HomeMy WebLinkAboutSP01-06-09COURTHOUSE HASTINGS NEBRASKA Tuesday, January 6, 2009 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Larson, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous meeting were approved as circulated. Orthmann attended a Buildings and Grounds meeting this morning. He also attended the retirement reception for Phelps County Supervisor Rodale Emken on the 23rd. He is in the process of gathering information about insurance for the handibuses. Larson attended the Road Committee meeting this morning. Neumann attended the Planning Commission meeting last night and the Buildings and Grounds meeting this morning. Hynes attended the Road Committee meeting this morning. Saathoff attended a Chamber of Commerce meeting and the Mid NE Individual Services meeting. He also sat in on a couple drug court proceedings. Kehoe attended the Buildings and Grounds meeting this morning and discussed the County phone system. It is only 8 years old so they decided to continue to patch the system because of the cost. The search for a building stands dormant for now as no one building was found to be suitable for both uses. He reminded the committee of a meeting with the Emergency Manager at 1:30 PM today. He also reported that the 1972 Jeep with a snow plow has been replaced and the Maintenance Dept would like to know what to do with it as it takes up room. The Buildings and Grounds Committee are to find a resolution to that issue. Woodman attended the Roads Committee meeting this morning. During the public comments portion of the meeting, Julia Moeller expressed her appreciation and gratitude to the Board for being fair and not listening to accusations about her. She felt that she has let the people of Adams County down and wanted to say thank you and she has done nothing wrong and will not be convicted. The Treasurer’s office is doing fine and she can’t find any turmoil in the office. Motion by Neumann, seconded by Orthmann, there being no further old business, we declare this Board adjourned sine die and appoint the County Clerk as temporary Chairman. Clerk Lewis asked for nominations for Chairman of the Board for 2009. Motion by Orthmann, seconded by Larson to nominate Larry Woodman as Chairman. Motion by Neumann, seconded by Larson that nominations cease. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Roll call vote on the motion to nominate Woodman. Ayes, Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Larson to nominate Neumann as Vice-Chairman. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann abstained. Motion by Kehoe, seconded by Hynes to name the following banks as Adams County depositories: Wells Fargo Bank, Heritage Bank, Hastings State Bank, Adams County Bank, Nebraska Public Agency Investment Trust (NPAIT) Five Points Bank and Bank of Doniphan. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Kehoe to authorize the County Treasurer to deposit funds in local banks: up to $2,500,000.00 in Wells Fargo Bank, up to $1,000,000.00 in Heritage bank, up to $1,350,000.00 in Hastings State bank, up to $2,775,000.00 in Adams County Bank, up to $6,000,000.00 in Nebraska Public Agency Investment Trust (NPAIT), up to $5,000,000.00 and up to $1,500,000.00 in Bank of Doniphan. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Hynes, seconded by Orthmann to give consent to County Treasurer to deposit 100% of capital stock and surplus in any of the depository banks named and said deposits to be protected by bonds and securities as required by law. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Larson to designate the Hastings Tribune as the legal newspaper for Adams County. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board members received a letter of resignation from Treasurer, Julia Moeller. With the acceptance of this resignation the need for the Recall election scheduled for January 27, 2009 is negated. Motion by Saathoff, seconded by Larson to accept the resignation of Treasurer, Julia Moeller effective January 5, 2009. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller, Highway Superintendent, presented information to the Board about an agreement with Nebraska Dept of Roads to pay for the electricity used by and the maintenance of overhead lights at the intersection of Roseland Ave and Highway 6 after the completion of the Highway 6 resurfacing. Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign the agreement with the Nebraska Dept of Roads to pay for the electricity and maintenance of overhead lighting at the intersection of Roseland Ave and Highway 6. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Miller told the Board the needed to pass a Resolution confirming the agreement with the Dept of Roads. Motion by Hynes, seconded by Larson to approve and authorize the Chairman to sign Resolution 09-01-06.1. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County clerk’s office. At 10:00 AM the Board proceeded to open bids for 2009 asphalt overlay projects. Bids were received from the following bidders in the following amounts: Vontz Paving, Segment #1, $341,953.39, Segment #2, $454,900.37, Segment #3, $363,136.18, Segment #4, $52,800.00 with start date of April 2009 and complete date of July 2009; Werners Construction, Segment #1, $351,405.85, Segment #2, $516,543.16, Segment #3, $410,855.42, Segment #4, $38,016.00 with start date of may 1, 2009 and completion date of July 31, 2009. Her recommendation was to give the bids to the engineer for review and award the bids at the January 20, 2009 meeting. Motion by Orthmann, seconded by Neumann to move to Executive Session for personnel and possible litigation. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Also present were Attorneys Mike Gilmour, Pam Bourne (via conference call) law clerk Bill Troshynski, County Clerk Lewis and Deputy Treasurer Bev Davis. Entered Executive Session at 10:15 AM. Motion by Larson, seconded by Saathoff to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:30 AM. The Chairman announced that the only discussion in Executive Session was about personnel and possible litigation and no action was taken. Motion by Saathoff, seconded by Hynes to reappoint Dawn Miller as regular members and Dan Furman and Deanna Mead as alternate members to the County Grievance Board with terms to expire January 2013. Roll call, ayes: Kehoe, Neumann, Hynes, Saathoff and Woodman. Nays, none. Larson and Orthmann left the meeting at 11:30 AM and returned at 11:33 AM. Motion by Larson, seconded by Kehoe to approve and authorize the Chairman to sign Resolution 08-12-20 setting a policy for expenditures of County funds for employee recognition. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis and Attorney Daiss. Motion by Kehoe, seconded by Saathoff to approve and authorize the Chairman to sign Tax List Correction numbers 13481 through 13484 and 13486 through 13496. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Larson, seconded by Orthmann to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 11:43 AM. This Board is now adjourned.
