A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann
was presiding. Roll call members present, Michael Stromer- District 1,Glen Larsen—District 2, Lee
Hogan- District 3 ,Scott Thomsen—District 4, Dale Curtis- District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Curtis,seconded by Stromer that this is an open public meeting of the Adams County Board
of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann, Orthmann. Nays:
None.
Orthmann stated that minutes from the March 5,2019 meeting have been circulated and will stand
approved unless there is a correction.
No corrections were suggested minutes approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m.the business
day prior to this meeting.

Took a road tour in the northern part of the county to assess road damages from recent
storms
Neumann requested more information from Supervisors Thomsen and Curtis regarding the meeting Phil
Lorenzen and Prochaska &Associates.The response was that the jail study is still in the preliminary and
fact gathering phase.
Orthmann- March 7, 2019—Attended a Midland Area Agency on Aging Board meeting
March 12,2019—Attended a Heartland Pet Connection Board meeting
March 14,2019—Attended a Convention and Visitors Bureau Board meeting
Chairman Orthmann opened the meeting to hear comments from the public.

Dan Rutt with Revive Ministries spoke during public comment to invite anyone interested to Revive
Ministries' annual fundraiser.
Adams County Highway Superintendent, Dawn Miller, presented a proposed agreement with Adams
Central Schools for shared costs relating to improvements at the Adams Central Road and Highway 6
intersection.
Adams County Deputy Attorney Dave Bergin informed the Board that a revision was made to section 6.1
of the agreement. Upon review the Board should consider approving the draft agreement with the
revisions proposed.
Action on the agreement was delayed until later in the meeting.

INTERLOCAL AGREEMENT BETWEEN
ADAMS COUNTY,STATE OF NEBRASKA AND THE ADAMS CENTRAL PUBLIC SCHOOL DISTRICT
RECITALS
WHEREAS,Adams County,State of Nebraska,and the Adams Central Public School District are public
agencies within the meaning of Neb.Rev.Stat.§13-803(2),and thereby have the authority to enter into
an Interlocal agreement pursuant to the interlocal Cooperation Act;and,
WHEREAS,the Adams Central Public School Districthas recently passed a bond issue forthe construction
of a new elementary school to be located on an Adams County road,namely Adams Central Avenue;and, '
( WHEREAS,the Adams Central Public School District and Adams County,State of Nebraska,by and through
its Department of Roads,will need to cooperate to provide an accelerated schedule and funding for
improvements-to the intersection of U.S. Highway 6 and Adams Central Avenue, in Adams County,
Nebraska in cooperation with Nebraska Department of Transportation(NDOT).
AGREEMENT
NOW,THEREFORE,in consideration of the foregoing recitals,Adams County,State of Nebraska,and the
Adams Central Public School District hereby enter into the following Interlocal agreement:
1. AUTHORITY AND PURPOSE:
1.3 Authority: Article XV,Section 13 of the Constitution of the State of Nebraska,the interlocal
Cooperation Act of the State of Nebraska,Neb.:Rev.Stat.13-801 et seq.,(the"Adel,authorize any two or
:more public agencies to enter into agreernentsfor the Joint or cooperative exercise.ofany power,privilege
or authority exercised or capable of exercise,individually by math public agencies. The Parties are public
agencies within the meaning of these laws.
1.2 improvements to Public Property and Right-of-Wa9:The Parties have the authority to construct
improvements to public property and right:Of-way,and other appurtenances thereto. The Parties have
the authority and responsibility to ensure adequate, effident, safe and accessible roadways for the
general public and for public school facilities and students, patents and patrons, and to design and
construct roadways for the general public and to school facilities, and to enter into any contracts to
effectivate'this authority and responsibility,
1.3 General Purpose: Itis the purpose of this Agreementfor the Parties to make the most efficient
use of their powers by cooperating with each other onthe.basis of mutual advantage and timely provide
services and facilities"as identified in this Agreement and in any addendum to this Agreement that will
accord best with geographic,•economic, population and other factors influencing the needs and
development of local communities..
2. ADMINISTRATION OF AGREEMENT:
2.1 Administration: The Parties each shall designate an administrator who Is hereby delegated ail
power and responsibility forthe managementof the cooperative undertaking set'forth In this Agreement,
including'but not limited to,the power to sign,execute and deliver provider agreements or contracts for

