Supervisor Curtis stated in public comment that he has received many comments from the public regarding the purchase of a new RYDE transportation bus, comments have been positive and in favor of the purchase. No additional public comments were made. Adams County Maintenance Supervisor, Harold Johnson, presented the Board with two bids received for contract cleaning services. Bid #1 — Heartland Cleaning service based in Lincoln, NE =$5835.00 per month Bid#2 — Eagle Buildings based in Hastings, NE = $5500.00 per month Motion by Thomsen, seconded by Weeks to award the contract cleaning bid to Eagle Buildings for $5500.00 per month. INTERLOCAL AGREEMENT BETWEEN ADAMS COUNTY, STATE OF NEBRASKA AND THE ADAMS CENTRAL PUBLIC SCHOOL DISTRICT RECITALS WHEREAS, Adams County, State of Nebraska, and the Adams Central Public School District are public agencies within the meaning of Neb. Rev. Stat. § 13-803 (2), and thereby have the authority to enter into an interlocal agreement pursuant to the Interlocal Cooperation Act; and, WHEREAS, the Adams Central Public School District has recently passed a bond issue for the construction of a new elementary school to be located on an Adams County road, namely Adams Central Avenue; and, WHEREAS, the Adams Central Public School District and Adams County, State of Nebraska, by and through its Department of Roads, will need to cooperate to provide appropriate Ingress and egress to and from the new elementary school and construct needed Improvements to the current right-of-way of Adams Central Avenue. AGREEMENT NOW, THEREFORE, in consideration of the foregoing recitals, Adams County, State of Nebraska, and the Adams Central Public School District hereby enter into the following interlocal agreement: 1. AUTHORITY AND PURPOSE: 1.1 Authority: Article XV, Section 18 of the Constitution of the State of Nebraska, the Interlocal Cooperation Act of the State of Nebraska, Neb. Rev. Stat. 13-801 et seq., (the "Act"), authorize any two or more public agencies to enter into agreements for the joint or cooperative exercise of any power, privilege or authority exercised or capable of exercise individually by such public agencies. The Parties are public agencies within the meaning of these laws. 1.2 Improvements to Public Property and Right -of -Way: The Parties have the authority to construct improvements to public property and right-of-way, and other appurtenances thereto. The Parties have the authority and responsibility to ensure adequate, efficient, safe and accessible roadways for the general public and for public school facilities and students, parents and patrons, and to design and construct roadways for the general public and to school facilities, and to enter into any contracts to effectuate this authority and responsibility. 1.3 General Purpose: It is the purpose of this Agreement for the Parties to make the most efficient use of their powers by cooperating with each other on the basis of mutual advantage and timely provide services and facilities as identified in this Agreement and In any addendum to this Agreement that will accord best with geographic, economic, population and other factors influencing the needs and development of local communities. 2. ADMINISTRATION OF AGREEMENT: 2.1 Administration: The Parties each shall designate an administrator who is hereby delegated all power and responsibility for the management of the cooperative undertaking set forth in this Agreement, Including but not limited to, the power to sign, execute and deliver provider agreements or contracts for 298 1 Page 7. ADDITIONAL STIPULATIONS: 7.1 SCOPE OF WORK: The scope of the work as defined in this project will start after May 17, 2017 and will meet substantially complete status by August 2, 2017. 7.2 ACCESS TO JUNIOR/SENIOR HIGH SCHOOL: During construction of this project, Adams Central Junior/Senior High School shall maintain access off of Adams Central Avenue at all times. Any change in entrance/exit to Adams Central Junior/Senior High School will be communicated to the Superintendent of Schools seven (7) days prior to the change. 7.3 REDUCTION OF SPEED: The speed limit on Adams Central Avenue, for the portion described in this project shall be clearly posted once the project is complete. 7.4 ACCESS TO ELEMENTARY SITE: Full access from the Adams Central elementary site onto Adams Central Avenue will be granted and in place by October 1, 2016. Temporary (or dirt) driveway access will suffice until permanent access is complete. 7.5 OVERHEAD LIGHTS: Adams Central Public Schools will be responsible for the ongoing maintenance of the overhead lights after installation. 7.6 COOPERATION: Adams County, State of Nebraska and the Adams Central School District shall work diligently and cooperatively with the Architects and Engineers hired by Adams Central Public Schools during the construction of the Adams Central Elementary Project. 7.7 ADDITIONAL RIGHT-OF-WAY: Any additional right-of-way needed by Adams County, State of Nebraska, from Adams Central Public Schools shall be deeded to Adams County, State of Nebraska at no additional cost. 8:— - CONCURRENT- WORK ON --ELEMENTARY SITE:--The-Adams Central- Public School District may -- conduct work in the Adams County road right -of way during the planning and construction of the project related to the construction of the new elementary school. 9. COOPERATION WITH THE NEBRASKA DEPARTMENT OF ROADS: Adams County, State of Nebraska and the Adams Central Public School District shall work cooperatively with the Nebraska Department of Roads in assisting with the completion of any needed traffic study related to the project. 10. INDEMNIFICATION: The Parties shall indemnify and hold each other, and its directors, board members, officers, administrators, and employees harmless, from any claims and expenses (including attorneys' fees and litigation expenses), damages or losses either may suffer as a result of any claims made under, in the administration of, or regarding the validity of this Agreement or the effect of this Agreement on the expenditure or revenue authority of the Parties, including but not limited to liability, or taxpayer or regulatory claims. 