The undersigned, being first duly sworn upon oath, depose and state as follows, to-wit:
1. That Phyllis A. Johnson and Burdett E. Johnson, wife and husband, are the owners of the
following described real estate:
The East Half of the Southwest Quarter (E/2 SW/4) of Section Twelve (12), Township Six (6),
Range Twelve (12) West of the 6`h P.M., Adams County, Nebraska,
and that they are now in possession thereof.
2. That on February 26, 1976, a Survivorship Warranty Deed dated March 1, 1971 was recorded in
Book 318, at Page 382 iri the office of the Register of Deeds of Adams County, Nebraska. Said Survivorship
Warranty Deed states that the "Grantors reserve an undivided one-half (1/2) of all oil and gas royalty, royalty to
be paid on casinghead gas, for a term of twenty-five (25) years and. for as long thereafter as oil, gas, or
cashinghead gas is produced."
3. Affants state that there has not been any exploration for or production of oil, gas or other
minerals upon said premises since March 1, 1971.
