This Agreement made this 1 ~thday of March, 2008, between First National Bank of Omaha, its
successors and/or assigns, ("Lender") and Hastings State Bank ("Bank") a national banking association with
offices at Hastings, Nebraska
WHEREAS, Bank is the beneficiary under a Trust Deed dated April 2, 2007 and filed Apri19, 2007, at
Instrument Number 20071562 of the Records of Adams County, Nebraska to secure a loan in the original
principal amount of $14,575.24 to Lisa J. Stec and David Stec, wife and husband, as joint tenants, ("Borrower
(s)") and covering the following described real estate:
Lot Two (2), Block One (1), Westland first Addition to the City of Hastings, Adams County,
Nebraska, according to the recorded plat thereof
WHEREAS, Lender proposes to make a loan to Borrowers not to exceed the principal amount of
$71,000 to be secured by a first mortgage or trust deed upon real estate covered by the Trust Deed of Bank and
described as above, and,
WHEREAS, Lender has requested Lisa J. Stec and David Stec, wife and husband and Hastings State
Bank have agreed to subordinate the lien of its Trust Deed to the mortgage or trust deed to be taken by Lender,
NOW, THEREFORE, in consideration of the premises the parties agree as follows:
Bank hereby expressly subordinates the lien of the above described Trust Deed to the lien of any
mortgage or trust deed taken by Lerd~r fro*n Borro~~~ers and declares the lien of the Trust Deed to be junior and
inferior to the lien of Lender upon the lands described therein; provided, however, that the subordination of the
Trust Deed of Bank shall not apply or be effective as to any amounts, exclusive of interest, in excess of $71,000
secured by the mortgage„ or trust deed of Lender.
