HomeMy WebLinkAboutSP02-19-08COURTHOUSE HASTINGS NEBRASKA Tuesday, February 19, 2008 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous regular meeting were approved as circulated. Kehoe attended a Buildings and Grounds meeting this morning. They reviewed equipment prices with Harold Johnson but will wait until closer to the end of the fiscal year before deciding to make any purchases. Saathoff attended the NIRMA and NACO meetings in Kearney on February 6th through the 8th. He also attended the Post Office Safety Award presentation. On the 11th he attended Drug Court Council in Grand Island. They toured the new Hall County law enforcement facility. He also attended an RSVP meeting at Good Samaritan Village. Hynes attended the NACO meeting in Kearney, a tour of the county roads earlier in the week and a Road Committee meeting this morning. Neumann attended the NIRMA and NACO meetings on the 6th and 7th and the first meeting of the Institute of Excellence. On the 11th he attended a Meth Coalition meeting and met the new Executive Director, Betty Vertin and on the 14th he attended a Midland Area Agency on Aging meeting and reported that Dianne Fowler is doing a good job. Larson attended the NIRMA and NACO meetings, the MAAA meeting and the Road Committee meetings. Orthmann attended the NIRMA and NACO meetings, the Meth Coalition meeting on the 11th, a BID meeting on the 12th, Adams County Senior Services on the 13th, Heartland Pet Connection on the 14th, RSVP on the 18th and a Buildings and Grounds Committee meeting this morning. Woodman attended the NIRMA and NACO meetings and was able to talk to Chris Peterson regarding the County’s concerns about the Regional Center and our mental health costs. He also attended the Road Committee meeting this morning and also gave a report on the budget and expenditures to date. Kehoe reported that the utilities of the county buildings has almost doubled and he also attended a CASA meeting on policies but they will meet again as they did not have a quorum. There were no public comments. At 9:45 AM the Highway Superintendent, Dawn Miller, opened gravel bids. Motion by Larson, seconded by Neumann to table the awarding of gravel bids until the meeting on March 4, 2008 to enable the Highway Superintendent to review the bids received. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. At 10:00 AM the Board held a public hearing for the County One and Six Year Road Plan. Dawn Miller reviewed the plan for the Board members and noted some additions to the plan. There was a change to Form 8 which lengthens a project to ¾ of a mile and three changes to Form 9, which include the addition of two bridges and some additional maintenance projects. Willis Hunt of 616 Madden Road addressed the Board about the plan. He requested that the County add resurfacing of Marian Rd from Highway 6 north to the Burlington Northern Santa Fe Railroad crossing. He stated that a traffic count done in 2006 determined that 2900 people per day use this road to access the City of Hastings. He asked the Board to add it to the County One and Six Year Plan. Curt Oerter representing the Smokey hill Homeowners Association asked the Board to place paving 1000 feet of Prairie Lake Rd on the One and Six Year Plan like the paving that the County had done on Idlewilde Rd. No one else appeared to speak and the hearing was closed. Motion by Neumann, seconded by Kehoe to amend the County One and Six Year Road Plan and add resurfacing of Marian Rd from Highway Six north to the BNSF crossing to the One Year Plan and paving of Prairie lake Rd near Smokey Hills Rd to the Six Year Plan. Roll call, ayes: Kehoe, Larson, Neumann, Orthmann, and Saathoff. Nays, Hynes and Woodman Motion by Kehoe, seconded by Saathoff to approve the County One and Six Year Road Plan as amended. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board recessed at 10:30 AM and reconvened at 10:35 AM. The Board held a public hearing on the request of Chief Ethanol Fuels to add about 95 acres to the County Industrial Area. Dee Haussler, Executive Director of Hastings Economic Development Corporation addressed the Board regarding the request. County Clerk Lewis told the Board that the Notice of Public Hearing regarding the request has been published three times as required by statute and the City of Hastings has approved the addition of the land to the County Industrial Area. Lewis also told the Board that Shane Perkins of the County Attorney’s office and Bob Sullivan, City Attorney, have reviewed the Resolution. Motion by Saathoff, seconded by Hynes to approve and authorize the Chairman to sign Resolution 08-02-19 approving