HomeMy WebLinkAboutSP04-21-09COURTHOUSE HASTINGS NEBRASKA Tuesday, April 21, 2009 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Orthmann, seconded by Neumann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the previous meeting were approved. Kehoe reported that the CASA Spring Fling is tomorrow, April 22nd, the weather meetings were well attended, and the Drivers Examiner will be installing new equipment on April 22, 23 and 24th. Saathoff attended a Senior Action Board meeting on the 20th and a Chamber Ag Business meeting on the 16th. Hynes attended a meeting at Hastings Area Council on Alcoholism on the 20th, a weather meeting on the 7th and a Roads Committee meeting this morning. Neumann attended an Executive Board meeting of Midland Area Agency on Aging on April 9th and a meeting of the Ron Gardner Meth Coalition. Larson attended the MAAA Executive Board meeting and the Roads Committee meeting. Orthmann had a meeting of Adams County Senior Services on the 18th and a meeting of Adams County Visitors and Convention Bureau on the 19th. Woodman attended the DARE graduation at Kenesaw on the 7th, observed operations of a track loader at the Roads Dept on the 8th, gave a presentation to Leadership Hastings on county government on the 15th and attended the Roads Committee meeting. During the public comments portion of the agenda Dawn Miller, Highway Superintendent, announced that Adams County is the recipient of federal stimulus money for project BRO-7001 (4), known as Juniata SW. She also reported that another project, STPE-2175(9), known as Ayr SE is on the waiting list and could be approved if some of the other counties projects don’t go through. She also updated the Board on the overlay project on Showboat Blvd. Chief Thoren appeared on behalf of Betty Vertin of the Ron Gardner Meth Coalition and asked the Board to pass a Resolution declaring May as Meth Awareness Month in Adams County. Motion by Neumann, seconded by Larson to approve and authorize the Chairman to sign Resolution 09-04-21.1, declaring May as Meth Awareness Month in Adams County. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County clerk’s office. Chief Thoren also presented an Interlocal Agreement to the Board for approval to apply for $53,444.00 in Justice Assistance Grant. The County would receive $10,000.00 of these grant funds. Motion by Hynes, seconded by Saathoff to approve and authorize the Chairman to sign the Interlocal Agreement with the City of Hastings for Justice Assistance Grant funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Attorney Mike Gilmour presented an application for a Victim Witness Grant for approval. These funds are used to fund the Victim Witness Unit in the County Attorney’s office. Motion by Hynes, seconded by Orthmann to approve and authorize the Chairman to sign the application for grant funds for the Victim Witness Unit in the County Attorney’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Attorney Troshynski presented the agreement for lease of the County’s transit vehicles to RYDE/Community Action Partnership. Motion by Saathoff, seconded by Kehoe to approve and authorize the Chairman to sign the agreement with RYDE/Community Action Partnership for lease of the County’s transit vehicles. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Orthmann read a letter from Randy Chick, director of the Community Redevelopment Authority, accepting the County’s offer to purchase property at 413 W 4th St Motion by Orthmann, seconded by Kehoe to approve the purchase of real estate at 413 W 4th St from the Community Redevelopment Authority in the amount of $10,000.00 to be paid from the Inheritance Fund. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Dawn Miller, Planning Administrator, presented subdivision cases to the Board for their approval. Motion by Hynes, seconded by Neumann to approve the Hupf Subdivision. Case 09-03.1, applicant Claire Hupf. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Orthmann, seconded by Hynes to approve and authorize the Chairman to sign Resolution 09-04-21.2 vacating the Saathoff Second Subdivision. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff abstained. Complete Resolution on file in the County Clerk’s office. Motion by Kehoe, seconded by Neumann to approve the Graham Subdivision, case 09-04.4, applicants Jesse Graham and Lee Saathoff. