presiding.
Motion by Patterson,seconded by Johnson that this is an open public meeting of the Adams County
Board of Commissioners. Roll Call,Ayes: Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays:

The Pledge of Allegiance was performed.
Chairman Hogan inquired if there were any conflicts of interest with today's agenda.
No conflicts were disclosed.

against the proposed one and six year road plan.

Chairman Hogan opened the floor for public comment on the one and six year plan.
Matt Greenquist; residence 3880 W Oregon Trail Road in rural Hastings spoke regarding the bridge
project C1-158 on Oregon Trail Road.The bridge was closed in 2019 remains closed.This project has
been on the one and six year plan for several years.Greenquist requested the bridge be made a priority.
Johns Rostvet; residence 3290 Smokey Hill Road in rural Hastings spoke regarding a paving project in
front of the Freeland Creek Subdivision. Rostvet requested this project be a priority last year as the
homes in Freeland Creek add substantial valuation to the county.
No additional public comments were received.

Hastings Economic Development Corporation Director, Shannon Laudauer, provided an update from the
HEDC office.
Adams County Convention and Visitors Bureau Director,Anjanette Bonham, requested approval of the
appointment of Kimberly Milovac to the visitors bureau board.
Motion by Johnson, seconded by Patterson to approve the appointment of Kimberly Milovac to the

Adams County Extension Director, Ron Seymour, requested approval of the appointment of Lindsay

Zoned Use: I-2 Industrial
Administrator's Comments: Adams County Amended Zoning regulations in August 2023 to
include Data Center definition and regulations in the I-2 district with a Conditional Use
Permit. A-NE Datacenters,Inc would like to place a Data Center in Section 18-T8N-R11 W
in Subdivided Heartland Subdivision Number Two. Data Centers and their accessory
structures are allowed by conditional use permits in the I-1 and I-2 Industrial Districts with
the following criteria:
1. Compliance with Section 8.11,Performance Standards for Industrial Uses
2. Compliance with 4.20.05,Criteria for Appearance:
3. Holder of the approved CUP shall submit an annual report to the County Zoning office
detailing compliance with the standards and criteria listed in 1 and 2 above based upon
a minimum of semiannual measurements of noise,liquid waste,heat,and light.
4. Consideration of available infrastructure capacity and impacts on the infrastructure.
5. Consideration of employment density with available land zoned industrial in the
county.
6. The premise shall always be maintained in a neat and orderly condition. The area is to
be fenced and always secured. The buildings and/or containers on the site will always
be maintained in a clean and orderly condition.
7. Noxious weeds on the premises shall be controlled pursuant to state and local laws and
regulations.
8. Noise level cannot exceed more than 20 decibels above the normal ambient noise level
at'Y4 mile from the data center. Maximum decibel levels shall be limited to a
maximum on-hour limit of 55 dba from the property line of any existing dwelling,
platted residential area,public park,recreational area,church cemetery,religious area,
school,or historical site within/2 mile of the data center.
9. Any change of ownership of the structures,data mining operation,or land requires
notification to the Adams County Zoning Department.
10. In the event the data mining center discontinues operation for a period of more than
twelve consecutive months,all equipment shall be removed,and the property shall be
restored to its original condition at the owner's expense.
11. Data Center shall not be within one half mile from an existing residential structure,
public park,cemetery,house of worship,or hospital without obtaining an impact
easement from said owner of the entity.

to the northeast.
Public Hearing Notice for the Planning&Zoning Commission meeting and the County Board
meeting was published in the Hastings Tribune on December 21,2023 and a formal written
notice for both the Commission meeting and the County Board meeting was mailed to all
landowners within 300'of the property by general delivery on December 21,2023.A list of the
landowners notified is included within the case file.
Anthony Levesque with A-NE Datacenters, Inc was present to answer questions regarding the future
data center.
Chad Waldren with Southern Public Power District was also present to answer questions regarding the
additional used of resources the data center will require.
Motion by Neumann, seconded by Reams to approve the issuance of a conditional use permit for a data
center in the Heartland Subdivision Number Two as presented. Roll Call,Ayes: Larsen, Hogan,Johnson,