and on behalf oftheir respective entity. Any Party appointing such administrator upon no less than seven
(7)days advance written notice to the other Party may change the admin istrator from time to time. Each
administrator shall communicate with the other administrator to effectuate the terms of this Agreement.
Unless otherwise agreed, the initial administrator under this Agreement for the Adams Central Public
School District shall be the Superintendent of Schools or his/her designee,and for Adams County,State
of Nebraska shall be the HighwaySuperintendent or his/her designee.
2.2 Real and Personal Property: Any real and personal property shall be acquired,-held and disposed
asset forth in this Agreement or any amendment hereto.
2.3 jJo Separate Entity: No separate legal or administrative entity is created.under this interlocal
Agreement.
3. PROJECT'DESCRIPTION: The project to which this interlocal agreement applies shall be located
as follows: The intersection of U.S Highway 5 and Adams Central Avenue in Adams County, Nebraska.
Improvements to the intersection are defined by NDOT and will extend in each direction from the
centerpoint of the intersection no more than 500 feet in any direction. This will include any additional
right-of-way,which shall be constructed jointly as provided herein;and referred to herein as"the Project".
4. APPROVAL OF PLANS FOR PROJECT: This project falls under the jurisdiction of the Nebraska
Department of Transportation(NDOT)therefore all plans and approval Is under NDOT.
5. DESIGN AND BIDDING OF THE PROJECTS: The Nebraska Department of Transportation shall be
in charge of the project, including design engineering, construction engineering, and construction
administration. The Nebraska Department of Transportation shall be in charge of letting bids on the
project as necessary,including bids fordeslgn,engineering,construction and construction administration.
Adams County,State of Nebraska will develop their own interlocal agreement with NDOT. Adams Central
Public Schools will pay Adams County;State of Nebraska promptly as expenses occur.
6. RESPONSIBIUTY FOR COST OF THE.PROJECTS: The Adams Central Public School District shall be
responslblefor reimbursing Adams County,State of Nebraska for a portion of the project,Including design
engineering,construction engineering,and construction to the following conditions:
6.1 ADAMS CENTRAL PUBUC SCHOOLS: The Adams Central Public School District shall pay and be
responsible for 15.76%of the total cost of the project. The total cost to Adams.Central PubiicSchools will
be a maximum amount of$520,000.00. This amount is contingent on Adams County,State of Nebraska
contributing at least 23.64%of the total cost of the project. The total cost to Adams County,State of
Nebraska will be a maximum amount of$780,000.00. These are maximum amounts to contribute by each
entity and the percent of the project(60%county and 40%AC)needs to be honored. If the total cost of
the project is less than the estimated amount,this will reduce the local contribution proportionally.
6.2. ADAMS COUNTY, STATE OF NE RA NA: Adams Co nty, State of Nebraska shall pay and be
responsible for 23.64%of the total cost of the project.The tot I cost to Adams County,.State-of Nebraska
will be a maximum amount of$780,000.00. This amount Is ntingent on Adams Central Public School

7. ADDmoNALSTIPULATIONS:
• 7.1 SCOPE OF WORK: The scope of the work as defined in this project*al start in the spring of 2020
and will be substantially complete by fail of 2020.
7.2 ACCESS TO JUNIOR/SENIOR HIGH SCHOOL: During construction of this project,Adams Central
Junior/Senior High School shall maintain access off of Adams Central Avenue at all times. Any change In
entrance/exit to Adams Central Junior/Senior FGgh School will be communicated to the Superintendent
of Schools seven(7)days prior to the change.
7.3 COOPERATION: Adams County,State of Nebraska and the Adams Central School District shall
work diligently and cooperatively with each other during the construction of tills Project.
7.4 INTERLOCAL AGREEMENT WITH NEBRASKA DEPARTMENT OF TRANSPORTATION: It shall be the
responsibility of Adams County,State of Nebraska to develop and obtain approval of a separate interlocal
agreement with the Nebraska Department of Transportation.

