HomeMy WebLinkAboutSP04-15-08COURTHOUSE HASTINGS NEBRASKA Tuesday, April 15, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Larson, seconded by Orthmann that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann was absent. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved as circulated. Orthmann attended a Senior Services meeting, United Way meeting and Heartland Pet Connection meeting on the 9th, a BID meeting and Adams County Visitors Bureau meeting on the 10th and another BID meeting on the 15th. Larson attended a meeting of Midland Area Agency on Aging and a Road Committee meeting. Hynes attended the Road Committee meeting. Saathoff attended Coffee with Senator Burling on the 5th and an RSVP meeting on the 9th. Kehoe attended a CASA meeting and announced that on April 23rd Casa is having a fund raiser at Lochland. Woodman attended the Institute of Excellence in Lincoln on the 3rd, Coffee with Senator Burling on the 5th and a Severe Weather meeting on the 7th, signed the Claims Release on the Bridge last Thursday and attended a Reuse of Funds meeting yesterday. Betty Vertin, director of the Ron Gardner Meth Coalition updated the Board on the activities of the coalition. They have formalized their Board of Directors and had election of officers and have started an online news letter. She also asked the Board to declare May as Methamphetamine Awareness Month in Adams County. The Chairman read the declaration into the record. Motion by Kehoe, seconded by Hynes to approve the declaration as read by the Chairman declaring May as Methamphetamine Awareness Month in Adams County. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Dawn Miller, Planning Administrator, presented two letters of interest regarding the vacant seats on the Board of Adjustments. The letters received were from Thomas Russell and Bonny Kroeker. Kroeker’s husband, Glen, serves on the Planning Commission and the Board felt that there could be a conflict of interest with husband and wife serving on the Commission and Board. They instructed Miller to seek other applicants. Motion by Larson, seconded by Saathoff to appoint Thomas Russell as a regular member to the Board of Adjustments for a three year term. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. The Board recessed at 9:55 AM and reconvened at 10:00 AM. At 10:00 AM the Board held a public hearing for the issuance of bonds for Adams County Hospital Authority for Mary Lanning Memorial Hospital. The Chairman opened the hearing and asked all parties interested in speaking to step forward. Parker Schenken of Baird Holm Attorneys, bond counsel for Mary Lanning addressed the Board about the intent of the bonds to use for remodeling new construction and refunding of current bonds. W. Mike Kearney, CEO of Mary Lanning Memorial Hospital, told the Board that the $30 million project is for re-functioning of the hospital, a new 7 story tower on the north, 2 new floors to the south and replacement of all windows. All patient rooms will be private. The project will take 3 to 3 ½ years to complete and if they can sell the bonds they hope to start in June or July. No one else spoke and the Chairman declared the hearing closed. Motion by Hynes, seconded by Kehoe to approve the issuance of TEFRA bonds for Mary Lanning Memorial Hospital and authorize the signing of resolution 08-04-15.1. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Coleen Sedlacek, Executive Director of Adams County Senior Services, presented her transportation budget request for 2008-2009. She told the Board she is budgeting for $4.00 per gallon gas this year. She has made the request for funding through United Way but does not know at this time how much United Way Funding she might receive. She hopes at least $10,000.00 which would make Adams County’s portion of her budget request at $40,000.00. She stated that she has $9155.00 from gas tax refund money to use towards the purchase of a new bus this year and will have a balance of over $4000.00 to use next year. Motion by Orthmann, seconded by Larson to approve the transportation budget request for 2008-2009 and authorize the Chairman to sign all necessary documents. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Attorney Perkins presented the grant application of Victim Witness program for funding from the Crime Commission and asked for Board approval. Saathoff left at 10:26 AM. Motion by Hynes, seconded by Larson to approve and authorize the Chairman to sign the grant application for the Victim Witness program. