. Stark stated that relocated the culvert may solve the issue. Chairman Neumann inquired if Stark would be open in sharing the cost of correcting the problem, Stark said he was open to discussion however was reluctant to agree to cost sharing. The Board, and Roads Superintendent Dawn Miller will continue discussion with Stark to come to a solution. Diane Johnson of 230 East 2nd Street in Hastings, approached the Board with similar issues as Stark's regarding water drainage as well as other issues that she feels are affecting the valuation of her property. Chairman Neumann advised Ms. Johnson that because she lives within city limits, she should contact her Hastings City Council Representative. Planning and Zoning Director Judy Mignery stated that the scheduled Public Hearing on the Hoffman Rezoning request will not be heard and the Public Hearing will be rescheduled and advertised for a later date. Motion by Weeks, seconded by Orthmann to open the Public Hearing for a conditional use permit for commercial grain storage in an agricultural district. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Mignery read case #12-09.3 into the record. A conditional use permit for the grain storage was approved in August 2012 with the condition of it expiring in two years, therefore the owners, James and Danece Meyer, would like to reapply for the permit. Motion by Weeks, seconded by Orthmann to close the Public Hearing for case #12-09.3. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Motion by Thomsen, seconded by Saathoff to approve case #12-09.3 for grain storage in an agriculture district. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes The Public Hearing for case #14-06.4, opened on June 24, 2014 was resumed. Case #14-06.4 is a request for a Conditional Use Permit for a Recreational Facility and Warehouse in the Mixed Use District. The applicant would like to place a recreational facility and warehouse storage building on the property. Discussion to place regarding the type of recreation to take place. Mignery informed the Board that it is used on occasion for archery clubs and there are plans for events to be held at the facility. Thomsen suggested the restriction of no outside archery, Curtis questioned if a crossbow was considered a firearm, which is already restricted in the permit. Motion by Orthmann, seconded by Curtis to close the Public Hearing on Case #14-06.4 — Conditional Use Permit for a Recreational Facility and Warehouse in the Mixed Use District.. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Motion by Thomsen, seconded by Weeks to approve Case # 14-06.4 — Conditional Use Permit for a Recreational Facility and Warehouse in the Mixed Use District, based on recommendations made. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Mignery presented the Board with plans for the West Fork North 5th Subdivision, Case #14-06.3 that would allow the applicant, Rodney Brunt, to subdivide 2.30 acres in the E 1/2 NE 1/4 Section 12, T8N, R10W, lying in the Mixed Use District for a recreational facility and warehouse. Motion by Saathoff, seconded by Thomsen to approve Case #14-06.3 for the West Fork North 5th Subdivision. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Mignery presented the Board with Case #14-07.1 for the Hawthorne Subdivision by applicant Elmo D Hawthorn Family Trust and Margaret A Hawthorne Revocable Trust and Heritage Bank, trustee. The applicant would like to subdivide 8.00 acres in the NW 1/4 SW' Section 13, T8N, R9W. Lucinda Glenn, with Seiler and Parker Law Firm was representing the family and available to answer questions from the Board. Motion by Saathoff, seconded by Curtis to approve Case #14-07.1 for the Hawthorne Subdivision. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Mignery presented the Board with Case #14-07.2 for the Heritage Subdivision. The applicant would like to subdivide 4.05 acres in the SW 1/4 SE 1/4 section 12, T7N, R9W. Motion by Saathoff, seconded by Thomsen to approve Case #14-07.2 for the Heritage Subdivision. Roll Call: Ayes: Neumann, Saathoff, Weeks, Thomsen, Curtis and Orthmann. Nays: None: Absent: Hynes Mignery presented the Board with the Board of Supervisors budget for the 2014/2015 fiscal year. The total budget for the Board of Supervisors proposed by Mignery was $230,638.00 with the only increases being for salaries and insurance premiums. Motion by Weeks, seconded by Orthmann to meet as a Board of Equalization for the purpose of a Motor Vehicle Exemption from Hastings Catholic Schools. Bever is requesting $2,300.00 on behalf of the SHDHD for the immunization clinic. The budget request will be considered at a later date. Phil Lorenzen with DA Davidsion, requested approval on financing notes for Project C1-450, 2013-1 Rural Road Improvement District as well as approval of an Underwriting Engagement Letter allowing Lorenzen to provide advisement. Smith had presented her budget during the July 1'2014 meeting, however realized she needed to adjust the figures to compensate for the former Director's salary payout. The revised about requested by the Adams County Visitor's Bureau is $239,000.00. Probation Director, Joseph Budnick, presented the Board with the 2014/2015 Probation budget. The total budget request for the probation office is $63,667.00 and juvenile budget request is $5,148.00. County Court Clerk Magistrate, Tom Hawes, presented the budget request for the Adams County Court. The total budget request is $297,125.00 for the 2014/2015 fiscal year. Hawes also informed the Board of the desire to replace the carpet in the County Court area however this would be out of the courthouse maintenance budget. Adams County Register of Deeds, Jan Johnson presented the budgets for the Register of Deeds Office, $224,782.00; the Micofilm Budget, $16,078.00; the Register of Deeds Preservation Budget, $47,100.00 and the Communications budget, $73,500.00. Adams County Extension Director, Ron Seymour, presented the 2014/2015 budget request for the Adams County Extension Office. Seymour presented two budget proposals. Proposal one at $175,671.00 would allow for an additional full time employee to oversee the school enrichment program, while proposal two at $157,639.00 would allow for a part time position. Adams County Treasurer, Bev Davis presented the 2014/2015 budget for the Adams County Treasurer's office in the amount of $513,388.00. The greatest adjustments being in the personnel lines. Adams County Emergency Management Director, Chip Volcek, presented the budget request for the Emergency Management Office in the amount of $149,816.82, this reflects a 2.10% increase of the previous year's budget. Adams County Attorney, Donna Fegler-Diass presented the 2014/2015 budget for the Adams County Attorney's office. The 2014/2015 budget request is $907,373.00 for the County Attorney's Office and $26,000.00 for the Adams County Law Library. Adams County Public Defender, Mike Mead, presented the Board with the budget for the Public Defender's office for the 2014/2015 fiscal year in the amount of $645,723.00. Adams County Sheriff, Gregg Magee presented the Board with the 2014/2015 budgets for the Adams County Sheriff's Department and the Adams County Jail. The budget request for the Sheriff's Department was $1,843,210.00 and the jail budget was $2,198,784.00. All budget determinations on budget request will be considered pending future budget discussions.
