HomeMy WebLinkAboutSP01-08-08COURTHOUSE HASTINGS NEBRASKA Tuesday, January 8, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Larson, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved as circulated. Kehoe attended a CASA meeting. They have received a grant for a presenter at their spring meeting. He also reported that Claire Williams is retiring. The Buildings and Grounds Committee met this morning and looked a the new skid loader. He also asked for the opinion of other Board members regarding the purchase of a generator for the courthouse. The committee received a quote from Caterpillar of $2000.00 per month to have a generator on standby. To purchase a generator for the courthouse would cost about $135,000.00. Hynes attended the Road Committee meeting. Neumann attended a Midland Area Agency on Aging meeting last Thursday, the Planning & Zoning meeting last night and the Buildings and Grounds committee meeting this morning. He also announced that there will be an open house for Wayne Mousel on January 29th. Larson attended the MAAA meeting and the Road Committee meeting. Orthmann attended the Building and Grounds meeting. Woodman attended the Road Committee meeting. Motion by Neumann, seconded by Larson there being no further old business to declare this Board adjourned sine die and appoint the County Clerk as temporary Chairperson. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Clerk Lewis asked for nominations for Chairman of the Board for 2008. Motion by Larson, seconded by Saathoff to nominate Woodman for Chairman. Motion by Neumann, seconded by Larson that nominations cease. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Roll call on nomination of Woodman as Chairman: Ayes, Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Kehoe to nominate Neumann as Vice-Chairman. Motion by Larson, seconded by Orthmann that nominations cease. Motion by Neumann, seconded by Larson to name the following banks as Adams County depositories: Wells Fargo Bank, Heritage Bank, Hastings State Bank, Adams County Bank, Nebraska Public Agency Investment Trust (NPAIT) Five Points Bank and Bank of Doniphan. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Saathoff to authorize the County Treasurer to deposit funds in local banks: Up to $2,500,000.00 in Wells Fargo Bank. Up to $1,000,000.00 in Heritage Bank Up to $1,350,000.00 in Hastings State Bank. Up to $2,775,000.00 in Adams County Bank Up to $6,000,000.00 in Nebraska Public Agency Investment Trust (NPAIT) Up to $5,000,000.00 in Five Points Bank, and Up to $1,500,000.00 in Bank of Doniphan Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Motion by Kehoe, seconded by Orthmann to give consent to County Treasurer to deposit 100% of capital stock and surplus in any of the depository banks named and said deposits to be protected by bonds and securities as required by law. Motion by Hynes, seconded by Saathoff to designate the Hastings Tribune as the legal newspaper for Adams County. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Hynes to approve and authorize the Chairman to sign Resolution 08-01-08 setting salaries for the public defender and supervisors. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Woodman explained that the need for Executive Session for contract negotiations is cancelled as it dealt with the public announcement regarding the future of the chemical dependency unit at Hastings Regional Center and the offer by DHHS to Hastings to lease new facilities to keep the unit local. He stated that he asked Dee Haussler to give more information to the Board when he appears on the Agenda. Haussler, Economic Development Director, asked the Board to release 20% increments of seven properties in County Industrial Areas for the year 2008. Motion by Saathoff, seconded by Neumann to approve the release of the following properties from County Industrial Areas in 20% increments for 2008 as follows: ECHO Company, first 20%; L & H Manufacturing, first 20%; Pepsi Cola Bottling Co., second 20%; Eaton Corporation, second 20%; Nebraska Cold Storage, second 20%; Van Diest Supply Company, second 20%; and AGP, third 20%. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete legal description on file at the Register of Deeds and County Clerk’s offices. Haussler also presented an application from Chief Ethanol Fuels requesting the County to approve the designation of a County Industrial Area of approximately 95 acres. Kehoe left at 10:25 AM. Motion by Larson, seconded by Neumann to accept the application and set the date for a public hearing on the request of Chief Ethanol Fuels for a County Industrial Area designation of approximately 95 acres described as a tract of land in the South ½ of Section 10, Township 7 North and Range 9 West of the 6th Principal Meridian, Adams County, Nebraska with a detailed legal and map available in the County Clerk’s office for February 19, 2008 at 10:30 AM. Roll call, ayes: Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Kehoe absent. Haussler continued to give the Board more information regarding the proposal to Hastings from DHHS and the juvenile chemical dependency unit at the Hastings Regional Center. Kehoe returned at 10:30 AM. The Board proceeded to discuss the resignation of Clerk of the District Court, Sue Nieto. Clerk Lewis told the Board they must fill the position within 45 days of the vacancy. There was debate whether or not the vacancy needed to be publicly known if deputy in the office wanted the position and the Board appointed her to that position. Neumann provided information that said it was not necessary to advertise the position, however Attorney Perkins said all interviews and discussion regarding the selection process needed to be in open session. Motion by Larson, seconded by Orthmann to advertise the opening for Clerk of the District Court with applications to be submitted to the County Clerk’s office by Friday, February 1, 2008 at 5:00 PM at which time the Personnel Committee would review the applications and make recommendations to the Board for possible applicants to interview. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Woodman left at 10:42 AM and returned at 10:45 AM. Motion by Neumann, seconded by Larson to approve claims and authorize the County Clerk to pay the same from their respective funds with the exception of the claim to Platte Valley in the amount of $42.50 which Kehoe asked to be withheld. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Larson to accept Miscellaneous Receipts for the month of December in the amount of $407,599.52. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Larson, seconded by Neumann to accept officers reports for the month of December from the Register of Deeds, County clerk and Sheriff. Beverly Johnson Deputy COURTHOUSE HASTINGS NEBRASKA Tuesday, January 8, 2008 The Adams County Cemetery Association held their annual meeting in conjunction with the regular Board meeting with Chairman Larry Woodman presiding. Trustees present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Kehoe. Also present were County Clerk Lewis and Attorney Perkins. Minutes of the previous meeting held on January 16, 2007 were approved. Lewis reported there were no burials in the county cemetery in 2007. Under old business there was continued discussion of the condition of the cemetery and the erosion problem. Neumann and Larson resolved to speak to the landowner to the east of the cemetery about his encroachment on to county property. Saathoff left at 11:15 AM. Motion by Neumann, seconded by Orthmann to name the following as Trustees for 2008: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, and Woodman. Nays, none. Saathoff absent. Motion by Neumann, seconded by Hynes to adjourn the annual meeting of the cemetery association.
