COURT HOUSE, HASTINGS, NEBRASKA Thursday, January 8, 1953. 10:00 o'clock A.M. Regular meeting of the Adams County Board of Supervisors met as per recess of January 6, 1953. Jay Goble, `thairman, presiding. Roil call, members present: Anderson, Goble, Lightner, Gangwish, Hohlen and Woodman.Absent:Bovard Motion by Woodman, seconded by Lightner, that Whereas, bids for construction of the Old Peoples Home were received by the Board of supervisors on January 6th, 1953 in accordance with the notice of bidders duly published, and with the plans and specifications on file in the office of the County Clerk and the explanations thereof, and WHEREAS, said bids were on the 6th day of January, 1953, opened, read and tabulated and it appeared that Carmichael and James, a partnership, of Hastings, Nebraska was the lowest and best bidder in the amount of $43,106.00. NOW, THEREFORE, be it Resolved, that the said bid of Carmichael & James in the amount of $43,106.00 be approved and that a contract in accordance with the notice to bidders, plans and specifications, bid and all explanations and abdenda thereof be awarded to Carmichael & Janes and the Chairman of the Board of Supervisors be and he is hereby authorized to execute said contract. BE IT FURTHER RESOLVED, that the surety bond presented to the Board of Supervisors in the amount of $43,106.00 with Carmichael and James, a Partnership, as principal, and Fidelity and Deposit Company of Maryland, as surety be approved. NEBRASKA Tuesday, January 13, 1953* 10:00 o'clock A.M. Statutory meeting of the Adams County Board of Supervisors met as per recesscof January 5,1953. Jay Goble, Chairman, presiding. Roll call, members present: Anderson, Goble, Lightner, Hohlen, Gangwish and Woodman. Absent: Bovard. There appears to be no more unfinished business, that this board now adjourn sine die. REORGANIZATION OF THE BOARD Roll call, members present: Anderson, Gangwish, Hohlen, Lightner, Maltman, Utecht and Woodman. At 10:15 A. M. the County Judge appeared before the %ard and stated that all bonds have been filed and approved. The Certificates of election of WM. Utecht, Floyd Woodmand and W. W. Maltman were presented, examined and approved by the Board of Supervisors. Motion by Lightner, seconded by Woodman, that Urn-Utecht be appointed temporary chairman. Roll call, all voted aye. Motion carried. That we proceed to take an informal ballot for Lthairman of the, Adams County Board of Supervisors An informal ballot was ordered and the Chairman appointed Maltman and Hohlen as tellers with results as follows: Woodman 3 and Anderson 4. That we suspend the rules and George Anderson be declared duly appointed permanent Chairman of the Adams County Board of Supervisors for the year 1953. Motion by 'Woodman, seconded by Hohlen, that we confirm the appointment of Rena Gartner as Clerk of the County Court, and Chas Mousel as substitute and acting County Judge. Roll call, all voted aye.Motion carried. Motion by Lightner,;seconded by Gangwish that the following Resolutithn be adopted. RESOLUTION: BE IT RESOLVED, that the County Judge pay such trust funds consisting of legacies, devises into the General fund of Adams County; payable to the Adams County Treasurer in the amount of $68.54. Roll call, all voted aye. Motion carried. Motion by Hohlen, seconded by Utecht that we authorize the Chairman to sign the tax book correction slips. Roll call, all voted aye. Motion carried. Motion by Maltman, seconded by Gangwish, that the HastinEs Daily Tribune be designated as the County official paper for the year 1953. Roll call, all voted aye. Motion carried. Motion by Lightner, seconded by Utecht, Whereas, it appears that the bid of 443,106.00 for construction of an Old Peoples Home has been approved and a contract awarded to Carmichael and James, and that an addition to said building should be constructed in accordance with the original plans and specifications, and Whereas, Carmichael and James have proposed to complete the additional work for the sum of 0422.85, and Whereas, there is the sum of approximately 455,000.00 availabel for said construction. Now Therefore Be It Resolved, that the additional work as shown by plans and specifications on file in the office of the County Clerk be authorized and the bid of Carmiachel and James for such additional work in the amount of 0422.85 be approved and a contract in accordance with such bid, plans and specifications be awarded and attached to the oriEinal contract as a supplemental agreement. It is further resolved that the Chairman be authorized to execute said contract on behalf of Adams County, Nebr. Roll call, all voted aye. Motion carried. Motion by Woodman, seconded by Gangwish, that we approve the following banks as county depositories: The Hastings National Bank, Hastings; Adanas County Bank, Kenesaw; City National Bank, Hastings; and Roseland State Bank, Rosela;d; also approve the securities posted by the following banks as security for county funds in the following amounts: The Hastings National Bank $600.00.00; City National Bank, Hastings W0.00.00; Adams County Bank, Kenesaw $30,000.00; Roseland