NOTICE OFDEFAULTAND ELECTION TO.SELL
Notice of default and election to sell is given by Joseph H. Badami, Attorney for
Trustee, in accordance with the procedure set forth in a certain Deed of Trust dated
September 14, 2006 wherein SCOTT MICHAEL MILLER AND TARA D. MILLER,
husband and wife, are designated as Trustors, TIERONE BANK, a United States
Corporation, is designated as Trustee and Beneficiary. Said Deed of Trust was filed for
record in the Office of the Register of Deeds of Adams County, Nebraska on September 18,
2006 as Instrument No. 20064147. Said Deed of Trust grants to TierOne Bank, Trustee the
power of sale over the following described real estate:
The South Thirteen and One-Half feet (S 13 '/2') of Lot Two (2), and the North
Forty-Four and One-Half feet (N 44 '/2') of Lot Three (3), in Penfield's
Subdivision of Lot Eight (8) and the South One-Half (S '/2) of Lot Seven (7),
Block One (1), Buswell's Addition to the City of Hastings, Adams County,
Nebraska, according to the recorded plat thereof, more commonly known as
728 North Minnesota Avenue, Hastings, Nebraska 68901-4465
Further Joseph H. Badami, Attorney for Trustee, states that the said Trustors have
breached an obligation of said Deed of Trust by failing to pay the monthly payments of
principal and interest of Five Hundred Forty-One and 52/100 Dollars ($541.52) for the
months of November and December, 2007 and January, February, and March, 2008 plus
late charges. As a result of this breach, said Beneficiary has elected to exercise the
power of sale and to sell or cause to be sold, the aforementioned properly to satisfy the
obligation of the Trustee.
