Motion by Larsen, seconded by Stromer that this is an open public meeting of the Adams County Board of Commissioners. Willis Hunt of 616 Madden Road, spoke during public comment. Hunt stated he feels there is a lack of transparency in regards to the justice center—now possible jail only project. Hunt inquired about site plans for the project. Commissioner Curtis stated the plans were just released and they would be available for public viewing soon. Adams County Highway Superintendent, Dawn Miller, also spoke during public comment. Miller informed the board of a meeting for board members, highway superintendents and NACO representatives to be held. Miller also informed the board of a bid opening for the joint Adams and Webster County road project on the Adams and Webster County line. The bid opening will be December 9th at 10:00 at the Webster County Courthouse. No additional public comments were made and public comment was closed. Adams County Victim Witness Advocate,Jacki Norris, requested the board approve and sign the user authorization and special conditions associated with the 2022 Victims of Crime Act (VOCA) Grant. Norris has reviewed the document and is requesting board approval. Motion by Stromer, seconded by Johnson approving the chairman signing the authorization and special conditions of the VOCA Grant as presented by Norris. INl ERLOCAL COOPERATION AGREEMENT BETWEEN ADAMS COUNTY, NEBRASKA AND WEBSTER COUNTY,NEBRASKA RT IEREAS, both of the parties hereto are political subdivisions of the State of Nebraska;and, WHEREAS, the Interlocal Cooperative Act,Neb. Rev. Sincerely, 3LLJ Brooke Seachord, Project Coordinator Adams County RESOLUTION NUMBER I//6,0/ WHEREAS,the Federal Disaster Mitigation Act of 2000 was signed in to law on October 30, 2000, placing new emphasis on state and local mitigation planning for natural hazards and requiring communities to adopt a hazard mitigation action plan to be eligible for pre-disaster and post-disaster federal funding for mitigation purposes;and WHEREAS,a Multi-Jurisdictional Hazard Mitigation Plan was prepared by the Little Blue Natural Resources District and the Lower Big Blue Natural Resources District,with assistance from JEO Consulting Group,Inc.of Lincoln,NE.and, WHEREAS,the purpose of the mitigation plan was to lessen the effects of disasters by increasing the disaster resistance of the Natural Resources Districts and participating jurisdictions located within the planning boundary by identifying the hazards that affect the Adams County and prioritize mitigation strategies to reduce potential loss of life and property damage from those hazards,and WHEREAS,the Nebraska Emergency Management Agency and FEMA reviewed and approved the Little Blue Natural Resources District and the Lower Big Blue Natural Resources District Multi- Jurisdictional Hazard Mitigation Plan Update as of October 25,2021,and WHEREAS,FEMA regulations require documentation that the plan has been formally adopted by the governing body of the Adams County in the form of a resolution and further requesting approval of the plan at the Federal Level;and NOW,THEREFORE,the governing body of the Adams County does herewith adopt the FEMA approved Little Blue Natural Resources District and the Lower Big Blue Natural Resources District Multi- Jurisdictional Hazard Mitigation Plan Update in its entirety;and PASSED AND APPROVED this /LQ day of 0 ,202 . WITNESSETH: WHEREAS,Adams County, Nebraska,and Hamilton County, Nebraska, are authorized by law to have charge and custody of County Jails and their inmates,respectively;and WHEREAS,Adams County,wishes to designate the Hamilton County Jail as a place of confinement for the incarceration of one or more Adams County inmates lawfully detained and/or committed to its custody;and WHEREAS, Hamilton County Jail is desirous of accepting and keeping custody of such inmate(s)in the Hamilton County Jail for a rate of compensation mutually agreed upon by the parties hereto;and WHEREAS, Nebraska Interlocal Cooperation Act§13-801 through §13- 827 R.R.S.Nob.and other Nebraska laws,as amended,authorize any county to contract with any other county to perform any governmental service, activity or undertaking which each contracting county is authorized by law to perform;and WHEREAS, the governing bodies of each of the parties hereto have determined to enter into this Agreement as authorized and provided for by Nebraska Revised Statutes 13-801,et. seq. and Nebraska laws, as amended; and WHEREAS, this Interlocal Agreement permits the two counties to make the most efficient use of their taxing authority and other powers by enabling the two counties to cooperate on a basis of mutual advantage and thereby providing services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population, and other factors influencing the needs and development of the two counties,and NOW,THEREFORE,in consideration of the above and foregoing recitals, the payments to be made,the mutual promises and covenants herein contained, and for other good and valuable consideration the parties hereto agree as follows: 1 1. GOVERNING LAW The parties hereto agree that,except where expressly otherwise provided, the laws and administrative rules and regulations of the State of Nebraska shall apply to any matter relating to an inmate or inmates confined pursuant to this Agreement. 