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann and Woodman. Nays, none. Saathoff, abstained. At 10:00 AM the Board held a public hearing for a Conditional Use Permit for Gary Vontz for a gravel pit, case 09-03.2. The Chairman opened the hearing and asked those wishing to speak to step forward. Sean Vontz of 115 E Paul St Hastings NE answered questions from the Board. No one else appeared and the hearing was closed. Miller provided information from the Planning Commission. Neumann asked if the whole quarter section would be authorized for pumping of gravel according to the way the application was submitted. Miller and Vontz both replied that the whole quarter was included in the application. Motion by Kehoe, seconded by Saathoff to approve the Conditional Use Permit a gravel pit, case 09-03.2, applicant Gary Vontz. Roll call, ayes: Kehoe, Larson, Hynes, Orthmann, Saathoff and Woodman. Nays, Neumann. Motion by Kehoe, seconded by Neumann to approve and authorize the Chairman to sign Resolution 09-04-21.3 vacating the “R” Land Inc. Subdivision #3. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Marv Schultes and Marty Stange of Hastings Utilities presented information to the Board regarding their proposed boundaries for a Wellhead Protection Area for the City of Hastings. Motion by Neumann, seconded by Larson to approve the Hastings Wellhead Protection Boundaries map as presented by Hastings Utilities Director, Marv Schultes and Marty Stange to proceed to resolution to formally establish the boundaries. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Mike Atchity, Dan O’Grady and Shawn Miller presented information to the Board regarding the current county phone system. Dan O’Grady stated that the current system is at maximum usage and the Telrad Company no longer supports any upgrades. The parts are hard to get and the system is outdated. Shawn Miller presented information on a new system available through Windstream called Siemans HiPath 3800. It is a bigger system and can be enlarged to meet the County’s needs. Mike Atchity presented information on the Windstream Shield program and pricing options. He presented a quote of $91,990.00 with annual maintenance of $6,249.60. This would only replace our current phone hardware and give the County the ability to expand the phone service but does not include any costs for the expansion. The Board recessed at 11:20 and reconvened at 11:25 AM. Motion by Orthmann, seconded by Neumann to move to Board of Equalization for motor vehicle exemption applications and Tax List Corrections. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Larson, absent. Entered Board of Equalization at 11:25 AM. Motion by Neumann, seconded by Orthmann to approve claims and authorize the County clerk to pay the same from their respective funds. Motion by Saathoff, seconded by Larson to accept Miscellaneous Receipts for the month of March in the amount of $472,667.36. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Hynes, seconded by Kehoe to accept officers reports for the month of March from the Sheriff and Register of Deeds. Roll call, ayes: Kehoe, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, Larson. Motion by Larson, seconded by Saathoff to move to Executive Session for personnel and the donation of sick leave. Also present were County clerk Lewis, Highway Superintendent Miller and Register of Deeds Johnson as well as attorneys Gilmour and Troshynski. Entered Executive Session at 11:40 AM. Motion by Saathoff, seconded by Hynes to return to regular session. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Returned to regular session at 12:14. The Board recessed at 12:30 PM and reconvened at the ACOB Assembly Room at 1:30 PM for a work session with elected officials and department heads. Shannon Bird and Kim Wilder gave a brief presentation about the Relay for Life and asked the Board’s permission to do payroll stuffers and have a salad and dessert luncheon and a food drive. The Board, as well as the officials and department heads, gave unanimous approval. Danene Miller and David Hughes with US Bank gave a presentation on the NACO sponsored purchase card program. Everyone seemed to think the program was a good idea and Donna Fegler Daiss was directed to draft a resolution for Board approval to proceed with an application for the purchase card program. There was discussion regarding setting of a policy for a per diem for meals for county employees traveling on county business. The issue will be researched further. Larson asked if any officials had thought of salary increases. Sheriff Magee stated that he thought 2.5% was sellable to the Board and the public. Highway Superintendent Dawn Miller stated that she felt 3% was more in-line. The meeting was adjourned. exemption applications and approval of Tax List Corrections with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Also present were County Clerk Lewis, Attorneys Gilmour and Tryshenski and Shannon Bird of the Treasurer’s office. Motion by Saathoff, seconded by Larson to approve motor vehicle exemption applications for Good Samaritan Village Hastings for a 1999 Chevrolet Express bus and a 2006 Ford E 350 Super Duty Van. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Saathoff to approve and authorize the Chairman to sign Tax List Corrections numbers 13502 through 13507.
