HomeMy WebLinkAbout0519 Minutes from May 19, 2015COURTHOUSE, ADAMS COUNTY Tuesday, May 19, 2015 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman Neumann presiding. Roll Call members present: Michael Stromer — District 1; Jennifer Czekai- District 2; Mike Weeks — District 3; Scott Thomsen — District 4; Dale Curtis — District 5; Chuck Neumann — District 6; Eldon Orthmann — District 7 Motion by Weeks, seconded by Orthmann that this is a meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An Agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk's Office. Roll call, Ayes: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None The Chairman announced the locations of the open meetings law and agenda in the room and asked if there were any conflicts of interest with any agenda items Minutes of the previous meeting were approved as circulated. Board members attended the following events and committee meetings and gave a brief report: Thomsen- May 4, 2015- Attended an Adams County Security Committee Meeting May 12, 2015 attended an ASAAP Board meeting Thomsen gave an update from the Building and Grounds Committee on the status of some remodeling and relocating projects. The area in the ACOB Building for the mental hearings is ready for carpet and the new area for the Public Defender's office in the Annex basement is ready for carpet and new doors. Stromer- May 14, 2015- Czekai- May 7, 2015 - May 12, 2015 - May 13, 2015 - May 14, 2015 - May 19. 2015- Weeks- May 16, 2015 - May 19, 2015- Curtis- May 7, 2015- 0rthmann- May 12, 2015 - May 18, 2015 - Attended a NACO Board of Equalization workshop in Kearney Attended an Extension Board meeting and reported the Extension Office has completed their move to their temporary location in the Foote Building. Also discussed at the meeting was new UNL Programs. Attended an Ag Society meeting where fair and rodeo preparations Were discussed Met with Amy Hafer with the Hastings Public Library; Hafer will make a budget request later in the meeting Attended a NACO Board of Equalization workshop in Kearney Attended an Adams County Road and Bridges meeting Attended "Coffee with the Senator" event at Kitty's Roadhouse Attended an Adams County Road and Bridges meeting Attended an Extension Board meeting and advised that the Extension Board may be over budget due costs associated with their phone System Attended an Ag Society meeting where fair and rodeo preparations Were discussed Attended the Drug Court graduation in Hastings. Each County now hosts its own graduation and Adams County graduated five people May 7, 2015- Attended a Midland Area Agency on Aging Board meeting May 13, 2015- Attended an Adams County Senior Services Board meeting where auditor costs and the budget was discussed. Orthmann (cont.) May 16, 2015 -Attended "Coffee with the Senator" event at Kitty's Roadhouse May 18, 2015- Attended an Adams County Security Committee meeting in the morning And an RSVP Board meeting in the evening May 19, 2015- Attended a BID Board meeting Neumann- May 6, 2015- Attended a South Heartland District Health Department meeting in Superior. May 7, 2015- Attended a Midland Area Agency on Aging Board meeting May 16, 2015- Attended "Coffee with the Senator" event at Kitty's Roadhouse where Neumann inquired about the gas tax and the possibility of having all mail in elections in the future. May 18, 2015- Attended an Adams County Wellness meeting Neumann also stated that he visited the town of Roseland the day after an F1 tornado damaged the east side of town. Neumann thanked Adams County Highway Superintendent, Dawn Miller and her staff as well as Emergency Manager Chip Volcek for their efforts with the clean up of the damaged area. Chairman Neumann opened the meeting for Public Comment. Wellness Committee member, Judy Mignery announced proposed dates for the Adams County Health Fair. The dates being considered are June 9th 10th and 11th. Mignery will also be looking into the possibility of having Mary Lanning do the blood draw. Clerk Magistrate, Tom Hawes spoke during Public Comment. Hawes requested guidance from the Board on how to budget for office furniture for a new judge did that judge should be based out of Adams County. The Board advised that Hawes could Escrow funds if the project takes place with in the next month, or he could increase his budget request for the following year. Adams County Highway Superintendent, Dawn Miller gave the Board an updated on LB610 and the potential revenue it would generate for the County. Public Comment Closed Motion by Orthmann, seconded by Curtis to open the Public Hearing for the proposed issuance of Hospital Revenue and Refunding Bonds. Nays: None Public Hearing Closed at 10:08 Motion by Thomsen, seconded by Weeks to approve the signing of Resolution 2015-05-19.02 for the proposed issuance of the Hospital Authority 1 Revenue and Refunding Bonds. Nays: None Motion by Orthmann, seconded by Curtis to meet as a Board of Equalization to hear motor vehicle exemption requests and tax list corrections. Nays: None Entered Board of Equalization at 10:03 a.m. Motion by Weeks, seconded by Czekai to close the Board Equalization and resume regular session. Nays: None Motion Orthmann, seconded by Curtis to approve the claims and direct the County Clerk to pay them out of their respective accounts. Nays: None Adams County Emergency Manager, Chip Volcek, provided the Board a detailed report on the tornado that went through the Village of Roseland earlier this week. Motion by Curtis, seconded by Czekai to open the Public Hearing regarding the vacating of Overland Road North of 94th Street to Barrows Road. Roll Call: Ayes: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None Public Meeting opened at 10:23 a.m. The chairman opened the meeting for those wishing to speak for or against the closure of Overland Road from 94th St to Barrows Rd. Adams County Resident Claire McCloud spoke in favor of closing the road. McCloud owns land west of the road and uses it to