Chairman COURT HOUSE, H STINGS, NEBRASKA Tuesday, December 22, 1942. 2:00 o'clock P. M. Special meeting of the Adams'County Board of Supervisors met as per published notice of December 10, 1942, and evidence was introduced including the 1940 Federal census. Roll call, all members present: Foote, Goble, Harm, Hohlen, James, Sergeant, and Shaw. Motion by Harm, seconded by Goble, that the following findings be adopted: In consideration of the evidence; we, the Board of Supervisors, do find the population of said County to be in excess of 26,000 and less than 30,000 as of this date. Roll call, all voted aye. Motion carried. Motion by J7:mes, seconded by Harm, that this Board now adjourn to meet again at the call of the County Clerk. Motion carried. Board adjourned. Chairman COURT HOUSE, HASTINGS, NEBRASKA. Wednesday, January 6, 1943. 9:00 o'clock A. M. Regular meeting of the Adams County Board of Supervisors met as per recess of December 7, 1942. Roll call, all members present: Foote, Goble, Harm, Hohlen, James, Sergeant, and Shaw. Minutes of last meeting were read and approved. Motion by James, seconded by Goble, that the applications of Betty Pickering, Rose Mc Cauley, and Beulah Porter for Mother's Pension be approved. Roll call, all voted aye. Motion carried. Motion by Foote, seconded by Shaw, that the monthly reports of the County Judge, County Clerk Car .Titles, 2 - Register of Deeds, Clerk of District Court, and Sheriff, and the annual reports of the Adams County Farm Bureau, and County Superintendent Institute Fund be placed on file. Roll call, all voted aye. Motion carried. Motion by Sergeant, seconded by James, that we adopt the following resolution: "BE IT RESOLVED,. That the County Board of Supervisors sell to Francis A. Harpham for the sum of $5.00, the following described property: Lot 15, Block 9, First Addition to the Village of Kenesaw, subject to taxes of record which was bid in by the County on a county tax certificate foreclosure sale; and, that the chairman of the County Board be hereby authorized to ex- ecute and deliver a warranty deed to said purchaser." Roll call, Ayes: Foote, Hohlen, James, Sergeant, and Shaw. Nays: Goble and Harm. Motion carried. Motion by Foote, seconded by Sergeant, that we adopt the following resolution: ttBE IT RESOLVED, That the County Board of Supervisors sell to Jennie E. Scudder for the sum of $15.00, the following described property: Lot 1015, Village of Juniata, subject to taxes of record which was bid in by the County on a county tax certificate fore- closure sale; and, that the chairman of the County Board be hereby authorized to execute and deliver a warranty deed to said purchaser." The County Judge appeared before the County Board at 3:30 o'clock P. M. and approved the bonds of Perle P. Koch, Supervisor District No. 3, George W. Bivens, Supervisor District No. 7, William G. Hohlen, Supervisor District No. 1, Emma Berg, County Clerk, and August Anderson, County Assessor. Motion by Sergeant, seconded by Shaw, that the following bonds be approved: Rachel Hayen, Deputy Register of Deeds, $2000; Fred 0. Schaffroth, Register of Deeds, $2000; M. F. Deets, County Surveyor, $500; Ida Blomenkamp, Deputy Clerk of District Court, $5000; Verner W. Felker, Clerk of District Court, $5000; Carroll P. Parker, Deputy Sheriff, x$10,000; Albert J. Theobald, County Treasurer, $50,000; Worthy B. Wood, Sheriff, $10,000; and Florence Rainforth, County Superintendent, $1000. Roll call, all voted aye. Motion carried. Statutory meeting of the Adams County Board of Supervisors. Roll call, all members present: Bivens, Goble, Harm, Hohlen, James, Koch, and Sergeant. Motion by Harm, seconded by Sergeant, that 1Nn. Hohlen be appointed as temporary chairman. Roll call, all voted aye. Motion carried. Motion by Bivens, seconded by Goble, that we proceed to take an informal ballot for the appointment of a permanent chairman of the Adams County Board of Supervisors for the year of 1943. Roll call, all voted aye. Motion carried. An informal ballot was ordered and the chairman appointed John A. James and Perle Koch as tellers with results as follows: First ballot - Hohlen 2, James 3, Harm I, Goble I. Second ballot - James 4, Hohlen 3. Motion by Sergeant, seconded by Koch, that we suspend the rules and John A. James be declaredduly appointed per- manent chairman of the Adams County Board of Supervisors for the year 1943. Motion by Sergeant, seconded- by Goble, that we adopt the following resolution: "BE IT RESOLVED, That the County Board of Supervisors sell to the Hastings Housing Company for the sum of $87.00, the following described. property: Lot 23, Country Club Addition to the City of Hastings, subject to taxes of record which was bid in by the County on a county tax certificate foreclosure sale, and subject to recording fee of $'I.55; and, that the chairman of the County Board be hereby authorized to execute and deliver a quit claim deed to said purchaser." Wednesday, January 13, 1943. 