2. TERM OF AGREEMENT The term of this agreement shall be for a period of one(1)year upon the execution by both parties. This agreement will automatically renew for additional one(1)year periods unless either party provides to the other notice of that party's intent to terminate this agreement. Such notice will be in writing and delivered to the other party no less than ninety(90)days prior to the effective date of said termination, 4. DEFINITIONS The parties hereby agree that the following terms shall have the specified meanings unless indicated otherwise herein: Day. One prisoner day shall be each day or portion thereof which a prisoner appears in custody on the jail management system.The count shall be conducted by the jail management system and Adams County shall be charged for each prisoner who is detained in the Hamilton County Jail from Adams County, 2 426 IPage 6, COMPENSATION In consideration of the supervision,safekeeping,care and sustenance provided by Hamilton County,Adams County will pay to Hamilton County a basic rate of $50.00 per Inmate per day,with a minimum of one day,but not including the day of discharge. Inmates that are considered high risk or staff intensive due to medical and/or mental illness,Adams County shall pay to Hamilton County a rate of$85.00 per day. The Hamilton County Sheriff shall determine which Inmates are high risk or staff intensive and the Hamilton County Sheriff shall notify the Adams County Jail of such determination. With regard to billing procedures,the parties agree to the following: (a)A current list of inmates for Adams County shall be maintained by the Hamilton County Sheriff's Office. (b)Hamilton County shall submit Itemized statements for inmates who are housed at the Hamilton County Corrections Facility. Such statements shall include: the name, date of birth, the dates of admittance and discharge,length of stay,and the total amount due for each inmate. 7. RIGHT OF INSPECTION Adams County shall have the right to inspect, at all reasonable times,all Hamilton County facilities in which inmates of Adams County are confined in order to determine if such jail maintains standards of confinement acceptable to Adams County and that such inmates therein are treated equally regardless of race, religion, color, creed, national origin, or sex; provided, however, that Hamilton County shall be obligated to manage,maintain and operate its facilities consistent with all applicable federal,state and local laws and regulations. 8. FURLOUGHS,PASSES,AND WORK RELEASE Hamilton County agrees that no early releases or alternatives to incarceration, including furlough, passes, electronic home detention or work release shall he granted to any inmate housed pursuant to this Agreement without written authorization by the committing court. 9. INMATE ACCOUNTS Hamilton County shall establish and maintain an account for each inmate received from Adams County and shall credit to such account all money which is received and shall make disbursements, debiting such accounts in accurate amounts for the inmate's personal needs. Disbursements shall be made in limited amounts as are reasonably necessary for personal maintenance. The Hamilton County Sheriff shall be accountable to Adams County for such inmate funds. At either the termination of this Agreement, the inmate's death, release 3 from incarceration, transfer to another correctional facility, or return to either Adams County or indefinite release to the court, the inmate's money shall be transferred to the inmate. 10. INMATE PROPERTY Hamilton County will be responsible to secure inmates' personal property and return same to the inmates'upon release. 11. RESPONSIBILITY FOR OFFENDER'S CUSTODY It shall be the responsibility of Hamilton County to confine the inmate or inmates; to provide treatment, including the furnishing of sustenance and all necessary medical and hospital services and supplies;to provide for the Inmates' physical needs;to make available to them programs and/or treatment consistent with the individual needs; to retain them in said custody; to supervise them; to maintain proper discipline and control; to make certain that they receive no special privileges and that the sentence and orders of the committing court in the State are faithfully executed; provided that nothing herein contained shall be construed to require Hamilton County, or any of its agents to provide service, treatment, facilities or programs for any inmates confined pursuant to this Agreement,which it does not provide for similar inmates not confined pursuant to this Agreement. Nothing herein shall be construed as to require Hamilton County to provide services, treatment, facilities or programs to Adams County inmates above,beyond or in addition to that required by applicable law. 12. MEDICAL SERVICES (a) Inmates shall receive such medical, psychiatric and dental treatment when emergent and necessary to safeguard their health while housed in the Hamilton County Jail, Hamilton County shall provide or arrange for the providing of such medical, psychiatric and dental services. Except for routine minor medical services provided by medical personnel employed by or contracted with Hamilton County within the Hamilton County Jail,Adams County shall pay directly or reimburse Hamilton County for any and all costs associated with the delivery of arty medical service provided to the Adams County Inmates. Adams County shall be responsible for any and all medical, psychiatric and dental treatment provided outside of the Hamilton County Jail and shall be billed therefore. (b) An adequate record of all such services shall be kept by Hamilton County for Adams County to review at its request, to the extent consistent with confidentiality regulations.Any medical or dental services of major consequence shall be reported to Adams County as soon as time permits. (c) Should medical, psychiatric or dental services require hospitalization,Adams County agrees to compensate Hamilton County dollar for dollar any amount expended or cost incurred in providing the same; provided 4 4271 papa that, except In emergencies, Adams County will be notified by contacting the Adams County Jail Administrator and the Adams County Attorney prior to the inmate's transfer to a hospital, if and when circumstances allow, or as soon afterward as practicable. (d) Hamilton County will be responsible for providing security and adequate supervision of any Adams County inmate while out of the Hamilton County jail for medical purposes, Adams County shall reimburse Hamilton County for the costs of providing security and supervision. 