HomeMy WebLinkAboutSP10-07-08COURTHOUSE HASTINGS NEBRASKA Tuesday, October 7, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Saathoff, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved. Orthmann attended a South Central Economic Development District board meeting in Superior on the 25th and the open house at the Prairie Loft Center on Sunday. Larson attended an Extension Board meeting last Thursday evening and the Road Committee meeting this morning. Neumann attended the Planning & Zoning meeting last night. Hynes attended the Hastings Alcohol Coalition meeting and a Library Board meeting and the Road Committee meeting this morning. Saathoff attended the Mid NE Individual Services meeting on the 17th, a Chamber of Commerce meeting on the morning of the 18th, the Central District meeting on the 18th and also a Drug Court meeting on the 18th. He also explained about pharming parties that were discussed by the NE Public Safety organization at the Central District meeting. Kehoe attended a Buildings and Grounds meeting this morning and they discussed making the 1st floor restrooms ADA compliant. He also attended a radio meeting Holdrege and a CASA meeting. He reported that there would not be a meeting with the Emergency Manager today. He also reported that the old boiler in the Courthouse is ready to be cut up and moved out but they are waiting for the arrival of the new ones in case we should get a cold spell and have to heat the Courthouse. Woodman spent a half day inspecting county roads and attended the Road Committee meeting this morning. Dawn Miller, Planning Administrator, presented a resolution to vacate Avalon Subdivision at the request of the property owners, Noel and Joan Nienhueser. Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign Resolution 08-10-07 vacating Avalon Subdivision in consideration of approval of Nienhueser Acres Subdivision. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete resolution on file in the County Clerk’s office. Miller also told the Board that they need to be looking for a replacement to the Planning Commission as Pearl Davison is retiring due to health reasons after 11 years of service on the Commission. She reported that Bob Hansen who currently sits on the Commission as a representative for Kenesaw village would like to be the replacement for Ms Davison as he lives in that area. She asked the Board to look for a replacement on the Commission from the Kenesaw area as that part of the County is not currently represented. Hynes brought forward the discussion about revising the procedures for appointments to the LEPC. He told the Board that it would be easier if the LEPC board could make their own appointments but a revision of their bylaws would be needed. The consensus of the Board was to make the process as easy a possible and directed the LEPC to proceed to revise their bylaws. Motion by Kehoe, Seconded by Orthmann to move to Board of Equalization for real estate and motor vehicle exemption applications, to hear an appeal of a personal property penalty and set 2008 tax levies. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10:00 AM. Julie Nash, Senior Action director, updated the Board on the Foster Grandparent program. Senior Action became the agency to direct this program effective September 1, 2008. Hynes brought forward a discussion about the memorial dedication of a county road. He reported that he had been approached by a member of the Holstein Fire Dept about designating a portion of Holstein Ave in memory of a fallen soldier from Holstein. Dawn miller presented some information she had regarding the matter. The Board directed Miller to develop guidelines and bring them back to the Board. There was discussion of changing the order of roll call vote of the Board members, however Kehoe asked that the discussion be delayed as the Buildings and Grounds committee is researching the cost of an electronic roll call board and would like to have that information before the Board makes a decision. There was a discussion of setting a Board policy regarding the amount of expenditures for retiring employees and officials. County Clerk Lewis shared several policies from other counties that she had received. The Board directed the County Attorney to draft a resolution establishing such a policy and a public hearing date was set for November 18, 2008. The Board can make changes to the proposed policy at the time of the public hearing. Kehoe brought forth a discussion about the need to replace the cable and antennae for the handibuses. Currently they have difficulty reaching areas of the County outside of Hastings. It has been discovered that the problem is the cable to the antennae and not the repeater. He also would like to move the antennae to the new county tower. The cost would be between $3000.00 and $4,000.00. Motion by Kehoe, seconded by Neumann to approve replacement of the cable and antennae for the handibus radio systems for a cost not to exceed $5000.00. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis told the Board that the amount of balance in the County Bond Fund was incorrect when the Board approved Resolution 08-09-02 transferring the Bond Fund balance to the General Fund. When the Treasurer’s office transferred the amount stated in the resolution the Bond Fund was left with a deficit balance. She asked the Board if they wanted to write a corrected resolution. Motion by Neumann, seconded by Hynes to approve correction of Resolution 08-09-02 to reflect to correct amount of balance in the Bond Fund to transfer to the General Fund. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, Seconded by Neumann to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe to accept officers reports for the month of September from the County Clerk, Register of Deeds, Treasurer and Clerk of District Court. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 11:25 AM and reconvened at 11:30 AM. Motion by Kehoe, seconded by Larson to move to executive Session for personnel and office procedures. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 11:32 AM. Motion by Neumann, seconded by Saathoff to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:58 AM. The Chairman announced upon returning to regular session that the only discussion was about personnel and office procedures and no action was taken. Supervisors met as a Board of Equalization for the purpose of hearing real estate and motor vehicle exemption applications and an appeal of personal property penalty with Chairman Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorney Daiss, Assessor Hynes and Dee Thaut representing the Treasurer. Motion by Orthmann, seconded by Saathoff to approve the recommendation of the Assessor to exempt real estate owned by the Prairie Loft Center except a house, garage and one acre that are currently being rented. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Assessor Hynes stated that Evercom has appealed the 25% penalty assessed by her for late filing of their personal property statement. She explained that the Nebraska statutes do not give the Board the authority to waive the penalty. Motion by Saathoff, seconded by Hynes to deny the request of Evercom to waive the penalty assessed by the Assessor for late filing of personal property statement. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Larson, seconded by Neumann to approve and authorize the Chairman to sign Tax List Corrections numbered 13466 through 13471. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Orthmann to approve motor vehicle exemptions for YMCA for a 2002 Ford pickup and Headstart for 4 2008 Chevrolet Uplander vans.
