A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann was
presiding. Roll call members present: Michael Stromer—District 1, Mike Weeks- District 2, Lee Hogan- District 3,
Scott Thomsen—District 4, Dale Curtis-District 5,Chuck Neumann—District 6, Eldon Orthmann—District 7
Motion by Weeks, seconded by Curtis that this is an open public meeting of the Adams County Board of
Supervisors. Roll Call;Ayes:Stromer,Weeks,Thomsen, Hogan,Curtis, Neumann, Orthmann. Nays: None
Orthmann stated that minutes from the June 28, 2016 meeting have been circulated and will stand approved
unless there is a correction.
No corrections were suggested
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An agenda
was available to the board members and was kept continuously current and posted in the County Clerk's office,
the main courthouse lobby and the Adams County website.The following is the agenda of items to be heard, no
modifications were made to the agenda after 9:30 a.m.the business day prior to this meeting.

Jerrad Fullerton with the USDA Wildlife Association presented the Board with a current agreement between
Adams County and the USDA Wildlife department for animal control services. Fullerton stated the new
contracted rate would be$9885.54.
Action on the proposed contract presented by Fullerton will be considered during the July 19,2016 regular
board meeting.
CASA director, RuAnn Root presented the board with a budget request of$36,000.00.
Action on Root's CASA funding request was deferred to later budget hearings.

Enclosed please find the new Subgrant Agreement between the County and the Nebraska
Department of Health and Human Services(DI-IHS)Child Support Enforcement(CSE)Program.
The purpose of this agreement is to account for the work of the Clerk of the District Court as it
relates to Child Support Enforcement. This agreement also offers the mechanism for DIJIIS to
provide reimbursement to the County for child support related work, The enclosed Subgrant
Agreement is effective from October 1,2016 until September 30,2017. Please note this agreement
now contains two(2)one(1)year extensions(Section I,A.TERM,)
Also included with the Agreement is the Subrecipient Information and Audit Requirement
Certification(Attachment 1)and the FFATA Data Reporting Worksheet(Attachment 2). These
forms have been partially completed based upon the information submitted in previous years,
Please review,verify and complete the information on these forms and return them with the signed
Subgrant Agreement. Failure to provide all of the necessary information requested on these forms
may result in a delay of any reimbursement requests.

INTERLOCAL AGREEMENT
THIS INTERLOCAL AGREEMENT made and entered into by and between
ADAMS COUNTY, NEBRASKA, a Political Subdivision of the State of Nebraska,
hereinafter referred to as "County" and the CITY OF HASTINGS, NEBRASKA, a
Nebraska Municipal Corporation, hereinafter referred to as "City", WITNESSETH:
WHEREAS, County and City currently jointly finance the operations of the
Hastings Public Library (Library); and
WHEREAS,as a result of this joint financing of the Library's operations, all Adams
County residents residing outside the corporate limits of City are granted access to the
Library and the Library's services;
NOW, therefore, in consideration of the foregoing recitals and the terms and
conditions hereinafter set forth, the parties hereby jointly and mutually agree as follows:
1. All property taxes from the area of Adams County outside of the city limits of
the City of Hastings collected by the County from the Adams County Library Levy
conunencing for Fiscal Year 2016-17 shall be transferred by County to City. As a result of
said transfer by County, City shall be responsible for the funding of Library operations and
the operation, maintenance, and replacement of the Bookmobile.
2. The term of this agreement shall be open ended,however either the City or the
County may make a request for reconsideration of the terms hereof by giving a six (6)
months written notice to the other party. The parties shall review this Interlocal Agreement
each year through the City/County Combined Services Committee prior to the adoption of
the County's annual budget, so that any changes take effect on October 1 in order for City
to adequately provide for the continued operation of the Library. As part of the annual
review,the Library Director shall provide the Committee with the latest utilization numbers
as part of an annual report of activity.
3. As provided in Paragraph 1. Above, County currently collects a separate
County Library tax pursuant to Neb. Rev. Stat. §51-201 to be utilized for Library support
and funding for County residents residing outside the city limits of the City. In
consideration of the annual payment as provided in Paragraph 1. above, the City shall
provide all regular library services to all residents of Adams County, including the
Bookmobile, at no additional charge. The Library may charge for some special events or
services, but the charge shall be applicable to all patrons and not differentiate between
residents of the City and residents of the County.
4. The funds transferred by County to City as provided herein shall be used by
City exclusively for the operation of the Library and the operation of Bookmobile services.
Transfer payments will be made by County on a monthly basis to the City Treasurer. The
County's current collection of the County Library levy is $ 167,732, based upon the 2015-
2016 budget levy. This amount shall be the base amount for subsequent fiscal years during
the term of this Interlocal Agreement. The County shall not transfer less than the base

amount to City annually in any subsequent fiscal year. The base amount may be adjusted
for inflation each year by the City/County Combined Services Committee prior to the
adoption of both the City and County's annual budget. In no event shall the inflationary
adjustment exceed three and one-half percent(3.5%)for any subsequent fiscal year.
5. The County Board shall appoint a resident of the county lying outside the
corporate limits of the City of Hastings as a non-voting liaison member to the City's
Library Board. Said Library Board liaison to serve a two(2)year term.
6. In addition, County shall maintain its current Bookmobile Sinking Fund
balance as of start of its 2015-16 Fiscal Year. All new funds collected by the County for
the Bookmobile Sinking Fund in Fiscal Year 2015-16 shall be transferred by County to
City and shall be set aside by City in a sinking fund to pay for the maintenance and
replacement of the Bookmobile. At such time as the bookmobile is to be replaced, the
County shall then transfer its balance of the Bookmobile Sinking Fund to the City to help
offset the cost of the new bookmobile. The City Treasurer shall be responsible for the
administration of these funds to see that they arc utilized in accordance with the provisions
of this Interlocal Agreement.