8. COOPERATION WITH THE NEBRASKA DEPARTMENT QF TRANSPORTATION: Adorns County,
State of Nebraska and the/Warns Central Public School District shall work cooperatively with the Nebraska
Department of Transportation in assisting with the completion of the project.
9. LNQE.ME1.C'ATlghi: The Parties shall indemnify and hold each other, and its directors, board
members, officers,administrators,and employees harmless,from any claims and expenses(including
attorneys'fees and litigation expenses),damages or losses either May suffer as a result of any claims made
under,in the administration of,or regarding the validity of this Agreement or the effect of this Agreement
on the expenditure or revenue authority of the Parties,including but not limited to liability,or taxpayer
or regulatory claims.
10. ASSIGNMENT;This Agreement shall be binding upon and inure to the benefit of the Parties and
their successors or assigns;provided,this Agreement shall not be assigned or otherwise transferred to a
third party without the prior written consent of the other Parties hereto.
11. NOTICES: All not cP or other communications which are required or permitted herein shall be in
writing and shall be sufficient if delivered personally,sent by facsimile transmission,or sent by registered
or certified mall,postage prepaid,return receipt requested,to the parties at their addresses or facsimile
numbers set forth below which may be changed from time to time by notice to the other party:

12. GOVERNING LAW: This Agreement shall be governed by and Interpreted in accordance with the
statutory and decisional law of the State of Nebraska.
13. ETIf1RE AGREEMENT: This Agreement constitutes the entire Agreement of the parties with
respect to the subject matter hereof. Ali prior agreements,representations,statements,and negotiations
are hereby superseded. This Agreement may be amended only by a writing executed by both parties.
14. PRiOR UTILITY SERVICES AGREEMENTS AND ritSSO YmON: Prior Utility Services agreements,
executed by the Parties,if any,shall remain in full force and effect unless otherwise agreed,and may be
assigned to the Cooperative or renegotiated in the name of the Cooperative. The Cooperative may be
dissolved and this Agreement may be terminated at any time during the initial Term or any Renewal Term
without cause on ninety(90)days written notice to die other Party.The Cooperative shall be dissolved
upon termination,provided that the Cooperative may not be dissolved until all outstanding contractual
obligations and claims have either been satisfied in full,reassigned,or assumed by the Parties,or the Party
liable and responsible for such obligations and claims,and until the completion of any pending state or
federal audit. Upon dissolution of the Cooperative,each Party shall become the owner of an undivided
fractional Interest in any assets of the Cooperative.
15. EFFECTIVE DATE: This Agreement shall be executed In duplicate originals,and the Effective Date

Miller presented the 2019 gravel bids that were publically opened on March 5, 2019. Miller has
discussed the bids with the Road and Bridge Committee and made the recommendation of awarding
Deweese Sand and Gravel the following county sections: Northwest at$13.19 per square yard,
_ Northeast at$13.09 per square yard and Southeast at$14.64 per square yard. Miller recommended
awarding Mid Nebraska Aggregate the Southwest section at$13.71 per square yard.
Miller recommended awarding the stockpile bid to MidNebraska Aggregate at$7.00 per square yard
and awarding pit prices to both vendors that submitted bids.

