ORDINANCE N0.4162
AN ORDINANCE OF THE CITY OF HASTINGS, NEBRASKA, CREATING
A STREET IMPROVEMENT DISTRICT WITHIN THE CITY OF HASTINGS
TO BE KNOWN AS STREET IMPROVEMENT DISTRICT NO. 2008-2;
DEFINING THE BOUNDARIES OF SAID DISTRICT AND PROPERTY
CONTAINED THEREIN; AND, PROVIDING FOR THE CONSTRUCTION
OF IMPROVEMENTS THEREIN.
BE lT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
HASTINGS, NEBRASKA:
Section 1. The Mayor and City Council of the City of Hastings, Adams County,
Nebraska, hereby find and determine that it is in the best interests of the City that East
Lochland Road from U.S. Highway 281 East to 436.00 feet East of North First Avenue,
including the intersections at U.S. Highway 281, Wildflower Avenue and North First
Avenue, be improved as hereinafter described; and that it is in the best interests of the
City of Hastings to create a street improvement district for the construction of the said
improvements.
Section 2. There is hereby created within the City of Hastings, Nebraska, a street
improvement district to be known and designated as Street Improvement District No.
2008-2, the outer boundaries of which shall contain the following property:
Beginning at the Southwest Corner of the South Half (S1/2) of Fractional Section 19,
Township 8 North, Range 9 West of the 6th P.M., Adams County, Nebraska; Thence
Northerly along the West line of said South Half (S1/2) a distance of 183.00 feet more
or less to a point; Thence Easterly along a line being parallel with and 183.00 ft. North
of the South line of said Fractional Section 19 a distance of 2,370.65 feet more or less
to a point on the East line of said South Half (S1/2), said East line also being the West
line of the Southwest Quarter (SW1/4) of Section 20, Township 8 North, Range 9 West
of the 6th P.ivi., Adams County, Nebraska; Thence continuing Easterly along a line
being parallel with and 183.00 feet North of the South line of said Southwest Quarter
(SW1/4) of Section 20 a distance of 1,196.00 feet more or less to the point of
intersection with the East line (extended northerly) of Lot 1, Block 2, Thom Subdivision
in the City. of Hastings, Adams County, Nebraska; Thence Southerly along said East
line (extended) a distance of 366.00 feet more or less to a point being 150.00 feet
South of the North line of said Lot 1; Thence Westerly along a line being parallel with
and 150.00 feet South of the North line of said Lot 1, the North line of Lot 4, Block 1 of
said Thom Subdivision and the North line of Lots 1 and 2 of Fleharty Subdivision a
distance of 1,196.00 feet more or less to a point on the West line of Lot 1 of said
Fleharty Subdivision, said West line also being the East line of the North Half (N1/2) of
Fractional Section 30, Township 8 North, Range 9 West of the 6th P.M., Adams County,
Nebraska; Thence continuing Westerly along a line being parallel with and 183.00 feet

South of the North line of said Fractional Section 30 a distance of 2,370.65 feet more or
less to a point on the West line of said Fractional Section 30; Thence Northerly along
said West line a distance of 183.00 feet more or less to the Point of Beginning,
Within said District, East Lochland Road from U.S. Highway 281 East to 436.00
feet East of North First Avenue, including the intersections at U.S. Highway 281,
Wildflower Avenue and North First Avenue, shall be improved by grading and
construction of 8 inch P.C.C. pavement, including curb and gutter, storm sewer, street
lighting and other necessary appurtenances.
Section 3. All of said improvements shall be constructed to the established grades
as fixed by ordinances of the City of Hastings, and shall be constructed in accordance
with plans and specifications to be prepared by the City Engineer, which plans shall be
approved by the Mayor and City Council. The improvements shall be made at public
cost, but special assessments shall be levied to reimburse the City for the cost of the
improvements as provided by law.
Section 4. Notice of the creation of said Street Improvement District No. 2008-2
shall be published in The Hastings Daily Tribune, a legal newspaper published in and of
general circulation within the City of Hastings, for three weeks after the publication of this
Ordinance.
Section 5. tf any section, paragraph, clause, or provision of this Ordinance shall
be held invalid, the invalidity of such section, paragraph, clause, or provision shall not
affect any of the other provisions of this Ordinance.
