HomeMy WebLinkAboutSP10-21-08COURTHOUSE HASTINGS NEBRASKA Tuesday, October 21, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Orthmann, seconded by Larson, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved. Kehoe reported that the Buildings and Grounds Committee met this morning and the new boilers are here but not connected yet and bids were sent to two local vendors for an electronic voting board but no bids have been received as of today. He also attended a CASA meeting and Hastings Public Schools has asked CASA to assist them with the truancy problem they have. A special committee has been formed to research that issue. He also reported that the antennae and cable for the handibus radios will be moved to the new tower however they need to wait for a crew to climb the tower to do the installation. The Buildings and Grounds Committee also met with the Sheriff about putting up a building at the Roads Dept site for his patrol deputies and evidence storage. Saathoff had a Senior Action board meeting yesterday and a Chamber Ag Business meeting last Wednesday or Thursday. Hynes had two Library Board meetings. They did telephone interviews for a new director. Two of those will be coming to Hastings for interviews. He also had a regular board meeting on the 13th. Neumann attended the County United Way fund raiser dinner on the 7th, A South Heartland District Health Board meeting on the 8th, a Meth Coalition meeting on the 13th and helped with the softball tournament on the 15th & 17th. He and Orthmann also met with Colleen Sedlacek, director of Adams County Senior Services and Chuck Evans to discuss the future of the county handibuses. It would appear at this time that the Senior Services want to give up the operations of the handibuses. A Good portion of the reasoning for that is because of the issue that NIRMA has regarding the insurance coverage of those busses. He also met with the Buildings and Grounds Committee this morning. Larson had no report. Orthmann attended the Heartland Pet Connection open house and microchip clinic on the 11th as well as the meeting with Neumann, Sedlacek and Evans and the Buildings and Grounds Committee meeting this morning. Woodman reported that he, Orthmann and Hynes visited with the Sheriff after the last meeting about the auditors report. He also reported that the Road Committee will be meeting this afternoon. Kehoe also mentioned that the audit report states that the County should not make prepayment of cell phone service, however that is a problem for the Sheriff’s Dept as the due dates on the bills are always before the Board meets for approval of payment and the phones could be shut off by the vendor. He asked how this problem could be resolved. Carissa Uhrmacher, director of Community Wrap Around, presented an update on the juvenile services programs in Adams, Clay, Nuckolls and Webster Counties and how the grant money had been spent over the past year. She also reported that the current Juvenile Services plan expires this year and the member counties are currently in the process of writing a new plan. Melissa Eckhardt, Planning Assistant, presented two subdivision cases to the Board for approval. Motion by Neumann, seconded by Hynes to approve Nienhueser Acres Subdivision, case 08-10.1, applicants Noel and Joann Nienhueser with the same conditions as recommended by the Planning Commission.. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to approve Deaw Acres Subdivision, case 08-10.2, applicants Dennis and Elizabeth Ground with the same conditions as recommended by the Planning Commission. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Eckhardt also told the Board that Rick Rader would like to serve as the regular on the Board of Adjustments in the place of Lila Gamble who resigned. That would leave a need to find an alternate member for the Board of Adjustment. She also reported there is a need to find a representative for the Kenesaw area to the Planning Commission. Motion by Saathoff, seconded by Larson to appoint Rick Rader to the regular position on the Board of Adjustment for a term to expire August 16, 2009. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Joyce Mangers and Rick Cartier, new City Planner, presented a request for the Board to accept an easement for Hastings North Substation Subdivision. Motion by Larson, seconded by Orthmann to accept the easement of Hastings North Substation Subdivision. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann’s term on the South Heartland District Health Board is expiring and the Board needs to make an appointment to that Board. Neumann stated that he is willing to continue serving on that Board. The Board opened the discussion regarding extending the courthouse hours and the use of flex time. County officials present for the discussion were the Count y Attorney, County Clerk, Treasurer, Assessor, Register of Deeds and Clerk of the District Court. Clerk Lewis told the Board that the officials had discussed the matter in a meeting and each seemed to have their own thoughts regarding the matter. Treasurer Moeller told that Board that her office has always accommodated anyone wanting to do business with her office if they were in the courthouse after 5:00. She said however it would be a problem to stay after 5:00 as the state computer system is closed after 5:00 PM. Jan Johnson, Register of Deeds said that she is usually in the office by 8:00 or 8:30 and the abstractors who need to leave town come in during that time. She said if the Board wanted to extend hours, her office would work with it. Clerk of District Court Setlik stated that the only services she could offer after 5:00 PM would be passport applications as the judges would be gone after 5:00 and any protection orders filed would have to wait until the next day for the judge’s signature. Attorney Daiss stated that most of the time her office worked the hours of County Court which are 8:00 AM to 5:00 PM. Clerk Lewis reported that during the discussion by the officials that changing the hours of the courthouse from 8:00 AM to 5:30 PM would work better than staying until 7:00 PM one night a week. This however, creates a problem for the Sheriff and courthouse security. It would require and additional 7.5 hours for added security. Neumann stated this equates to about an additional $6000.00 per year and he is not interested in the county spending any more money to accomplish this. It was the consensus of the Board that this issue is closed unless it is presented by someone other than the Board or elected officials. Motion by Saathoff, seconded by Orthmann to re-appoint Neumann as the County representative to the South Heartland District Health Board for a three year term. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann abstained. Motion by Larson, seconded by Saathoff to accept the audit report from the state auditor for 2007-2008 fiscal year. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Larson to approve and authorize the Chairman to sign the final Victim Witness grant application and award. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis read into the record the corrected resolution for transfer of funds from the Courthouse Bond Fund to the General Fund. Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign Resolution 08-10-21.1 correcting Resolution 08-09-02. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Attorney Daiss presented three resolutions for foreclosure on tax sales certificates Motion by Orthmann, seconded by Kehoe to approve and authorize the Chairman to sign Resolution 08-10-21.2 for foreclosure on tax sales certificates 5242 through 5264. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Motion by Saathoff, seconded by Neumann to approve and authorize the Chairman to sign Resolution 08-10-21.3 for foreclosure on tax sales certificates 15157 through 15194. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Motion by Kehoe, seconded by Larson to approve and authorize the Chairman to sign Resolution 08-10-21.4 for foreclosure on tax sales certificates 4981 through 5003. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Saathoff brought forth a discussion of issuing a public statement and issuing a letter requesting the resignation of the treasurer in view of the recall process that has been implemented against her. He stated that the public has lost their trust in her. Kehoe and Woodman stated that they feel there is a process in place for removal of a public official and to let the voters have the opportunity to express their feeling by voting at an election. Saathoff stated that if he had a public statement prepared he would ask for a motion for issuing that statement but since he does not have a statement prepared he would let the matter drop. Motion by Orthmann, seconded by Neumann to move to Executive Session for discussion of tax litigation. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Executive Session at 11:05 AM. Motion by Neumann, seconded by Larson to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:45 AM. The Chairman announced that the only discussion was about tax litigation and no actions were taken in Executive Session. Motion by Kehoe, seconded by Orthmann to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Larson to approve Miscellaneous Receipts for the month of October in the amount of $506,044.23. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Hynes to accept officer reports for the month of September from the Sheriff and Treasurer. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board decided that since they will not be meeting on Tuesday, November 4, 2008 because that is the Presidential General Election, they will postpone that meeting to Monday, November 10, 2008. This Board is adjourned at 11:50 AM.