RE: Road Study for Abandoned road within Section 31,T7N-RIOW
Please refer to the attached research items on the above described location:

the south%of Section 31 circled in RED,showing the original road layout;
item 2-Photo copy form the Road Record Book#1,dated February 15,1872,for a
Road Petition with that portion of Section 31,T7N-R1OW,circled in REI)on the
back;
Items 3-2013 County aerial of area noting no evidence of a public roadway or a
defined field drive:
j(tern 4-2016 County aerial of that area noting new residence in the very SW corner
of the SE also noting no maintained public roadway in existence. Also,to the
north is the site of the newly placed residence that will need to develop a driveway,
still note no evidence of a maintained public roadway to new north development.
In review of the recent physical use of the original road layout,said area has been fanned or
being used as field drive access to the SE and SW 1/4s of the Section and the southernmost area of
the north!4 of the Section along the Prairie Lake dam. I have also contacted the Denver Township
officials and they stated remembering an old"drive type"road but not maintained and current
adjoining landowners have only recognized it as a field access drive. Also,it is also worth noting that
to redevelop this road would result in direct impact to the existing pivot operations in the SW'b and
the new residences in the SE1/4 of said Section.
With the presentation of the circulated"Petition for Closure",it is my recommendation that
the Board of Supervisors proceed to the public hearing to hear formal comments to officially close the
abandoned roadway as located within the attached documents.

Miller requested the board make a motion to take action on Resolution 2016-07-05.01 that recognizes the
receipt of the petition for road closure and the setting of a public hearing to hear comments for or against the
proposed road closure.
Motion by Neumann,seconded by Weeks to approve the chairman's signature on Resolution 2016-07-05.01 and
set a public hearing for August 2,2016 at 9:45 a.m. in the Adams County Board of Supervisors room. Roll Call;
Ayes:Stromer,Weeks,Thomsen, Hogan, Curtis, Neumann,Orthmann. Nays: None
Miller presented the Board with a proposal from Olsson and Associates for a project design on Adams Central
Avenue at the site of the future Adams Central Elementary School.
Brief discussion occurred on the costs associated with the project design,as Weeks stated that Adams Central
Schools should be responsible for the costs. Miller stated that cost reimbursement from the school could be
included in an inter-local agreement with the school.
Motion by Weeks,seconded by Stromer to approve the project design agreement with Olsson and Associates.

it is ow understanding that Adams County.Nebraska(`Chard"}requests Olsson Associates,Inc.
("Olsson") to perform the services described herein pursuant to the terms of this Letter
Agreement for Professional Services, Olsson°s General Provisions and any exhibits attached
hereto(all documents constitute and are referred to herein as the"Agreement")for the Project.
Olsson has acquainted itself with the information provided by Client relative to the Project and
based upon such information offers to provide the services described below for the Project
Client warrants that it is either the legal owner of the property to be improved by this Project or
that Client is acting as the duly authorized agent of the legal owner of such property, Client
ad nowiedges that it has reviewed the General Provisions and any exhibits attached hereto.

SCHEDULE FOR OLSSON'S SERVICES
Unless otherwise agreed, Olsson expects to perform its services under the Agreement as
follows:
Anticipated Start Date: July 11,2016
Anticipated Completion Date: December 31,2016
Olsson will endeavor to start its services on the Anticipated Start Date and to complete its
services on the Anticipated Completion Date. However, the Anticipated Start Date, the
Anticipated Completion Date, and any milestone dates are approximate only, and Olsson
reserves the right to adjust its schedule and any or all of those dates at its sole discretion,for
any reason, including, but not limited to, delays caused by Client or delays caused by third
parties.
COMPENSATION
Client shalt pay to Olsson for the performance of the Exhibit'K Services a fixed fee for each of:
1. Preliminary Design Services $5,200,00
2. Basic Design Services $24,500.00
3. Bidding or Negotiating Phase Services ;2.700.00
Total Fees: $32,400.00
Otsson's reimbursable expenses for this Project are included in the fixed fee, Olsson shall
submit invoices on a monthly basis and payment is due within 30 calendar days of invoice date.
TERMS AND CONDITIONS OF SERVICE
We have discussed with you the risks, rewards and benefits of the Project, the Scope of
Services, and our fees for such services and the Agreement represents the entire
understanding between Cent and Olsson with respect to the Project The Agreement may only
be modified in writing signed by both parties.
Client's designated Project Representative shall be Dawn Miller.
If this Agreement satisfactorily sets forth your understanding of our agreement. please sign in
the space provided below. Retain one original for your files and return an executed original to
Olsson. This proposal will be open for acceptance for a period of 22 days from the date set
forth above,unless changed by us in writing.