11. ASSIGNMENT: This Agreement shall be binding upon and inure to the benefit of the Parties and their successors or assigns; provided, this Agreement shall not be assigned or otherwise transferred to a third party without the prior written consent of the other Parties hereto. 2991 Page 7. GOVERNING LAW: This Agreement shall be governed by and interpreted in accordance with the statutory and decisional law of the State of Nebraska. 14. ENTIRE AGREEMENT: This Agreement constitutes the entire Agreement of the parties with respect to the subject matter hereof. All prior agreements, representations, statements, and negotiations are hereby superseded. This Agreement may be amended only by a writing executed by both parties. 15. PRIOR UTILITY SERVICES AGREEMENTS AND DISSOLUTION: Prior Utility Services agreements, executed by the Parties, if any, shall remain in full force and effect unless otherwise agreed, and may be assigned to the Cooperative or renegotiated in the name of the Cooperative. The Cooperative may be dissolved and this Agreement may be terminated at any time during the Initial Term or any Renewal Term without cause on ninety (90) days written notice to the other Party. The Cooperative shall be dissolved upon termination, provided that the Cooperative may not be dissolved until all outstanding contractual obligations and claims have either been satisfied in full, reassigned, or assumed by the Parties, or the Party liable and responsible for such obligations and claims, and until the completion of any pending state or federal audit. Upon dissolution of the Cooperative, each Party shall become the owner of an undivided fractional interest in any assets of the Cooperative. •16.----• EFFECTIVE DATE: -This Agreement -shall -be executed• in -duplicate originals, •and -the -Effective Date — shall be November 16, 2016. All requirements for periodic meetings or action shall date from the Effective Date of this Agreement. Project Director Total Budget Request $79,044 $23.08 X 35 hours x 52 weeks Annual Salary S42,000 The Director spend 100% of her time on the project offering, but not limited to: emotional support, criminal justice advocacy, crisis counseling, explanation of victims' rights, assistance in setting up appointments with prosecuting attorneys or LE, advising of measures they can take to keep themselves safe, referral to other agencies, and assistance in filling out compensation forms. The director will also assist victims in filling out applications for Protection/Harassment Orders. Direct services to victims include contacting all victims of crime by phone or in person. Every victim also gets a letter detailing the services provided to them, case information, and contact information. These letters are on top of and face to face or phone contact that the unit may have with the victim. Each morning, the director receives a list of reports taken an the previous day from LE and the director then goes through that list and gathers any information on the victim such as name, address, phone mrmhcr, ere. This list also lists the crime that was perpetrated upon the victim and defendant name. The list also alerts the director to whether or not the defendant was arrested, cited, or referred for prosecution. All victims are contacted within 72 hours, but most are contacted within 48 hours, so that advocacy can begin as soon as possible. During this initial contact, the director gives the victim any pertinent case information such as court appearance, bond information, assesses safety issues, informs the victim of their rights, and a general overall view of what to expect next. The director also can refer to other agencies and set up any appointments necessary at this time as welt. The director has been in this position for 15 years. Until very recently, this was the only paid position. With the generosity of the last grant application, the unit was able to hire a part time bilingual advocate to assist the director with day to day activities and also help with non-English speaking victims. This has already started to show an effect in the contact numbers of those populations here in Adams County. The director is in close contact with LE, SASA, Probation, and any assistance agencies to ensure that we are covering all the basis when it comes to assisting victims. We also try to not duplicate services, but sometimes that may happen. The director also has a great working relationship with the local courts, County & District, to ensure smooth communication regarding upcoming court dates for the offender. Part time Bilingual Advocate 515 x 25 hours x 52 weeks Salary 519,500 The director is requesting funds to txmtinue the part time bilingual advocate position. Although the unit still needs to use Ispeak cards and the language line when this advocate is not available, the addition of the Spanish- speaking advocate has already made a positive difference in the communication with non-English speaking victims. This advocate has, or is in the process of, translating all letters and forms that the unit currently uses into the Spanish language and is also assisting with the development and translation of the survey that the unit sends out to victims. This advocate has access to everything that the director has at her disposal, and is catching on quickly. She will attend the NEVAA training this summer, to assist her in technique and knowledge. The Adams County Attorney has agreed to assist the unit with the costs of this training, if necessary. The advocate currently works no more than 25 per week and is paid $15.00 per hour. The Adams County Attorney has agreed to approach the Adams County Board of Supervisors to ask them to pitch in to get her up to full time. We are hopeful that they will agree to do this. The director is also asking for funds to defray the cost of the employers 303 1 Page share of the FICA & retirement for this advocate. These will be detailed in the Fringe Benefit section of this grant application. Nays: None Adams County Clerk, Ramona Thomas, presented the Board with a request from Tom Reichert to rent the Adams County Office Building Assembly Room on December 17th. Reichert has filled out the necessary application and paid the necessary deposit. Motion by Weeks, seconded by Thomsen to approve the rental request submitted by Tom Reichert.