RESOLUTION No.
of the ADAMS COUNTY BOARD OF SUPERVISORS
WHEREAS,because of climate conditions,the operation of heavy vehicles in the spring of
the year will seriously damage or destroy the following described asphalt roads under the
jurisdiction of Adams County:
The road known as Adams Central Avenue from the northeast corner of Section 8,
T7N-R1OW at West 12"'Street,thence south on Adams Central Ave for 2 miles to
Hwy 6,and continuing south of Adams Central Ave,going south from Hwy 6 to
Assumption Road or 4 miles,SHALL be restricted to 40 Tons or 80,000 pounds
GROSS Weight; AND
On Adams Central Avenue from the northeast corner of Section 8,T6N-R1OW,going
south from Assumption Road,thence south on Adams Central Ave for 5 miles,
ending at the intersection of Hwy 74,SHALL be restricted to 30 Tons or 60,000
pounds GROSS Weight.

WHERAS,the above described asphalt roads are under the jurisdiction of Adams County,
and Adams County is responsible for the maintenance of same,and
WHEREAS,it would be in the best interest of the residents of Adams County to limit and
restrict the weight of vehicles operating on the asphalt roads during the spring of the year,
NOW,THEREFORE,the Adams County Board of Supervisors,in accordance with Section
60-681 of the Revised Statues of the State of Nebraska,hereby for a period not to exceed
sixty(60)days,beginning on the 20th day of March,2019,restrict the weights of vehicles
on the above described roads as follows:
30 TON or 40 TON GROSS Weight,per vehicle maximum
as posted and signed per described per roadway segment
The Board of Supervisors further direct that the penalty for violation of this Resolution shall
be a fine designated under Section 60-6296 for the Revised Statutes of the State of Nebraska.
The Board of Supervisors further directs the Highway Superintendent of Adams County to ''`'y
erect and maintain sighs designating the restrictions set by this Resolution at a minimum at
each end of that portion of the asphalt road hereby affected. Such signs arc to read as
follows:

60,000 lbs. OR 80,000 lbs.
GROSS WEIGHT(where indicated)

This Resolution shall not take effect until such time as the signs are erected and maintained,
on only such roads as deemed necessary by the Adams County Highway Superintendent.
The Board of Supervisors further directs that if during the time this Resolution is to be in
effect,the Adams County Highway Superintendent determines that the climatic conditions
have improved to a point where the above described roadways do not appear to be subject to
further damage from heavy vehicles,the Weight Limit restrictions may be rescinded and
Weight Limit signs removed with no further action of the Board of Supervisors being
necessary.

Miller gave an update on the road and bridge condition following heavy rain and flooding last week.
Miller has submitted the necessary paperwork to possibly receive FEMA funds and Miller will keep the
Board update with new developments.
Director of the Area Substance &Alcohol Abuse Prevention office,Stefanie Creech-Will, provided the
Board with a program update.

Adams County Convention and Visitor's Bureau Director,Anjanette Bonham, requested approval of two
appointees to the Adams County CVB Board. Bonham requested Elizabeth Gartner or 220 N Lincoln
Avenue in Hastings and Stephanie Hagemeier or 909 N Williams Ave in Hastings, be appointed to the
Adams County CVB Board of Directors.
Motion by Thomsen,seconded by Curtis to approve the appointment of Gartner and Hagemeier to the
CVB Board. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen,Curtis, Neumann, Orthmann. Nays: None.
Bonham informed the Board that the CVB Board of Directors approved two grant awards.The first being
awarded to the 2019 Tattoo Convention held in Hastings and the other awarded to Prairie Loft for the
Flatwater Music Festival. Bonham stated both grants were paid for from funds provided by the City of
Hastings.
Brief discussion occurred regarding if the Adams County Board needed to take action on the grant
awards due to it being paid with City of Hastings funds.
Deputy Attorney Bergin confirmed the County Board would not be required to take any action on the
grant awarded by the CVB Board using City of Hastings funds.
Supervisor Neumann requested that Adams County Attorney, Donna Fegler-Daiss, be reappointed to the
South Heartland District Health Department Board.

Board Room to review and take action on tax list corrections and motor vehicle tax exemption
applications. Chairman Eldon Orthmann presided over the meeting.
