A regular meeting of the Adams County Board of Supervisors was held with Chairman Eldon Orthmann
presiding. Roll call members present, Michael Stromer- District 1,Glen Larsen—District 2, Lee Hogan-
District 3,Scott Thomsen—District 4, Dale Curtis-District 5,Chuck Neumann—District 6, Eldon
Orthmann—District 7.
Motion by Curtis,seconded by Stromer that this is an open public meeting of the Adams County Board
of Supervisors. Roll Call;Ayes:Stromer, Larsen, Hogan,Thomsen, Curtis, Neumann, Orthmann. Nays:
None.
Orthmann stated that minutes from the July 16, 2019 meeting have been circulated and will stand
approved unless there is a correction.
No corrections were suggested minutes approved by unanimous consent.
Public notice of this meeting has been given by publication in the Hastings Tribune and by posting.An
agenda was available to the board members and was kept continuously current and posted in the
County Clerk's office,the main courthouse lobby and the Adams County website.The following is the
agenda of items to be heard, no modifications were made to the agenda after 9:30 a.m.the business
day prior to this meeting.

Chairman Orthmann opened the meeting to receive comments from the public.
Adams County Highway Superintendent, Dawn Miller,spoke during public comment to provide an
Update on the South East Truck Route Project. Miller stated that from J Street,the west bound lane
would be open starting August 7, 2019.

approval a homestead exemption request that was submitted late due to clerical error.The State of
Nebraska has declined to reimburse the county the amount of exemption ($679.78) however Russell

We are writing to request a partial refund of personal property taxes assessed and paid in 2018
for assets owned by Burghardt Trucking at the end of 2017. Multiple assets were sold in 2017
and this was not reflected on the personal property tax return,which was mistakenly not filed by

were disposed of during 2017 and should not count as personal property tax for 2018. We hope

Adams County Highway Superintendent, Dawn Miller, presented the Board with an agreement between
Adams County and the Nebraska Department of Transportation for the 2019 Fracture Critical Bridge
Inspections. Miller has reviewed the agreement and resolution and is requesting approval.

STATE OF NEBRASKA DEPARTMENT OF TRANSPORTATION
STATEWIDE 2019 FRACTURE CRITICAL BRIDGE
INSPECTIONS AND LOAD RE-RATINGS
THIS AGREEMENT,entered into by and between Adams County,Nebraska,hereinafter
referred to as the"County",and the State of Nebraska,Department of Transportation,
hereinafter referred to as the"State".
WITNESSETH
WHEREAS,certain bridges on county roads in said County have been designated as
being eligible for Surface Transportation Program(STP)Funds by the Department of
Transportation,Federal Highway Administration,hereinafter call FHWA,in compliance with
Federal laws pertaining thereto,and
WHEREAS,STP Funds have been made available by Title 23 of the United States code,
providing for the Inspection and load re-rating(load re-rating is not necessary if bridge condition
remains the same)of the fracture critical bridges on its public roads,and
WHEREAS,the Federal share payable on any project provided for by the above
mentioned code shall not exceed eighty(80)percent of the eligible engineering for bridge
inspection and load re-rating costs thereof,and
WHEREAS,regulations for carrying into effect the provisions of the above mentioned
code provide that the Federal share of the cost of such project shall be paid only to the State,
and
WHEREAS,the County's share of the proposed project shall be twenty(20)percent of the
actual project costs and this share may be funded with County's Soft Match Balance,and
WHEREAS,the State is willing to obtain Federal approval of the proposed work and
Federal funds for the proposed project,with the understanding that no State funds including
State-Aid Bridge funds are to be expended on this project,and
WHEREAS,the County has earmarked or will be using a portion of the County'Soft
Match Balance to pay all project costs not paid for by Federal funds;such costs based on
twenty(20)percent County participation are currently estimated to be$2,184.57,but such costs
may increase or decrease due to variations between the estimated and actual project costs,and
State administrative officials. The final settlement between the State and County will be made
following final audits and when final costs have been determined by the State.
SECTION 6. It is further understood that the County's share of the total project costs shall be all
costs not paid for by Federal funds. Therefore,if the Federal government refuses to participate
in the project or any portion thereof,the County is responsible for full project payment with no
cost or expense to the State in such project or portion thereof. Should the project be
abandoned before completion,the County will pay all costs incurred by the State prior to such
abandonment.

by their proper officials thereunto duly authorized as of the dates below indicated.