State Bank, Roseland $20,000.00; Roll call, all voted -aye.Motion carried. Motion by Woodman, seconded by Maltman that we consent to the County Treasurer depositing up to 100% of he capitol stock and surplus in any of the depository banks hamed, said deposits to be protected by the bonds as renuired by law. Roll call, all voted aye. Motion carried. Motion by Maltman, seconded by Uangwish that the license of the Club Brick Pile Inc. be denied effective January 16, 1953 and the County Clerk to notify this action of the lioard to the County Sheriff, County Attorney and Courtney W. Larson. Roll call, all voted aye. Motion carried. Motion by Lightner, seconded by Gangwish that we appoint Mr and Mrs Kistler as Custodians for the year 1953 at the sane salary as 1952. Roll call, all voted aye. Motion carried« Motion by Hohlen, seconded by Woodman, that we approve the appointment of George Sarver, Deputy Sheriff for a period of six months at the request of Sheriff Wood, and that the Sheriff is to make a monthly report of taxes collected. Motion by Maltman, seconded by Gangwish, that the following resolution be adopted: RESOLUTION: Whereas, the Union Pacific Railroad Company has constructed and maintains a railroad track in Adams County, Nebraska which track intersects a county road, which is an extension of Baltimore Avenue of the City of Hastings, at a crossing near the Southwest corner of the North Half Northwest Quarter of Section 1 Township 7, Range 10, Adams County, Nebraska; and Whereas the said railroad Company has repeatedly and ontinously for many years failed and neglected to keep said crossing clear to permit the free and uninterrupted travel by motor vehicles and pedestrians, and has on numerous occasions blocked said crossing by railroad cars for unreasonable periods or time; and Whereas, it is to the best interests of the residents of Adams County, Nebraska that said crossing be kept free and clear for motor vehicle traffic; and, Whereas, the above mentioned conditions are endangering the public health, safety and welfare of said County and have created an emergency condition. Now, therefore, Be It Resolved by the Board of Supervisors of Adams County, Nebraska, that a copy or this resolution be forwarded to the Union Pacific Railroad Company and the Railway Commission of the State of Nebrasks and that all necessary and proper action be taken immediately to correct such conditions by all parties concerned. WITNESSETH that for an in consideration of the Mutual covenants hereinafter expressed the contractor agrees to donate and furnish to the county all labor and equipment necessary to construct one mile of Armor Coat Road on a county road lying between Section Sixteen (16) and Section Seventeen (17), Township Seven (7) North, Range Nine (9), West of the 6th P.M., Adams County, Nebraska,.. as said road is presently located. The contractor agrees to grade, prepare and slope the shoulders, scarify and stablize said roadway and to apply thereon a good and sufficient armor coat and seal, said work to be done in a good and workmanlike manner and in accordance with the specifications of the Department of Road and Irrigation of the state of Nebraska, said contract to be performed under the supervision of the County Engineer of Adams County, Nebraska. The contractor hereby agrees to perform said labor and to furnish the necessary equipment therefor at no cost or expense to the county. In consideration of the donation of the labor and equipment by the contractor the county hereb agrees to furnish to the contractor for the purposes herein set forth all materials necessary to complete said mile of road including all sand and gravel necessary to complete a stabilized soil base and all aggregate and asphaltic oils necessary for said armor coat and seal, said material to conform to the standards and specifications of the Department of Roads and Irrigation of the State of Nebraska, at no cost to the contractor; provided, however, that the total cost and expen e to the county for said materials shall not exceed the sum of One Thousand Four Hundred Dollars ($1,400.00)., Contractor rurther agrees that he shall be solely responsible for any injury or damage sustained by any and all persons during the progress of said construction and prior to the completion and acceptance of said road to the end- that during the said construction the contract.r agrees to save the county harmless for any such injury or damage. The contractor further agrees to keep in force present policies of insurance guaranteeing payment of compensation according to the Workmen's Compensation Law of Nebraska for all workmen injured in his employ- during the completion of said road. The county further agrees that all materials supplied under this contract shall be free from any and all liens and encumbrances which shall in any way adversely affect the use thereof by the contractor. Said materials to be furnished by the county shall be delivered at a point to be determined by the parties hereto which point of delivery may be at the site of the work to be performed under this contract.