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann and Woodman. Nays, none. Neumann and Saathoff, absent. Saathoff returned at 10:30 AM. At 10:30, Beth Baxter, Director of Region III, addressed the Board about proposed funding of Region III for 2008-2009 . It appears that Adams County portion of funding will increase by about $20,000.00. The Board discussed with her their frustration about the mental health program and the costs to the counties since the state has eliminated Hastings Regional Center and made fewer beds available for EPC patients. Some other issues discussed were the determination of residency and county of financial responsibility. At 11:05 the Board discussed the bids received for the 2008 Overlay projects. Neither bid received met the specifications set out in the bid documents so the Board had the right to reject all bids and negotiate for the projects. Since the four projects were not tied to each other, Miller could negotiate on each project individually, however since three projects would need participation from the City of Hastings and no interlocal agreement is currently in place for those projects it leaves the Assumption Road project the only one available for negotiations. Motion by Larson, seconded by Hynes to decline all bids received for the 2008 Overlay projects. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Motion by Larson, seconded by Hynes to direct Dawn Miller, Highway Superintendent, to negotiate overlay costs of Assumption Road for 1.01 miles for completion in October 2008 and other original specifications of the bid. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Motion by Orthmann, seconded by Saathoff to move to Executive Session for discussion of County Burial Assistance. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Entered Executive Session at 11:27 AM. Motion by Saathoff, seconded by Larson to return to regular session. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:50 AM. The Chairman announced that the only discussion in Executive Session was about a County Burial request. Motion by Saathoff, seconded by Orthmann to deny the claim from Washington County for County Burial Assistance. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent. Motion by Larson, seconded by Orthmann to approve claims and authorize the County Clerk to pay the same from their respective funds. Motion by Kehoe, seconded by Hynes to accept officers reports for the month of March from the County Clerk, Register of Deeds, Treasurer and Sheriff. Roll call members present were Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Neumann was absent. Also present were County Clerk Lewis, Attorney Perkins, Assessor Hynes and Deputy Assessor Shane, Appraiser Kuhn and Treasurer Moeller. Motion by Kehoe, seconded by Saathoff to deny the request of Mosaic for 2008 Chevrolet Express lift van because the vehicle is domiciled in Hall County. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann, absent Motion by Orthmann, seconded by Kehoe that based on recommendation from Attorney Perkins the Board deny the real estate exemption request for property at 1914 W 8th St owned by the 1st Church of God. City Attorney Robert Sullivan presented information to the Board as to why the properties owned by the City of Hastings should retain an exempt status and not be placed on the tax rolls. His argument was that even though the City receives revenue by leasing the property for farming, the predominate use of the property is for public use and should maintain an exempt status. The City has filed protests on seven properties on which the Assessor has changed the status from exempt to taxable. Sullivan stated that the argument for all properties was basically the same. The primary use of the property is for public purpose and the City is not in the business of owning property unless it is for public use. The Board feels that the predominate use of property ID number 122-40.11 8-260.10 is for farming rather than public use and since the City receives revenue from this property it should be placed on the tax rolls. Motion by Saathoff, seconded by Hynes to uphold the Assessor’s recommendation to place property ID number 122-40.11 , known as the Well Field Addition on the 2008 tax rolls. Roll call, ayes: Larson, Hynes, Saathoff and Woodman. Nays, Kehoe and Orthmann. Neumann, absent. Motion by Saathoff, seconded by Hynes to approve the Assessor’s recommendation to place property ID number 8-260.10, known as the Wastewater Treatment Plant Sludge field on the 2008 tax rolls. Roll call, ayes: Larson, Hynes and Saathoff. Nays, Kehoe, Orthmann and Woodman. Neumann, absent. This motion ended in a tie and the Board asked the Attorney to research how to proceed with the decision on this property. The matter will be taken up later in the agenda. The Board recessed at 3:20 PM for the Attorney to recess the manner in which the Board should proceed regarding their tie vote on property ID number 8-260.10. The Board reconvened at 3:29 PM. Attorney Perkins told the Board that according to Roberts Rules of Order, which is what the Board uses for their meeting procedures, the tie vote is defeated and an a new motion needs to be made. Motion by Larson, seconded by Hynes to uphold the Assessor’s recommendation to place property ID number 8-260.10 known as the Wastewater Treatment Plant Sludge Field on the 2008 tax rolls.
