Motion by Patterson, seconded by Stromer that this is an open public meeting of the Adams County Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan, Reams, Neumann, Patterson Nays: None Absent:Johnson The Pledge of Allegiance was performed. Chairman Hogan inquired if there were any conflicts of interest with today's agenda. Commissioner Patterson stated he has a conflict of interest regarding the grant request submitted by the Nebraska Softball Association,and will be abstaining from voting on that item. A-NE Datacenters,Inc would like to place a Data Center in Section 18-T8N-R1 I W in Subdivided Heartland Subdivision Number Two. Data Centers and their accessory structures are allowed by conditional use permits in the I-1 and I-2 Industrial Districts with the following criteria: 1. Holder of the approved CUP shall submit an annual report to the County Zoning office detailing compliance with the standards and criteria listed in 1 and 2 above based upon a minimum of semiannual measurements of noise,liquid waste,heat,and light. 4. Consideration of available infrastructure capacity and impacts on the infrastructure. 5. Consideration of employment density with available land zoned industrial in the county. 6. The premise shall always be maintained in a neat and orderly condition. The area is to be fenced and always secured. The buildings and/or containers on the site will always be maintained in a clean and orderly condition. 7. Noxious weeds on the premises shall be controlled pursuant to state and local laws and regulations. 8. Noise level cannot exceed more than 20 decibels above the normal ambient noise level at'/4 mile from the data center. Maximum decibel levels shall be limited to a maximum on-hour limit of 55 dba from the property line of any existing dwelling, platted residential area,public park,recreational area,church cemetery,religious area, school,or historical site within''/z mile of the data center. 9. Any change of ownership of the structures,data mining operation,or land requires notification to the Adams County Zoning Department. 10. In the event the data mining center discontinues operation for a period of more than twelve consecutive months,all equipment shall be removed,and the property shall be restored to its original condition at the owner's expense. 11. Data Center shall not be within one half mile from an existing residential structure, public park, cemetery,house of worship,or hospital without obtaining an impact easement from said owner of the entity. There is a residence to the West approximately 2480', to the Southeast 3000',to the East Northeast 3540', CPI is 2,400' to the east of property,Village of Prosser is approximately 7,122' to the northeast. Public Hearing Notice for the Planning&Zoning Commission meeting and the County Board meeting was published in the Hastings Tribune on December 21,2023 and a formal written notice for both the Commission meeting and the County Board meeting was mailed to all landowners within 300' of the property by general delivery on December 21,2023. LAWFUL PRESENCE IN USA AND WORK ELIGIBILITY STATUS PROVISIONS County agrees to comply with the requirements of Neb.Rev.Stat.§§4-108 to 4-114 with its project,including,but not limited to,the requirements of§4-114(2)to place in any contract it enters into with a public contractor a provision requiring the public contractor to use a federal immigration verification system to determine the work eligibility status of new employees physically performing services within the State of Nebraska. SECTION 10. ENTIRE AGREEMENT This agreement contains the entire agreement of County and State. No representations were made or relied upon by County or State other than those that are expressly set forth herein. No agent,employee or other representative of County or State is empowered to alter any of the terms in this agreement unless done in writing and signed by an authorized officer of the County and State. South Heartland District Health District Director, Michele Bever, presented the annual report for the SHDHD office. Eric Walston presented the annual county weed report and requested board approval. Motion by Stromer,seconded by Reams to approve the annual weed report submitted by Walston.
