HomeMy WebLinkAboutSP09-16-08 (2) COURTHOUSE HASTINGS NEBRASKA Tuesday, September 16, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Larson, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved as circulated. Kehoe attended a Combined Services Committee meeting and also met with the Emergency Manager. They are looking at a new job status for Shelly Boden. Saathoff attended a Senior Action Board meeting on the 15 th at Noon and a Chamber Legislative Forum that evening. Hynes attended the Combined Services Committee meeting and the Roads Committee meeting this morning. He drove some of the county roads yesterday and reported that the Library Board is reviewing candidates for a new director. Neumann attended the United Way breakfast, the NACO Institute of Excellence. He reported that they discussed how county boards vote and most of them rotate their roll call. They also had a discussion about the processing of claims and the costs involved with the process. He was wondering what it costs Adams County to process one claim. On the 8th he attended a Meth Coalition meeting and the Planning Commission meeting. Larson attended a MAAA meeting last Thursday and an Extension Board meeting in the evening. He also attended the Road Committee meeting this morning and did a road tour yesterday. Orthmann attended a BID meeting on the 9th, a Senior Services meeting on the 10th in the morning. They are still working on the problem about the insurance coverage on the busses. He attended a Heartland Pet Connection meeting the evening on the 10th and a meeting of the Adams County Convention & Visitors Bureau on the 11th. Woodman attended the Combined Services committee meeting last Wednesday morning and met with the Highway Superintendent and some landowners in the afternoon. He also attended the Institute of Excellence in North Platte, did a road tour of county roads and had a Road Committee meeting this morning. During public comments County Clerk Lewis told the Board that the officials and department heads have planned a barbeque for a fund raiser for United Way to be held on Tuesday, October 7 from 11:00 AM until 2:00 PM. The officials and department heads will be bringing salads & desserts and asked the Board members if they would contribute the meat. Everyone attending will be required to pay $5.00 and guests are welcome. A head count will be needed by September 30th. There was also a discussion of flex time and it was determined that the officials meet with the Board to discuss the matter. It will be placed on the agenda for discussion on October 21, 2008. Dawn Miller, Highway Superintendent, presented the 2007-2008 Year End Road Report to the Board for their approval. She explained the contents and asked for questions. Motion by Larson, seconded by Hynes to approve and authorize the Chairman to sign the 2007-2008 Year End Road Report to be placed on file with the County Clerk and the Nebraska Dept of Roads. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Attorney Daiss presented the contract for the services of Secondary Public Defender with Langvardt & Valle for approval and signing. She stated she had reviewed the contract and found nothing to change. Motion by Saathoff, seconded by Orthmann to approve and authorize the Chairman to sign the contract with Langvardt & Valle for the services of Secondary Public Defender effective January 2009. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:00 AM Lee Hogan and Sandy Himmelberg presented the 2008-2009 Ag Society budget to the County Board. Hogan pointed out some in formation in the budget and answered several questions.. The Board thanked them for informing them about their budget and commended them on the good job the fair board does. At 10:15 AM Dawn Miller, Planning Administrator, presented a request from Glenwood Telephone Co. to extend their Conditional Use Permit for another year in order to complete their project. Motion by Saathoff, seconded by Larson to grant a year extension to Glenwood Telephone Co. of their Conditional Use Permit, case 07-10.1. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Miller also presented information to the Board on case 08-09.1, Woodman Subdivision, applicant Brent & Sarah Woodman. Chairman Woodman told the Board that he would abstain from any discussion regarding this case due to a relationship with the applicants. Motion by Neumann, seconded by Kehoe to approve case 08-09.1, Woodman Subdivision, applicants Brent & Sarah Woodman. Roll call, ayes: Kehoe, Larson Neumann, Hynes, Orthmann and Saathoff. Nays, none. Woodman, abstained. Miller also presented information on an administrative plat for C & E Witt Subdivision. Motion by Kehoe, seconded by Larson to approve the administrative plat of C & E Witt Subdivision, applicant Robert Kober. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:30 the Board considered the asphalt improvements to Marian Road based on the bid pricing received by the City of Hastings. Miller told the Board that she has negotiated some pricing with Werners. She got mobilization costs reduced from $12,000.00 to $9,000.00. She also reported that the core samples from Marian Road indicated sufficient oil to reuse the millings from 10% to 15%. Werners will also do shoulder work and seeding. Motion by Neumann, seconded by Kehoe to approve the asphalt overlay project on Marian Road from the railroad tracks to Highway 6 based on the negotiated price with Werner Construction on the price per unit as presented. Roll call, ayes: Kehoe, Larson, Neumann, Orthmann and Woodman. Nays: Hynes and Saathoff. Larson brought forth a discussion about creation of a Board policy for recognition of county employees. He stated that a long time employee will be retiring in the future and he was asked what the county policy was regarding payment of costs for recognition of such an employee. County Clerk Lewis told the Board that she had spoken to the director at Accountability & Disclosure and he had referenced NE statute 13-2202 which states that counties can expend up to $25.00 per employee per year for meals. The County Attorney’s office will research the matter and bring information back to the Board. Motion by Saathoff, seconded by Hynes to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Kehoe to approve Miscellaneous Receipts for the month of August in the amount of $1,022,780.19. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Orthmann to accept officers reports for the month of August from the Register of Deeds and the Clerk of District Court. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 10:45 AM and reconvened at 10:50 AM. Motion by Hynes, seconded by Orthmann to move to Executive Session for discussion of Road Dept personnel. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 10:55 AM. Motion by Larson, seconded by Saathoff to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. The Chairman announced that the only discussion in Executive Session was about Road Dept. personnel and no action was taken. Returned to regular session at 11:15 AM. Miller updated the Board on FEMA matters. This Board is adjourned.
