HomeMy WebLinkAboutSP07-07-09COURTHOUSE HASTINGS NEBRASKA Tuesday, July 7, 2009 A regular meeting of the Adams County Board of Supervisors was held as per public notice given with Chairman, Larry Woodman, presiding. Roll call members present were: Kehoe, Larson, Neumann, Hynes Orthmann, Saathoff and Woodman. Motion by Neumann, seconded by Orthmann, that this meeting is a regular meeting of the Adams County Board of Supervisors and public notice of this meeting has been given by publication in the Hastings Tribune and by posting. An agenda was available to the members and an agenda was kept currently amended and posted in the County Clerk’s office. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Chairman announced the locations of the open meetings law and agendas in the room. Minutes of the last meeting were approved. Becky Sullivan, Wellness Coordinator with Mary Lanning Memorial Hospital, gave a Power Point presentation to the Board and elected officials about the benefits of a Worksite Wellness Program to the County. She answered several questions about starting a Wellness Program for the County employee; the first step would be to assemble a Wellness Committee. The elected officials were asked to let the County Clerk know if they or any of their employees were interested in serving on the committee. Kehoe attended a Buildings and Grounds Committee meeting and reported that there was damage to the roof of The Bridge property at 907 S Kansas Ave. The County is currently carrying the property insurance while this property is still under contract for purchase. They have one bid for repairs and will get others. Saathoff had no report. Hynes attended a Road Committee meeting on June 30th. Neumann attended the Planning Commission meeting last night and also the Planning Comprehensive Plan workshop last week and the Buildings and Grounds meeting this morning. Larson attended the Road Committee meeting on the budget and they also visited some bridges near Pauline in the afternoon. Orthmann moved an obsolete handibus from the Senior Services to the Road Dept last week and also attended the Buildings and Grounds Committee meeting this morning. Woodman attended the Road Committee meeting and announced the Combined Services Committee will be meeting Wednesday morning. Spencer Nelsen, USDA Wildlife Specialist, presented the annual report of animal control projects in Adams County and his funding request for 2009-2010. Motion by Neumann, seconded by Larson to approve the funding request from USDA Wildlife Services for animal damage control for 2009-2010 in the amount of $8954.00 and authorize the Chairman to sign the contract. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Loren Uden, Emergency management Director, requested that the Board accept 2 funding grants from the State for Local Assistance for 2009-2010 Emergency management in the amount of $61,230.00 plus additional funding for 2008-2009 in the amount of $16,388.40. This additional funding will cover the cost of a 2003 Ford F350 purchase from federal surplus to be used to pull the department trailers. Motion by Saathoff, seconded by Kehoe to accept the 2 grants from the State for funding of local emergency management and authorize the Chairman to sign. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Kehoe, seconded by Larson to move to Board of Equalization for motor vehicle exemption applications and Tax List Corrections. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Entered Board of Equalization at 10:37 AM. Dawn Miller, Highway Superintendent, presented a Financial Management System Certificate to the Board for approval. She stated that this document needed to be approved and signed prior to receiving any federal funding. The document certifies that the County complies with GASB45 regulations for audit purposes. Motion by Larson, seconded by Hynes to approve and authorize the Chairman to sign the Local Public Agency Financial Management System Certification. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Miller also presented Resolution for approval that designates Adams County, the Local Public Agency, authorized to receipt federal funds. Motion by Kehoe, seconded by Neumann to approve and authorize the Chairman to sign Resolution 09-07-07, authorizing Adams County to receipt federal funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Complete Resolution on file in the County Clerk’s office. Miller also presented additional Interlocal Agreements with townships for approval. Motion by Saathoff, seconded by Hynes to approve and authorize the Chairman to sign Interlocal agreements with Little Blue Township for maintenance, and Juniata and Zero Townships for maintenance and gravel. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Orthmann requested approval of Donna Hastings for appointment to the Adams County Convention and Visitors Bureau. Motion by Orthmann, seconded by Kehoe to appoint Donna Hastings to the Convention and Visitors Bureau Board for a three year term to expire in June 2013. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. There was a discussion regarding the recently purchased Caterpillar motorgrader. The machine has had numerous problems and the operator of the machine is not happy with the way it performs. Other operators of motorgraders in the Highway Dept have black balled the machine and don’t care to operate it either. It has been discovered that the machine was manufactured in Brazil and the bids specifications required that it be American built. Murphy Tractor has offered to give the County a new John Deere for that Caterpillar plus $5000.00. The County Attorney advised that if the Board changes machines other than Caterpillar, the equipment needs to go to public bid. The discussion was delayed to be continued later on the agenda after budget presentations in hopes that the salesman from Caterpillar could be present to answer questions. Motion by Neumann, seconded by Hynes to approve claims and authorize the County Clerk to pay the same from their respective funds. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Saathoff, seconded by Orthmann to accept officers reports for the month of June from the County Clerk, Register of Deeds, District Court Clerks and Sheriff. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. The Board continued the meeting hearing budget presentations from Kaleena Fong of the Visitors Bureau, Sheriff Magee and the Jail budget, Ron Seymour and the Extension Office budget. The Board recessed at 11:55 AM and reconvened at 1:00 PM. Kehoe did not return. They continued budget hearings from Harold Johnson of Maintenance, Treasurer, Bev Davis, Register of Deeds, Jan Johnson, Assessor Diane Hynes, Data Processing, Ron Kucera, District Court Clerk, Chrys Setlik, County Court, Tom Hawes, District Judge, Stephen Illingworth, Surveyor, Tom Krueger, Roads, Weed and Planning, Dawn Miller, County Clerk, Chris Lewis and the County Board’s budget. The Board continued the discussion about the new Caterpillar motorgrader. Larry Schmidt, Caterpillar sales man was present. The Board told Schmidt they were not happy with the new machine, it is down nearly every week and it was manufactured in Brazil which was outside the bid specifications. They asked Schmidt what he would do about the problem. Schmidt apologized for the mistake but he would give a brand new machine, manufactured in America with 5 year warranty and 90 days delivery date. Attorney Daiss again advised the Board that if they wanted a different machine other than the Caterpillar, they would have to re-bid. They could, however, honor any warranty that would be on the Caterpillar. Motion by Saathoff, seconded by Larson to move to Executive Session for discussion of warranty contract on the 2008 Caterpillar. Roll call, ayes: Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Kehoe, absent. Entered Executive Session at 4:00 PM. Returned to regular session at 4:15 PM. The Chairman announced that the only discussion was regarding the warranty of the Caterpillar motorgrader and no action was taken. Motion by Neumann, seconded by Larson to accept Caterpillar’s offer to give a new machine at no cost to Adams County with a 5 year warranty and 90 day delivery date. Also present were County Clerk Lewis, County Attorney Daiss and Shannon Bird representing the Treasurer. Motion by Orthmann, seconded by Neumann to approve and authorize the Chairman to sign Tax List Correction 13512. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Larson, seconded by Neumann to approve motor vehicle exemption applications for Good Samaritan Society – Hastings for a 1999 Dodge Ram pickup and two vehicles for South Central Behavioral Services, a 2009 Toyota Camry and 2007 Toyota Camry. Roll call, ayes: Kehoe, Larson, Neumann, Hynes, Orthmann, Saathoff and Woodman. Nays, none. Motion by Neumann, seconded by Saathoff to return to regular session.