RESOLUTION
SIGNING OF THE PROJECT PROGRAM AGREEMENT
2019 FRACTURE CRITICAL BRIDGE INSPECTION

Whereas: the Nebraska Department of Transportation(NDOT)is developing a transportation
project,on the behalf of the county,for which it intends to obtain Federal funds;
Whereas: Adams County as a sub-recipient of Federal-Aid funding is charged with the
responsibility of expending said funds in accordance with Federal,State and local laws,rules,
regulations, policies and guidelines applicable to the funding of the Federal-aid projects;
Whereas: Adams County and the NDOT wish to enter into a Program Agreement to provide for
fracture critical bridge inspection and load re-rating(if necessary)services for the Federal-aid
project.
Be It Resolved: by the Board of Supervisors of Adams County that:
Chair of the Adams County Board of Supervisors is hereby authorized to sign the attached
Project Program Agreement between the Adams County and the NDOT.
Adams County is committed to providing local funds for the project as required by the Project
Program Agreement.

PROPOSAL FOR MATERIAL HAULER
The following proposal for material hauling shall be for a total of 80 hours to haul/deliver material form
the borrow site to the project site at various sites across Adams County.
We haveP tractor/side dump units each with a capacity of 25 to 28 tons. The rate for each unit with
an operator is$120.00 per hour. After August 20"',we will have one more unit available for a total of 5.
I have included copies of the vehicle registrations and insurance certificates along with a copy of our
workman's compensation insurance and a copy of our liability insurance.

recommendation of the Adams County Road and Bridge Committee that the award go to Big Red Bunks
at a rate of$120.00 per hour.

Adams County budget preparers, Dawn Miller and Judy Mignery, requested the Board consider
approving a 1%budget override for the 2019/2020 budget. It is not anticipated the override would be
needed however it has been common practice to approve the override in the event it is needed.

evening.The rooms must be entirely vacated at that time,and any property or materials
belonging to the person,group,or organization must be removed from the building at that time
each day.
5. Persons,groups,or organizations not related to the county shall not go beyond the closed
door by the elevator.
6. Persons,groups,or organizations shall return the Assembly Room and the Meeting Room,
and adjacent restrooms,as you found them. If any extra cleaning Is required by county staff,
the cost of such cleaning shall be charged to the person,group,or organization. In addition,
any damage to any portion of the Adams County Office Building caused by members of a group
or organization using the facilities shall be charged to the group or organization.

RELATING TO A CHANGE IN HEALTH CARE INSURANCE FOR
EMPLOYEES OF ADAMS COUNTY
RESOLUTION NO.
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ADAMS COUNTY,
NEBRASKA that:
1. On July 1,2019,pursuant to the adoption of a motion by the Boani of Supervisors of
Adams County,the Health Insurance Program for the purposes of providing health insurance to
the qualifying employees of Adams County was changed from a self-insured program
administered by Midlands Choice to a Blue Cross and Blue Shield Program administered through
NACO.

2. Prior to July 1,2019,Adams County was a member of Partner's Health Alliance
which provided assistance to county emplowes in finding reduced rates for the performance of
certain health care procedures. Subsequent to July 1,2019,the transfer of Adams County to the
Blue Cross and Blue Shield Insurance requires an end to such services through Partner's Health
Alliance.
3. Therefore,subsequent to July 1,2019,Adams County shall only cover such health
care procedures which were commenced and performed through Partner's Health Alliance prior '
