A F F I D A V I T OF SCRIVENER'S ERROR
1. I, Garry McCubbin, hereby certify and affirm upon personal knowledge that I am the
Trustee for the Deed of Trust dated August 29, 1995 and recorded August 29, 1995 as Instrument
number 953205.
2. I hereby certify and affirm that a Substitution of Trustee executed by Kozeny and
McCubbin Trustee Company L.C., as attorney in fact to Wells Fargo Bank N.A., recorded October 4,
2007, as Instrument number 20074469 and the Notice of Default recorded October 4, 2007, as Instrument
number 20074470 regarding the property located at 730 S Chicago Avenue, Hastings, NE 68901.
3. I hereby certify and affirm that due to a Scrivener's Error, there existed an error
regarding the legal description, which appeared in the Substitution of Trustee and Notice of Default. The
legal description which read incorrectly stated the following:
LOT SIX (6) AND THE NORTH HALF (N/2) OF LOT SEVEN (7), BLOCK TWO (2), KELLER'S
ADDITION TO THE CITY OF HASTINGS, ADAMS COUNTY NEBRASKA, ACCORDING TO THE
RECORDED PLAT THEREOF.
4. I hereby certify and affirm that the following legal descriptions is the true and correct
legal description:
LOT SIX (6) AND THE NORTH HALF (Nl/2) OF LOT SEVEN (7), BLOCK TWO (2), KELLER'S
ADDITION TO THE CITY OF HASTINGS, ADAMS COUNTY NEBRASKA, ACCORDING TO THE
RECORDED PLAT THEREOF.
5. This affidavit is given to correct the legal description information reference in the
Substitution of Trustee recorded October 4, 2007, as Instrument number 20074469 and the Notice of
Default recorded October 4, 2007, as Instrument number 20074470 which contained the error described
above.