10:00 0' clock A. M. Statutory meeting of the Adams County Board of Supervisors as per recess of January 12, 1943. Roll call, all members present: Bivens, Goble, Harm, Hohlen, James, Koch, and Sergeant. Motion by Goble, seconded by Sergeant, that the wages of County employees for the year 1943 beginning February 1, 1943 be as follows: Road dragging 300 per mile, single man 450 per hour, man and team 600 per hour, man and two teams 700 per hour, three patrolmen and maintenance men $125.00 per month, extra patrolmen 45¢ per hour, and com- mon labor 450 per hour. Motion by Hohlen, seconded by Sergeant, that the following resolution be adopted: "BE IT RESDLVED, That, Whereas, the County of Adams is the owner and holder of title to the following described real estate, to -wit: Lots 16, 17, 18, 19, 20, and 22, and Lots 43 to 53 inclusive, and Lot 23, Country Club Addition; and, Whereas, it appears to this Board that it would be to the best interest of the county of Adams, Nebraska and to all concerned, we do hereby adopt the following restrictive covenants applicable to said above property, to -Lit: "...(B) That in addition to the specific restrictions and covenants hereinafter set forth, the signatories hereto recognized are bound by the provisions of the State of Nebraska and the building code of the City of Hastings, County of Adams, State of Nebraska. (C) a. All lots in the said tract shell be known and designated, and described as residential lots and no structure be erected, altered, placed or be permitted to remain on any of the building plots in said tract other than detached single-family dwellings not to exceed two and one-half stories in height and a private garage for not more than three cars. b. No dwelling shall be permitted on any of the above lots of the division whose ground floor area is less than 675 square feet in the case of a one story structure, orless than 500 square feet in the case of a one and a half story structure or more in height, exclusive of open porches and attached garage. c. No building shall be erected or moved on any residential building plot nearer than 25 feet, nor farther than 35 feet from the front line or nearer than four feet from any side lot line. The side line restriction shall not apply to a garage located on the rear third of a lot except that on corner lots no structure shall be permitted nearer than 6 feet to the side street line. d. No residential structure shall be erected or placed on any building plot which plot has an area of less than 5000 square feet or a frontage of less than 45 feet and no inches. e. No noxious or offensive trade, advertising sign, bill board, or other advertising device shall be permitted or erected or placed in said property, and no activity shall be carried on upon any lot nor shall anything be done thereon which may be- come an annoyance or nuisance to the neighborhood. f. No trailer, basement, tent, shack, garage, barn or other outbuilding erected in the tract shall at any time be used as a residence temporarily or permanentz y, nor shall any structure of a temporary character be used as a residence. g. For a period of 50 years from date, no person of other than the Caucasian race shall be or become the grantee or lessee of said property, or except as a servant in the family living thereon, be granted the privilege of occupying the same. h. A perpetual easement is reserved over the rear 5 feet of each lot for utility installation and maintenance. i. The covenants and restrictions are to run with the land and shall be binding on all of the parties hereto and all persons claiming under than until January 1, 1968, at which time said covenants and restrictions shall terminate. j. If the parties hereto, or any of them, or their heirs or assigns, shall violate or attempt to violate any of the covenants or restrictions herein before January 1, 1968, it shall be lawful for any other person or persons owning any other lots in said addition to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenant or restriction and either to prevent him or then from so doing or to recover damages or other dues for such violation.." And we do hereby authorize the Chairman of the Board of Supervisors to sign such deeds necessary to carry into effect said restrictive covenants. Roll call, all voted aye. Motion carried. Motion by Hohlen, seconded by Harm, that the County Clerk be and is hereby authorized to issue warrants on the last day of each month to all county officers, deputies, and clerks in county offices who are entitled to receive pay on county warrants as are fixed by law governing the different county offices and upon agreement with the County