the request of Chief Ethanol Fuels to add about 95 acres to the County Industrial Area. Bob Horton, Chief Probation Officer for District Seven addressed the Board regarding LB 1130. He told the Board that this bill as introduced would split probation as it now is and would place the supervision under the Dept of Corrections. New staff would have to be hired and the parole officers who currently pay rent for county supplied space would have to be provided space by the county at county cost. This bill was introduced at the request of the Governor as there are funds available in Dept of Corrections that are not assessable to the Executive branch of government. Horton will keep the Board advised on the movement of the bill. Motion by Kehoe, seconded by Orthmann to move to Board of Equalization for real estate and motor vehicle exemption application and Tax List Corrections. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 11:00 AM. Dawn Miller, Planning Administrator, presented subdivision applications for Board approval. Motion by Kehoe, seconded by Saathoff to approve the final plat for Flat Creek Subdivision, case 08-01.3, applicant, James Hartman. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Hynes, seconded by Orthmann to approve The Ranch Subdivision, case 08-02.1, applicants, Wayne and Vicki Nienhueser Revocable Trusts. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Saathoff to approve the Bostock Subdivision, case 08-02.2, applicant Clint Bostock. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Larson to approve Hull Subdivision, case 08-02.3, applicants, Clarence H. Blomenkamp Family Trust. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. County Clerk Lewis told the Board that the County has received a request from the Nebraska Dept of Roads for surveyor services to locate corners for project NH 6-4(121). Motion by Neumann, seconded by Hynes to approve and authorize the Chairman to sign the contract with Nebraska Dept of Roads for the surveyor services for Project NH6-4(121). Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Neumann addressed the Board regarding LB 395, Senator Johnson’s bill for a statewide smoking ban. He said that Senator Burling has taken a position of opposition against the bill. He asked the Board if they were interested in supporting the bill and if they wished to send a letter to Senator Burling asking him to support the bill. Motion by Saathoff, seconded by Neumann to approve and authorize the chairman to sin a letter in support of LB 395 to be sent to Senator Burling.  Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Miller presented a resolution to the Board about placing weight restriction on paved roads in Adams County in an effort to prevent damage to the roads due to the thawing of the ground. There was discussion regarding addition of roads and increasing the maximum weight on some roads. Motion by Larson, seconded by Hynes to approve and authorize the Chairman sin Resolution 08-02-19.1 placing weight restrictions on paved roads in Adams County as amended. Hynes asked why the 20 ton restriction on Showboat couldn’t run all the way to Highway 74 and that would give truckers the ability to go east or west from there. Larson withdrew his motion and Neumann concurred. Motion by Larson, seconded by Neumann to approve and authorize the Chairman to sign Resolution 08-02-19.1placing a 20 ton weight restriction on Showboat Blvd from “J” St to Highway 74 and Assumption Rd from Showboat Blvd east to the Clay County line effective March 1, 2008. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Motion by Saathoff, seconded by Larson to approve and authorize the Chairman to sign Resolution 08-02-19.2 setting weight restrictions of 15 ton on designated county roads. Motion by Kehoe, seconded by Orthmann to approve claims and authorize the County Clerk to pay the same from their respective funds. Motion by Larson, seconded by Saathoff to Approve Miscellaneous Receipts for the month of January in the amount of $1,439,107.34. Motion by Larson, seconded by Kehoe to approve officers reports for the month of January from the Register of Deeds and the Sheriff. The Board recessed at 11:45 AM and reconvened at 1:30 PM to interview candidates for the vacant position of Clerk of the District Court. The candidates interviewed were Chrystine D. Setlik, Barb Beran, Priscilla Pekas, Amy Jo Nelson and Lucas Kliewer. Motion by Larson, seconded by Orthmann to appoint Chrystine D. Setlik as Clerk of the District Court for the unexpired term to begin March 1, 2008 and end January 2011. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none.
