HomeMy WebLinkAboutSP08-05-08COURTHOUSE HASTINGS NEBRASKA Tuesday, August 5, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann and Woodman. Saathoff was absent. Motion by Orthmann, seconded by Larson, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved as circulated. Kehoe met with the City regarding the Emergency Management budget and also had a Buildings and Grounds meeting this morning. Hynes also attended the budget meeting with the City and a Region III meeting on July 25th. Neumann attended the Fair opening, the 4-H auction and multiple fair functions and the Buildings and Grounds meeting this morning. Larson also attended the Fair opening and checked county roads about three different times last week and attended the Road Committee meeting this morning. Orthmann attended the Fair opening on July 23rd, a meeting of South Central Economic Development District in Central City on July 31st and a Buildings and Grounds meeting this morning. Woodman attended the Fair opening, met with Dawn Miller about the Road Dept budget, also met with the City about the Emergency Management budget and the Roads Committee meeting this morning. There were no public comments. Attorney Perkins provided information to the Board regarding a court order to refund taxes collected on Crosier Monastery. He reported that the time frame was over 7 years and the total refund was about $137,000.00 with the County’s portion about 420,000.00. He was asking the Board to approve refunding those taxes. Motion by Orthmann, seconded by Neumann to approve refunding of taxes to the Community Redevelopment Corporation for taxes paid over seven years on inflated value for property owned by developer Tom Lauvetz known as Crosier Monastery per court decision. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Saathoff, absent. Neumann stated that he had asked for the discussion regarding flex time for the courthouse to be placed on the agenda. He stated that it worked so well for the Roads Dept that perhaps it might be considered for the offices of the courthouse. Perhaps the Treasurer, County Clerk, Assessor and Register of Deeds could keep their office open until 7:00 PM on Thursdays and give some employees Friday afternoons off. This would be a way of rewarding the employees with some time off and also provide customers more opportunities to do county business. It was suggested that the officials discuss this issue and bring it back to the Board with their recommendations. Motion by Neumann, seconded by Kehoe to move to Board of Equalization for motor vehicle exemption applications and real estate corrections. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Entered Board of Equalization at 9:59 AM. Attorney Perkins reported that he had reviewed the bids for services of Secondary Public Defender that had been received from Langvardt and Valle and Whelan and Scherr. His recommendation was to accept the bid of Langvardt and Valle in the amount of $90,000.00. Motion by Kehoe, seconded by Hynes to award the contract for services of Secondary Public Defender to Langvardt & Valle in the amount of $90,000.00. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Perkins also discussed the Interlocal Agreements that Adams County has with 13 counties to provide mental health services on their behalf. He stated that he has revised and updated the agreements with the latest statutory revisions and the new hourly rate as determined by the Courts of $95.00 per hour. Motion by Hynes, seconded by Larson to approve the Interlocal Agreements as revised with 13 counties in Region III to provide mental health board services. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Perkins also told the Board that Region III had sent out a new Letter of Agreement for Board approval for year 2008-2009 and the previously required payment of mental health board costs through the Region has been removed. They have obtained additional funding through the State to off set the expenses the counties have for mental heath boards. Motion by Orthmann, seconded by Larson to approve the new Letter of Agreement with Region III for 2008—2009. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. The Board conducted their quarterly jail inspection next on the agenda. At 10:30 AM, Dee Haussler, director of Hastings Economic Development Corporation, presented information to the Board regarding property owned by BJN Manufacturing, Inc and a Community Block Grant and a loan from HEDC. He reported that BJN had completed their requirements for the block grant but has not repaid the total amount owed to HEDC Reuse Fund. The business has closed and the buildings are for sale. He has a buyer for the buildings and was asking the Board to give approval for Chairman Woodman to sign the request for the County Attorney to sign the Deed of Reconveyance. Motion by Orthmann, seconded by Hynes to authorize the Chairman to sign the request for Deed of Reconveyance of Man Properties LLC and direct County Attorney Daiss to release Deed of Reconveyance instrument # 20054004. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Motion by Neumann, seconded by Hynes to return to Board of Equalization for Tax List Corrections. Motion by Kehoe, seconded by Hynes to move to Executive Session for discussion of a county burial request. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Saathoff was absent. Also present were County clerk Lewis, Attorney Perkins, Assessor Hynes and Dee Thaut representing the Treasurer. Motion by Neumann, seconded by Hynes to approve motor vehicle exemptions for South Central Behavioral Services for a 2004 Dodge Intrepid, 2005 Chrysler Pacifica and a 2005 Chrysler Mini van. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Motion by Hynes, seconded by Orthmann to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. It was noted that the Assessor had not yet presented her corrections for approval. Motion by Hynes, seconded by Orthmann to rescind previous motion to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Assessor Hynes presented her corrections to the Board. Motion by Kehoe, seconded by Larson to approve removal of the improvement value on property owned by Lavina Saathoff. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Motion by Neumann, seconded by Orthmann to remove the value of a bin on property owned by Clair Hupf and place the value on property owned by Jason Hupf. Roll call, ayes: Kehoe, arson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Motion by Hynes, seconded by Orthmann to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Returned to regular session at 10:05 AM. The Board returned to Board of Equalization at 10:37 AM for action on Tax List Corrections. Motion by Larson, seconded by Neumann to approve and authorize the Chairman to sign Tax List Correction numbers 13445 through 13457. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, absent. Motion by Orthmann, seconded by Neumann to return to regular session.