Board; also, that the Chairman of the County Board be authorized to sign warrants; also, that this order is to apply, to county employees who are to receive a monthly salary. Poll call, all voted aye. Motion carried. Motion by Koch, seconded by Haim, that we adopt the following resolution: "BE IT RESOLVED, That the County Board of Supervisors sell to J. B. Fernow for the sum of $13.83, the following described property: Lots 24 to 28 inclu- sive, Block 5, Village of Roseland, subject to taxes of record which were bid in by the County on a county tax cer- tificate foreclosure sale, and subject to recording fee of $1.55; and, that the chairman of the County Board be hereby authorized to execute and deliver a suit claim deed to said purchaser." Roll call, Ayes: Bivens, Goble, Harm, Hohlen, James, and Koch. Nay: Sergeant. Motion carried. Motion by Sergeant, seconded by Goble, that we adopt a budget of $40,000.00 for the Road Fund. This $40,000.00 to be divided equally between Supervisor Districts No. 1, 2, 3, and 4 respectively, in the amount of $10,000.00 to each named district for the year 1943. Roll call, all voted aye. Motion carried. Regular meeting of the Adams County Board of Supervisors met as per adjournment of December 13, 1943. John A. James, Chairman, presiding. Roll call, all members present: Bivens, Goble, Hohlen, James, Koch, Priebe, and Sergeant. Minutes of last meeting were read and approved. Motion by Priebe, seconded by Bivens, that we adopt the following resolution: "WHEREAS, it appears that in the as- sessment of the property consisting of improvements on leased grounds, that there was made an obvious error in list- ing the valuation of the said property as $4500.00 instead of $2700.00, and WHEREAS, it hereby appears that the total valuation of the property is $2700.00, and the County Board being satisfied that it was an obvious error, IT IS, therefore, the opinion and judgement of this Board that the said assessment should be corrected in ac- cordance with the true valuation and intent, and the County Assessor, the County Clerk, and the County Treasurer are therefore hereby directed to correct the said assessment and the records based thereon to show the said property as- sessed at $2700.00 instead of $4500.00 as it now appears." Motion by Hohlen, seconded by Sergeant, that we adopt the following resolution: "WHEREAS, Harry Suchland, as guard- ian of the person and estate of Rose Suchland, an incompetent person, duly appointed by the County Court of Adams County, Nebraska, has filed in the District Court of Adams County, Nebraska, a petition for a license to sell the following described real estate belonging to the incompetent: Five -eights (5/8) of the West Half (W2) of Lot Four (4), Block Four (4) College Addition to Hastings, Nebraska, The West Seventy-two (72) feet of the Southwest Quarter (SWw) of Block Five (5), Mc Intyre's Addition to Hastings, Nebraska, and, The South, Half of the Southwest Quarter (Si SY) of Section Thirteen (13), Township Eight (8) North, Range Nine (9) West of the 6th P. M., Adams County, Nebraska, for the reason that there is no cash or personal property belonging to the incompetent and the income from the real estate is insufficient to care for and maintain the incompetent, to pay the taxes thereon, and the expenses and charges of the management of her estate; that the expense of the care of the incompetent at the Ingleside State Hospital, Ingleside, Nebraska, since she was committed there on August 24, 1942 in a sum in excess of $350.00 or any part of it has not been paid and she or her estate is liable therefor and for the accruing expense of maintain- ing her and caring for her in said institution; that any part of the proceeds of the sale of said real estate avail- able can be invested so as to produce a larger return than is realized from the real estate; that it is for the benefit of the incompetent and her estate that the real estate be sold and the proceeds thereof used for the pur- poses aforesaid, and, WHEREAS, the Board of Supervisors of Adams County, Nebraska, have investigated the matter and approve of the proposed sale and deem it necessary for the best interests of the incompetent. THEREFORE, BE IT RESOLVED, by the Board of Supervisors of said county that it deems such proposed sale proper and beneficial to the ward and her estate and it approves the same that a copy of this resolution be certified by the County Clerk of said County to the District Court thereof." Haried for $85.00; Lots 1 and 2, Block 3, West Lawn Addition to the City of Hastings, to Stella Phillips for $100.00; subject to taxes of record which were bid in by the County on county tax certificate foreclosure sales; and that the chairman of the County Board be hereby authorized to execute and deliver quit claim deeds to said purchasers."