13. RECORDS AND REPORTS Hamilton County shall keep all necessary and pertinent records concerning Adams County inmates In the manner mutually agreed upon by the parties hereto. During an inmate's confinement in Hamilton County Jail, Adams County shall, as allowed by law and upon request be entitled to receive and be furnished with copies of any report or records associated with said inmate(s) incarceration in a timely manner. 15. REMOVAL FROM JAIL An inmate of Adonis County legally confined in Hamilton County shall not be removed from there by any person without written authorization from Adams County or by order of any court having jurisdiction.Hamilton County agrees that no early releases or alternatives to incarceration including furloughs, passes, work release, work crews or electronic home detention shall be granted to any inmate without written authorization from the committing court. This paragraph shall not apply to an emergency necessitating the immediate removal of the inmate for medical, psychiatric, dental treatment or other catastrophic condition presenting an eminent danger to the safety of the inmate or to the inmates or personnel of Hamilton County. In the event of any such emergency removal, Hamilton County shall inform Adams County of the whereabouts of the inmate or inmates so removed at the earliest practicable time, and shall exercise all reasonable care for the safe keeping and custody of such inmate or inmates. 16.TECHNOLOGY EFFORTS Both parties agree that they shall cooperate and spend reasonable funds to allow for video conferencing capabilities from the Hamilton County Jail to the Courtrooms in Adams County and to facilitate video conferencing between 5 Adams County inmates and the inmates' attorneys. The use of this technology will reduce the need for transporting inmates for court appearances and expenses to Adams County for Attorney travel time, 17. ESCAPES in the event any Adams County inmate escapes from Hamilton County's custody,Hamilton County will use all reasonable means to recapture the inmate. The escape shall be reported immediately to the Adams County Sheriff and Adams County Attorney. Hamilton County shall have the primary responsibility for and authority to direct the pursuit and retaking of the inmate or inmates within its own territory. Any cost in connection therewith shall be chargeable to and borne by Hamilton County. 18, DEATH OF AN INMATE (a) In the event of the death of a Adams County inmate, the Hamilton County coroner shall be notified. Adams County shall receive copies of any records made at or in connection with such notification. (b) Hamilton County shall immediately notify Adams County of the death of an inmate,furnish information as requested and follow the instruction of Adams County with regard to the disposition of the body. In the case of an unattended death, suspicious death or criminal case, the Hamilton County Coroner would have authority over the deceased and would coordinate with local law enforcement to finish the investigation prior to the release of the deceased inmate.Adams County hereby designates the Adams County Attorney the official authorized to request information from and provide instructions to Hamilton County regarding deceased inmates. The body shall not be released except on written order of said appropriate official of Adams County. All expenses relative to any necessary preparation of the body and shipment charges shall be paid by Adams County.With Adams County's consent, Hamilton County may arrange for burial and all matters related or incidental thereto,and all such expenses shall be paid by Adams County and shall not affect the liability of any relative or other persons for the disposition of the deceased or for any expenses connected therewith, (c) Adams County shall receive a certified copy of the death certificate for any of Its inmates who die while in Hamilton County custody. 19. HOLD HARMLESS AND INDEMNIFICATION Hamilton County agrees to hold harmless, indemnify and defend Adams County, its officers, agents and employees,from and against any and all claims, losses or liability for injuries, sickness or death of persons, or damage to property arising out of any willful misconduct or negligent act, error or omission of Hamilton County, its officers, agents or employees,in 6 428 IPage connection with the services required by the Agreement, provided, however,that: (a)Hamilton County's obligations to indemnify, defend and hold harmless shall not extend to injuries, sickness, death or damage caused by or resulting from the willful misconduct or negligence of Adams County, its officers,agents or employees or sub-consultants;and (b)Hamilton County's obligations to indemnify, defend and hold harmless shall not extend to injuries, sickness, death or damage caused by or resulting from the willful misconduct or a third party other than an officer, agent or employee of Hamilton County, and shall apply only to the extent of the degree of negligence or willful misconduct of Hamilton County. (c)Hamilton County will provide to Adams County continuous proof of Hamilton County's Workers' Compensation Insurance coverage as required by the State of Nebraska; and Commercial General Liability Insurance, Laws Enforcement Liability Insurance,and