Motion by Stromer, seconded by Johnson that this is an open public meeting of the Adams County Board of Commissioners. Roll Call,Ayes:Stromer, Larsen, Hogan, Reams, Neumann, Patterson Nays: None Absent:Johnson The Pledge of Allegiance was performed. Chairman Hogan inquired if there were any conflicts of interest with today's agenda. No conflicts were disclosed. Adams County Planning&Zoning Director,Judy Mignery, spoke during public comment to make the board aware of LB1375 pertaining to conditional use permits. Mignery also serves as the county board administrator stated she sent a letter Senator Halloran and other state senators that appear to be in favor of LB1067 that would repeal the inheritance tax. No additional public comments were made and public comment closed. Beth Janning from the Adams County Extension Office provided the annual extension office report. Chad Thies with Zelle Solutions gave a presentation regarding human resource services available from Zelle Solutions. Roll Call,Ayes:Stromer,Larsen, Hogan, Reams, Neumann, Patterson Nays: None Absent: Johnson INTERLOCAL COOPERATION AGREEMENT BETWEEN ADAMS COUNTY,NEBRASKA AND HALL COUNTY,NEBRASKA WHEREAS,both of the parties hereto are political subdivisions of the State of Nebraska;and, WHEREAS, the Interlocal Cooperative Act, Neb. Rev. Stat. §13-801 to §13-827, permits local governmental units to make the most efficient use of their powers to enable them to cooperate with other governmental units in an effort to provide services and facilities in a manner that will accord with the needs of their local communities;and, WHEREAS,it would be in the best interest of Adams County,Nebraska(Adams County) and Hall County,Nebraska(Hall Count)),that Barrows Road Resurfacing,beginning at the east right-of-way line of Nebraska Highway 281 and ending approximately 3,100 feet to the east at the east limit of the unincorporated community of Hansen(Project),be cost shared for road surface maintenance purposes between the two entities in such a manner as to facilitate such road surface maintenance;and, WHEREAS, the Adams County portion is the eastbound lane and the Hall County portion is the westbound lane;and, WHEREAS, the Project shall include tasks such as, but not limited to,surveying, engineering, plan preparation,contract document preparation,bid procurement,construction,staking,observation,testing and project management;and, WHEREAS,Adams County and Hall County shall use local funds for participating costs;and, WHEREAS,Adams County and Hall County shall be financially responsible for portions of project described above;and, WHEREAS,this Interlocal Agreement does not alter maintenance,signing,snow removal responsibilities previously established;and, WHEREAS,Adams County agrees to indemnify and hold harmless,protect and defend Hall County and its elected and appointed officials, employees, agents, and representatives against any and all claims, demands,suits,actions,payments and judgments,including any and all costs and expenses connected therewith,legal costs or otherwise,for any damages which maybe asserted,claimed,or recovered against or from Hall County or its insurers,because of personal injury,including bodily injury or death,or on account of property damage, including loss of use thereof,sustained by any person or persons which arises out of,is in any way connected with,or results from any and all work or activity associated with the services provided under this agreement unless such damages are the direct and sole result of Hall County's negligence;and, WHEREAS,Hall Countyagrees to indemnify and hold harmless,protect and defend Adams Countyand its elected and appointed officials, employees, agents, and representatives against any and all claims, demands,suits,actions, payments and judgments, including any and all costs and expenses connected therewith,legal costs or otherwise,for any damages which maybe asserted,claimed,or recovered against or from Adams County or its insurers,because of personal injury,including bodily injury or death,or on account of property damage, including loss of use thereof, sustained by any person or persons which arises out of,is in any way connected with,or results from any and all work or activity associated with the services provided under this agreement unless such damages are the direct and sole result of Adams County's negligence;and, WHEREAS,this Agreement shall expire after completion of road maintenance during the 2024 calendar year. Motion by Reams, seconded by Johnson to direct the attorney's office to proceed with civil legal action against Brady Chase.
