AND Wilma Schmidt, Successor Trustee of the Intervivos Trust of Laura Johnson, being first
duly sworn upon oath, depose and state as follows:
They are the owners of the following described real estate:
The Northwest Quarter (NW'/) of Section Thirty-five (35), Township Five (5)
North, Range Eleven (11), West of the 6°i P.M., Adams County, Nebraska.
That on January 27, 1982 an oil and gas lease was granted to Empire Oil Properties, Inc., for a
term often years from the date of the instrument, "and as long thereafter as oil or gas, or either
of them is produced from said land by the lessee". Said Lease was recorded March 11, 1982 as
Inst. No. 820624 in the office of the Register of Deeds of Adams County, Nebraska
That said Oil and Gas Lease was assigned to Zeteo Corporation reserving one half of one percent
overriding royalty by Assignment of Oil and Gas Lease recorded April 1, 1982 as Inst. No. 820905;
said reserved one half of one percent overriding royalty was then assigned to James P. Dawson by
Assignment of Oil and Gas Lease recorded September 22, 1983 as Inst. No. 832727; all in the office
of the Register of Deeds of Adams County, Nebraska.
Affiants state that there has never been any exploration foi• or production of oil, gas or other
minerals upon said premises.
Further Affiants saith not.
