NATHANIEL M. SHAPER and KELLEY A. SHAPER, Husband and Wife,
GRANTOR, in consideration of ONE DOLLAR AND OTHER VALUABLE
CONSIDERATION received from GRANTEE, STEVEN L. McWHIRTER and
NANCY J. McWHIRTER, Husband and Wife, conveys to GRANTEE as joint
tenants and not as tenants in common, the following described
real estate (as defined in Neb. Rev. Stat. 76-201):
The East 31~' of Lot Nine (9) and the West 8'~' of Lot
Ten (10), Block One (1), in Lewis' Subdivision of
Blocks 1, 8, 9 and 16 of Lewis' Subdivision of the NE's
of the SE1~ of Section 11, Township 7 North, Range 10
West . of the 6t" P. M. , in the City of Hastings, Adams
County, Nebraska, according to the recorded plat
thereof; AND also the strip of land 30' in width
adjoining said portions of Lots 9 and 10 above
described on the South being that portion of Third
Street adjacent thereto vacated by the City of
Hastings.
GRANTOR covenants .(jointly and severally, if more than one)
with GRANTEES that GRANTOR:
(1) is lawfully seised of such real estate and that it is free
from encumbrances except for easements and restrictions of
record;
(2) has legal power and lawful authority to convey the same;
(3) warrants and will defend title to the real estate against
the lawful claims of all persons.
