The undersigned, being first duly sworn upon oath, depose and state as follows, to-wit:
1. That Roger L. Schukei and Cheryl K. Schukei, husband and wife, are the owners and currently in
possession of the following real estate:. The Northwest Quarter (NW/4) of Section Thirty-one (31), Township
Seven (7) North, Range Eleven (11) West of the 6°i P.M., Adams County, Nebraska, and aone-third interest in the
Northwest Quarter (NW/4) of Section Thirty (30), Township Seven (7) North, Range Eleven (11) West of the 6°i
P.M., Adams County, Nebraska.
2. That Phyllis A. Johnson and Burdett E. Johnson, wife and husband, are the owners and currently
in possession of the following real estate: The West Half of the Southwest Quarter (W/2 SW/4) of Section
Twelve (12), Township Six (6), Range Twelve (12), West of the. 6`h P.M., Adams County, Nebraska, and aone-
third interest in the Northwest Quarter (NW/4) of Section Thirty (30), Township Seven (7) North, Range Eleven
(11) West of the 6°' P.M., Adams County, Nebraska.
3. That Valerie J. Schukei, a single person, is the owner and currently in possession of the following
real estate: The Northeast Quarter (NE/4) of Section Thirty (30), Township Seven (7) North, Range Eleven (11)
West of the 6`I' P.M., Adams County, Nebraska, and aone-third interest in Northwest Quarter (NW/4) of Section
Thirty (30), Township Seven (7) North, Range Eleven (11) West of the 6'h P.M., Adams Courity, Nebraska.
4. That on March 11, 1982, an Oil and Gas Lease to Empire Oil Properties, Inc. was recorded as
Instrument No. 820613; assigned to Zeteo Corporation by Assignment of Oil and Gas Lease recorded April 1,
1982 as Instrument No. 820905; assigned to James P. Dawson (one-half percent) by Assignment of Oil and Gas
Lease recorded September 22, 1983 as Instrument No. 832727; all in the records of Adams County, Nebraska.
Said Oil. and Gas Lease states that the "lease shall remain in force for a term of ten years from this date, and as
long thereafter as oil or gas, or either of them" are produced.
5. Affiants state that there has never been any exploration for or production of oil, gas or other
minerals upon said premises and that they have not received any rental payments since the initial payment made
January 19, 1982.