haul grain. McCloud is willing to put a gate and lock restricting access to the road. Adams County Resident Brad Augustine spoke regarding the potential closure. Augustine is not opposed to the closure however did voice concerns of the culvert and who would incur the cost of maintaining it if it was not removed. Dawn Miller addressed Augustine's concerns; the removal of the culvert would be considered an improvement and the County is not allowed to improve a road that has been abandoned. The County could be hired by the landowners. Deputy Attorney David Bergin will do further research on the removal of the culverts. Adams County Resident, Ken Ossler inquired why this could not be reclassified as a minimum maintenance road. Motion by Curtis, seconded by Czekai to close the Public Hearing on the Overland Road Closure. Roll Call: Ayes: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None Action on the road closure was differed to a later date, as Dawn Miller will be notifying the Township of the possibility of the Township claiming the road. The Townships will have until September to inform the County of their decision. Motion by Cutis, seconded by Weeks to approve 2015 gravel and maintenance agreements with Adams County Townships. Roll Call: Ayes: Stromer, Weeks, Czekai, Thomsen, Curtis, Neumann, Orthmann. Nays: None Dawn Miller presented the Board with an agreement received by the Nebraska Department of Roads for the 2015 Bridge Inspection agreement. Miller suggested taking no action at this time as she feels the agreement would mean that Adams County would incur 20% of the cost if federal funds are obtained by the NDOR. No action was taken no the 2015 Bridge Inspection Agreement. Thomsen exited meeting at 10:54 a.m. CASA representative, RuAnn Root presented the CASA budget request for the 2015-2016 fiscal year. Root is requesting an amount of $35,000. A decision on the funding request for CASA will be considered during future budget hearings Thomsen returned to the meeting at 10:54 a.m. Hastings Public Library director, Amy Hafer presented the Board with the Library's budget request of $151,732.00 for the 2015-2016 fiscal year. A decision on the budget request for the Hasting Public Library will be considered at future budget hearings. Board member Thomsen and Deputy County Attorney Bergin presented the Board with resolution 2015- 05-19.02 that would restrict weapons in county owned buildings. Nays: None RF[SOLUTtON TO PROHIBIT THE CARRYING OF CONCEALED HANDGUNS AND OTHER CONCEALED WEAPONS OR ANY KIND OF FIREARMS OR EXPLOSIVES IN 'HIE ADAMS COUNTY OFFICE BUILDING, THE ADAMS COUNTY ANNEX BUILDING, AND ANY FACILITIES UNDER THE CONTROL OF THE ADAMS COUNTY DEPARTMENT OF ROADS Adams County Resolution No. WI IEREAS, the Adams County Board of Supervisors has the ownership and control over the Adams County Office Building, the Adams County Annex Building, and any facilities under the control of the Adams County Department of Roads; and WI IEREAS, the Adams County Board of Supervisors wishes to provide it safe working place for its employees and a safe arca Ibr the general public to conduct its business; and WHEREAS, the statutes of 1110 State of Nebraska, specifically Nebraska Revised Statutes 69- 2441 (I ) (a), mini( the Board of Supervisors to prohibit the carrying of concealed handguns in buildings undo[ its control, and the criminal laws of the State of Nebraska prohibit the carrying of concealed weapons; and WHEREAS, pursuant to Bergman r. Schahlnndcr, 85 Neb. 251, 122 N.W. 990 (1909), the county board may exercise "such powers as are requisite to enable them to discharge the official duties devolved upon them by law"; and WHEREAS, the Adams County Board of Supervisors wishes to protect its citizens and its employees; THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ADAMS COUNTY, NEBRASKA that: I. The Adams County Board of Supervisors hereby prohibits the carrying of concealed handguns, other concealed weapons, and any other firearms or explosives in the Adams County Office Building. 2. The Adams County Board of Supervisors hereby prohibits 1110 carrying of concealed handguns, other concealed weapons, and any other firearms or explosives in the Adams County Annex Building. 3. The Adams County Board of Supervisors hereby prohibits the carrying of concealed handguns, other concealed weapons, and any other firearms or explosives in any facilities under the control of the Adams County Department of Roads, except that this prohibition shall not apply to employees of the Adams County Department of Roads acting within the scope of their employment. 4. The Adams County Board of Supervisors hereby reaffirms that the carrying of concealed handguns and other concealed weapons in the Adams County Courthouse is prohibited by the laws of the State of Nebraska. In addition, the Adams County Board of Supervisors hereby prohibit the carrying of any other firearm or explosive in the Adams County Courthouse. 5. The Adams County Board of Supervisors hereby declares that the prohibition outlined in this resolution shall not apply to law enforcement officers on duty or acting in the performance of their duty, or security officers employed by Adams County on duty or acting in the performance of their duty. 6. The Adams County Board of Supervisors hereby directs County employees to immediately place appropriate signs which provide notice of the prohibition outlined in this resolution on the doors of, and in other appropriate locations, on or in the Adams County Office Building and the Adams County Annex Building. Because they notified our office within the 30 days necessary of the federally amended return, we are able to adjust our personal property schedule to match the federal for the 2014 year. The amended return's total taxable amount includes 3 seperate Adams County schedules and only one schedule is affected by the amendment as described above. *The two items with astericks in each picture are the adjusted items on the schedule.
