NO. d"~J424 Date - -~~ Time-~~if TER OF DEEDS NOTICE IS HEREBY GIVEN that on October 4, 2007, Jon E. Burchess and Terri L. Burchess, husband and wife, ("Sellers"), and Johnny Gomez and Rolinda Gomez, husband and wife, ("Buyers") entered into an agreement (the "Contract") in which Sellers agree to sell to Buyer and Buyer agrees to purchase from Sellers the following described real estate and all improvements thereon: Lot Four (4), Block Three (3), Bungalow Addition to the City of Hastings, Adams County, Nebraska; _ - and having a street address of 1915 West Third, Hastings, Nebraska (the "Premises") The terms and conditions of the agreement are specifically stated in the Contract. This Notice of Contract is intended only to provide record notice of the respective interests of the parties in said real estate. The purchase price for the Premises is payable over a 5 year term, with a final payment due from Buyer on October 4, 2012. The Contract designates Seiler & Parker, P.C., L.L.O., Attorneys at Law, Hastings, Nebraska, as Escrow Agent for this purchase. An executed copy of the Contract, a warranty deed conveying the Premises, and all other documents related thereto, have been deposited with the Escrow Agent. Upon payment of all principal and interest due and upon the performance of all the terms of the Contract by the Buyer, the Escrow Agent is authorized to deliver the Warranty Deed and other related documents to the Buyer, without any further action by Sellers. Seller shall pay all real estate taxes and special assessments levied against the Premises after the date of the Contract from funds received from Buyer, and notice of such taxes and assessments should be sent to Sellers at the address below. The Contract may not be assigned by Buyer without written consent of Sellers, but it may be assigned by Sellers upon 30 days' written notice to Buyer.
