HomeMy WebLinkAboutSP03-18-08COURTHOUSE HASTINGS NEBRASKA Tuesday, March 18, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved as circulated. Orthmann attended Senior Services and Heartland Pet Connection board meetings on March 12th, An Adams County Convention & Visitors Bureau meeting on March 13th as well as the retirement luncheon for Bill Harris and a BID meeting also. Larson attended the Harris retirement and the Roads Committee meeting this morning. Neumann attended a meeting of the Midland Area Agency on Aging on March 6th, the Woodman anniversary on the 9th, a Meth Coalition meeting on the 10th, participated in an online workshop of Institute for Excellence on the 11th, a Health Dept meeting on the 12th and the Harris retirement on the 13th. Hynes attended a Combined Services meeting on March 12th, the Harris retirement on the 13th, also the Woodman anniversary on the 9th and the Roads Committee meeting this morning. Saathoff attended the Harris retirement on the 13th. Kehoe attended the Woodman anniversary on the 9th, the Combined Services meeting and a CASA meeting; however there was no quorum at CASA so no business conducted. Woodman attended the workshop for the Institute of Excellence, the Combined Services meeting, the Harris retirement and the Roads Committee meeting. There were no comments from the public. County Clerk Lewis reported to the Board that the Treasurer has received a replacement security in the amount of $150,000.00 from Adams County Bank. This is a non-maturing Bank Deposit Guaranty Bond. Motion by Hynes, seconded by Kehoe to accept the Bank Deposit Guaranty Bond in the amount of $150,000.00 from Adams County Bank. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller, Planning Administrator, presented information to the Board on two subdivision cases, Bourg Second Subdivision and Osler Acres Subdivision. Motion by Neumann, seconded by Saathoff to approve case 08-01.1, Bourg Second Subdivision, applicant Ed Bourg. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Larson to approve case 08-03.1, Osler Acres Subdivision applicant Georgia Osler. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Hastings City attorney Bob Sullivan was present to ask the Board to approve Resolution 08-03-18. This resolution would remove right-of-way along property recently annexed into the City from a County Industrial Area. County Clerk Lewis read the Resolution into the record. Motion by Neumann, seconded by Larson to approve and authorize the Chairman to sign Resolution 08-03-18 removing right-of-way from a County Industrial Area. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Dawn Miller, Highway Superintendent, provided information to the Board about recent efforts by the Highway Dept to clean up county road ditches. They found 19 dump sites within 2-3 mile radius of Hastings. They picked up 10 sites from 70th St south to 12th St and from 12th St south and west to Adams Central Road. Kehoe provided information to the Board about grants that are available from NE Dept of Environmental Quality for cleanup of illegal dump sites. Miller stated that she was aware of these grants however, most of the time they don’t cover their costs of labor and equipment. The County has used the grants in the past when they contracted with someone for cleaning up large dump sites. Attorney Shane Perkins asked the Board for direction regarding taxes, interest and penalties owed to the County by 360 Networks. The company has split into two companies and is in the process of bankruptcy. He said the companies are asking for the Board to waive the interest and penalties and they would pay the taxes. He stated that some other counties have done this. It seems that if the Board would waive the interest and penalties, the taxes could be paid soon. However if the Board decides not to waive the interest and penalties the recovery of them and taxes would be pushed to the bottom of the list of creditors. He feels that the companies will have to pay the interest and penalties anyway as federal law requires it but if the Board would waive them and the taxes were paid the interest and penalties would stop accruing. Motion by Saathoff, seconded by Larson for Perkins to proceed in the collection of the taxes and to use his discretion to forego the interest and penalties owed by the companies who were 360 Networks. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Hynes, seconded by Kehoe to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Orthmann to accept Miscellaneous Receipts for the month of February in the amount of $708,625. 60. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to accept officers reports for the month of February from the Register of Deeds and County Clerk. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Orthmann to move to Executive Session for litigation regarding the Kothe Bridge case. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 10:40 AM. Motion by Neumann, seconded by Kehoe to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:07AM. The Chairman announced that the only discussion during Executive Session related to litigation of the Kothe Bridge case. This Board is now adjourned.