Automobile Liability Insurance coverages in the minimum amount of$1,000,000(one million) any person per occurrence and maximum coverage of $5,000,000(five million)each occurrence. Adams County agrees to hold harmless, indemnify and defend Hamilton County, its officers, agents and employees, from and against any and all claims, losses or liability for Injuries,sickness or death of persons,or damage to property arising out of any willful misconduct or negligent act,error or omission of Adams County, its officers, agents or employees, in connection with the services required by the Agreement,provided,however,that (a) Adams County's obligations to indemnify, defend and hold harmless shall not extend to injuries, sickness, death or damage caused by or resulting from the willful misconduct or negligence of Hamilton County, its officers,agents or employees or sub-consultants;and (b) Adams County's obligations to indemnify, defend and hold harmless shall not extend to Injuries, sickness, death or damage caused by or resulting from the willful misconduct of a third party other than an officer,agent or employee of Adams County, and shall apply only to the extent of the degree of negligence or willful misconduct of Adams County, 20. RIGHT OF REFUSAL AND TRANSPORTATION (a)Hamilton County shall have the right to refuse to accept any inmate from Adams County or any other law enforcement agency that,in the judgment of Hamilton County, has a current illness or Injury or is not fit for confinement, which may adversely affect the operations of the Hamilton County Jail as determined by the correctional intake staff and the Custody Authorization form. 7 (b)Adams County prisoners shall be transported by Adams County to court appearances and any other hearing, meeting, and/or appointments, with the exception of medical services provided in the City of Aurora. 21. INDEPENDENT CONTRACTOR In providing service under this contract, Hamilton County is an independent contractor and neither it nor its'officers, agents or employees are employees of Adams County for any purpose, including responsibility for any federal or state tax, industrial insurance or Social Security liability. Neither shall the provision of services under this Agreement give rise to any claim or career service or civil service rights, which may accrue to any employee of Adams County under any applicable law,rule or regulation, 22. GENERAL PROVISIONS (a) Severability. In the event any provisions of this agreement shall be determined to be unenforceable or otherwise invalid for any reason, such provisions shall be enforced and valid to the extent permitted by law. All provisions of this agreement are severable and unenforceability or invalidity of a single provision herein shall not affect the remaining provisions. (b) Governing Law and Venue. This agreement shall be governed by the laws of the State of Nebraska and venue for any lawsuit shall be the Adams County or Hamilton County Courts. (C) Attorney's Fees, In the event it is necessary for either party to utilize the services of an attorney to enforce any of the terms of this agreement, such enforcing party shall be entitled to compensation for its reasonable attorney's fees and costs. In the event of litigation regarding any terms of this Agreement,the substantially prevailing party shall be entitled,in addition to other relief,to such reasonable attorney's fees and costs as determined by the Court. (d) Waiver of Breach. The waiver by either party of the breach of any provision of this agreement by the other party must be in writing and shall not operate nor be construed as a waiver of any subsequent breach by such other party. (e) Savings Clause. Nothing in this agreement shall be construed so as to require the commission of any act contrary to law, and wherever there is any conflict between any provisions of this agreement and any statute, law, public regulation or ordinance, the latter shall prevail but in such event, the provisions of this agreement affected shall be curtailed arid limited only to the extent necessary to bring it within legal requirements. (f) Filing. This Agreement shall be filed with the Hamilton and Adams County Clerks. 8 429 1 23. SEPARATE LEGAL ENTITIES This agreement does not create a new legal entity or a new administrative entity. 24. INTERPRETATION This agreement has been submitted to the scrutiny of all parties and their counsel, if desired, and it shall be given a fair and reasonable interpretation in accordance with its words, without consideration or weight given to its being drafted by any party or its counsel. All words used in the singular shall include the plural; the present tense shall include the future tense; and the masculine gender shall include the feminine and neuter gender. 25. ACCESS TO RECORDS CLAUSE The parties hereby agree that authorized representatives of the parties shall have access to any books, documents, paper and record of the other party that are pertinent to this agreement for the purposes of making audits, examinations, excerpts and transcription. All such records and all other records pertinent to this agreement, and work undertaken pursuant to this agreement shall be retained by the parties for a period of three (3) years after the final expiration date of this agreement or any amendments hereto, unless a longer period is required to resolve audit findings or litigation. In such cases, the parties may expressly agree by an amendment or separate agreement for such longer period for record retention. 26. ENTIRE AGREEMENT This agreement represents the entire integrated agreement between Adams County and Hamilton County and supersedes all prior negotiations, representations or agreement, either written or oral.