Commissioner Patterson started discussion on proposed Resolution 2024-02-20.01; calling for a special
issue on the May Primary Election Ballot for allowable lottery sales in the rural areas of Adams County
not under city or village jurisdiction.
Owner of Hastings Keno, Mike Nevrivy, stated the intent it to have Keno at Southern Hills Golf Course
and Country Club which is located outside of any city or village limits.
The question on the City of Hastings two mile jurisdiction arose and the potential conflicts it could
create.
Motion by Patterson,seconded by Johnson to strike"and extraterritorial jurisdiction"from the

RESOLUTION
TO PLACE THE ISSUE OF AN ADAMS COUNTY
LOTTERY ON THE PRIMARY BALLOT ON
MAY 14,2024
Adams County Resolution No.2024-02-20.01
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF ADAMS COUNTY,
NEBRASKA that:
WHEREAS,a county lottery is a permitted source of revenue pursuant to the Nebraska
County and City Lottery Act as long as such lottery is approved by a majority of the registered
voters casting ballots on the issue in Adams County,and
WHEREAS,the Adams County Board of Commissioners has determined that there is an
interest in the creation of a county lottery in Adams County.
NOW,THEREFORE,BE IT RESOLVED BY THE ADAMS COUNTY BOARD OF
COMMISSIONERS:
That an election shall be held in conjunction with the Primary Election on May 14,2024
on the issue of whether Adams County should establish and conduct a county lottery in certain
designated areas of Adams County which are defined in this resolution.
The ballot for the above-described election to be held on May 14,2024 shall be presented
in the following form:
Shall Adams County,Nebraska establish and conduct a lottery as permitted under the
Nebraska County and City Lottery Act,which lottery would be conducted in certain designated
areas of Adams County,for the purpose of community betterment as defined in such act?
The designated areas of Adams County in which the county lottery may be conducted are
as follows:
All parts of Adams County except those areas hereinafter defined:
Areas within the corporate limits of the City of Hastings.

Meeting Minutes

A regular meeting of the Adams County Board of Equalization was held in conjunction with the meeting
of the Adams County Board Commissioner's meeting,with Chairman Lee Hogan presiding.
Commissioners present were; Glen Larsen—District 2, Lee Hogan—District 3, Harold Johnson—District
4,Tim Reams—District 5, Chuck Neumann—District 6,Joe Patterson—District 7
Michael Stromer—District 1 was absent
At 10:01 am there was a motion by Neumann, seconded by Patterson to meet as a Board of
Equalization. Roll Call,Ayes: Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None Absent:
Stromer
Board of Equalization opened at 10:01 am
Adams County Deputy Assessor,Janet Kopisch, presented the board with the annual permissive
exemptions. Kopisch has reviewed the applications and have indicated approval or denial.
Motion by Reams, seconded by Johnson to approved all the exemption recommendations by Deputy
Assessor Kopisch. Roll Call,Ayes: Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays: None

Deputy Assessor Kopisch presented tax list corrections for parcel ID 010019382, owners Toby&
Shelly Julian; parcel ID 010010291, owner Megan Woods; parcel ID 010005455, owner Larry
Shaw
Kopisch has reviewed the corrections and is recommending approval.
Motion by Neumann, seconded by Reams to approve the tax list corrections presented by Deputy

Adams County Deputy Treasurer, Deanna Mead, presented the board with motor vehicle tax exemption
applications for;

Deputy Treasurer Mead stated that the county treasurer has confirmed all entities meet the criteria for
exemption and is recommending approval.
Motion by Neumann, seconded by Reams to approve the motor vehicle exemptions as presented by
Deputy Treasurer Mead. Roll Call,Ayes: Larsen, Hogan,Johnson, Reams, Neumann, Patterson Nays:
None Absent:Stromer
Motion by Patterson, seconded by Reams to exit Board of Equalization and resume regular session. Roll
